Employee Availability. (a) An employee designated for standby duty shall be available during her period of standby duty at a known telephone number or pager number and be able to report for duty as quickly as possible if called. (b) The Employer, at its own expense, will supply pagers to members of the bargaining unit who are designated for standby duty.

Employee Availability. Only employees who restrict to thirty-two (32) or fewer hours per week shall have the option of submitting an Availability Form. Employees who submit an Availability Form declaring the times and/or days they are available to work, must be available to work one (1) late shift per week and also have open availability on either Saturday or Sunday. Employees who restrict their hours to less than sixteen (16) hours per week must be available to work Saturday and Sunday. Employees may change their availability to a maximum of five (5) times per calendar year. Lifting their restriction to full availability does not count as one of the five (5) changes. Employees shall be required to work within their Restriction of Availability and may lose hours as a result. This means if a shift falls outside of an employee’s availability it shall not be subject to claim. If sufficient employees are not available to work on any day, the Employer may deny further requests to restrict such day(s). Requests to restrict will not be unreasonably denied.

Employee Availability. The Employee agrees to make himself or herself reasonably available to the Company to respond to requests by the Company for information pertaining to or relating to the Company and/or the Company’s affiliates, subsidiaries, agents, officers, directors or employees that may be within the knowledge of the Employee. The Employee will cooperate fully with the Company in connection with any and all existing or future litigation or investigations brought by or against the Company or any of its affiliates, agents, officers, directors or employees, whether administrative, civil or criminal in nature, in which and to the extent the Company deems the Employee’s cooperation necessary. The Company will reimburse the Employee for reasonable out- of pocket expenses incurred as a result of such cooperation. Nothing herein shall prevent the Employee from communicating with or participating in any government investigation.

Similarly, an employee on approved leave of absence or sick leave may bid on job postings within thirty (30) days of their documented expected date of return to work. 2. Consistent with this Agreement, any permanently assigned employee who fails a drug/alcohol test will relinquish his/her permanent assignment. When the employee is certified to return to work, the employee will be placed on the on call list by seniority until the next bid period. 3. Any permanently assigned employee who is medically unfit for duty will be eligible to return to his/her permanent assignment subject to fit for duty requirements. In the event that the employee is unfit for duty for more than six (6) months, the Employer retains the right to evaluate the status of the employee and to determine to bid the position as a permanent assignment. In the event the employee is certified to return to duty, the employee will be returned to his/her previous assignment as soon as practicable.

An employee returning from an absence of more than three hundred and sixty-five (365) calendar days will be reinstated to their former position which includes their shift, classification, and days off unless otherwise provided for by contract bidding requirements which occurred during the employee’s absence which would indicate and qualify the employee for a different shift.
