Application of Differential Sample Clauses
The 'Application of Differential' clause defines how differences in rates, prices, or other financial terms are calculated and applied between parties under a contract. Application of Differential. For nurses who have been regularly working a shift described in Section 12 for thirty (30) or more days immediately preceding a paid holiday, comp time off, or the beginning of a vacation or a paid sick leave period, the applicable differential shall be included in the nurse's holiday pay, vacation pay, paid sick leave, or paid comp time. The vacation, sick leave, holiday and comp time off pay of a nurse on a rotating shift shall include the differential such nurse would have received had he/she been working during such period.
Application of Differential. For unit members who have been regularly working a shift described in Section 8 for thirty or more calendar days immediately preceding a paid holiday, or the commencement of a vacation, or the commencement of a paid sick leave period, or compensatory time off, as the case may be, the applicable differential shall be included in such unit member's holiday pay, vacation pay, paid sick leave or paid compensatory time. The vacation, sick leave, holiday and compensatory time off pay of a unit member on a rotating shift shall include the differential such unit member would have received had he/she been working the same shift during such period.

(1) regularly working a shift described in Section 9, and/or
(2) assigned to and regularly working a special job assignment enumerated in Exhibit A of this MOU, and/or
(3) eligible for and receiving Career Incentive Allowance as provided in Section 14 for 30 or more calendar days immediately preceding a paid holiday, the commencement of a vacation, paid sick leave period, or comp time off, the applicable differential shall be included in such employee's holiday pay, vacation pay, paid sick leave or paid comp time.
