Additional Ordinary Hours for Part. Time Employees (a) If a part-time employee has nominated Employee Availability that is a span of availability pursuant to 9.2(b)(ii), Xxxxxxx may roster that employee for additional ordinary hours above their guaranteed minimum hours set in accordance with clause 9.2(a) provided they are within the are tremendously less beneficial to employees than the rostering terms for part-time employees of the Awards copied in this row of this table. The Awards contain no 5-week limitation period, or any other limitation period, upon an employee’s right to ‘dispute’ the amount of wages paid to them. This Agreement term may also prevent, in a practical sense, an employee exercising their right under the Fair Work Act to recover unpaid wages for up to 6 years after the wages were payable. None of the above is declared by the employer in its F17A declaration.
