---ANNUAL PERFORMANCE TESTS. Annual Performance Tests verify ongoing compliance with the Contracts and establish plants capacities and efficiencies that are used to calculate contract payments, either for capacity or energy. Annual Performance Test responsibilities generally consist of (i) verification of testing procedures, (ii) witness of performance tests, (iii) review of test results and test reports for compliance with Contract terms and conditions, and (iv) identification of contract non-compliance for dispute resolution with the Supplier. Prior to the Transition Date, the Utility will cooperate and assist DWR with scheduling of upcoming Annual Performance Tests, and the Utility may have its staff witness such testing.

---ANNUAL PERFORMANCE TESTS. Unless required otherwise by applicable State or federal law and/or regulation, the Licensee shall conduct, on a bi-annual basis, performance tests to ensure compliance with the technical specifications in Section 3.5 supra and Exhibit 1 attached hereto, including, without limitation: a) Signal level of video carrier of each activated channel; b) System carrier to noise level(s) measured at a low and high VHF; c) System hum modulation measured at any one frequency. The costs of such tests shall be borne exclusively by the Licensee. Upon request, the above tests shall be submitted to the Issuing Authority, or his designee, on a bi-annual basis within thirty (30) calendar days after completion of such testing. Unless otherwise required by applicable law or regulation, said reports shall also include, without limitation, the name of the engineer who supervised the test; a description of test equipment and procedures used; measurement of locally receivable Signals; an assessment of the picture quality available from the access equipment; the weather conditions under which such tests were taken; measurements of Cable System performance as required in Section 3.5 supra; and a statement of the Licensee's adherence to all performance standards, and if said standards are not satisfactorily met, a statement as to what corrective action is to be taken.
---ANNUAL PERFORMANCE TESTS. The Project Company shall at its own cost conduct the Annual Performance Test every Contract Year at the times and in the manner specified under Schedule 2 (Design and Construction Standards) to confirm the Demonstrated Net Water Capacity of the Project Facilities. The Independent Expert shall observe, monitor and review the results of the Annual Performance Test to determine compliance of the Project Facilities with requirements of this Agreement.

  • Ongoing Performance Measures The Department intends to use performance-reporting tools in order to measure the performance of Contractor(s). These tools will include the Contractor Performance Survey (Exhibit H), to be completed by Customers on a quarterly basis. Such measures will allow the Department to better track Vendor performance through the term of the Contract(s) and ensure that Contractor(s) consistently provide quality services to the State and its Customers. The Department reserves the right to modify the Contractor Performance Survey document and introduce additional performance-reporting tools as they are developed, including online tools (e.g. tools within MFMP or on the Department's website).

  • Performance Review Where a performance review of an employee’s performance is carried out, the employee shall be given sufficient opportunity after the interview to read and review the performance review. Provision shall be made on the performance review form for an employee to sign it. The form shall provide for the employee’s signature in two (2) places, one (1) indicating that the employee has read and accepts the performance review, and the other indicating that the employee disagrees with the performance review. The employee shall sign in only one (1) of the places provided. No employee may initiate a grievance regarding the contents of a performance review unless the signature indicates disagreement. An employee shall, upon request, receive a copy of this performance review at the time of signing. An employee’s performance review shall not be changed after an employee has signed it, without the knowledge of the employee, and any such changes shall be subject to the grievance procedure of this Agreement. The employee may respond, in writing, to the performance review. Such response will be attached to the performance review.
