Application of Service Credits. Service credits will only apply to the monthly recurring fees Customer is responsible for paying for DDoS Mitigation Services, and shall not apply to any other services provided to Customer by Provider. A credit will be applied only to the month in which the event giving rise to the credit occurred. The maximum service credits issued in any one calendar month shall not exceed 100% of the MRC for the DDoS Mitigation Service. If Customer fails to notify Provider in the manner set forth herein with respect to the applicable service credits, Customer shall be deemed to have waived its right to any such credits for that month.
Application of Service Credits. Smartling will apply any Service Credits only against future Software Service payments otherwise due from Customer. Service Credits will not entitle Customer to any refund or other payment from Smartling. Unless otherwise provided in the Agreement, Customer’s sole and exclusive remedy for any unavailability, non-performance, or other failure by Smartling to provide a Software Service is the receipt of a Service Credit (if eligible) in accordance with the terms of this Section 2.
Application of Service Credits. Service Credits shall be derived by the Contractor from Service Level Reports. Each invoice submitted by the Contractor shall reflect and deduct from the Monthly Invoice, the Service Credits (if any) accrued during the invoice period. The total Service Credits for each Month shall be capped at 15% of the Monthly Invoice for the Month.
Application of Service Credits. 3.3.1 If BT agrees to take reasonable steps to expedite provision of the Service, in order to achieve an Operational Service Date which is earlier than the CCD, any date other than the CCD shall be treated as an estimate and Service Credits will not apply to that alternative date.
Application of Service Credits. 4.3.1 Service Credits will not be paid if the Qualifying Fault is not reported in accordance with BT’s fault reporting procedures.
4.3.2 For BTFR and BTATM Services only, where any single Qualifying Fault arises from one or more PVC failures that affect(s) more than one Site, Service Credits will be applied only to the Site with the lowest Site Charges. Where multiple Sites that are connected to a hub Site fail, then the total Service Credits for failure at those Sites will not exceed the Service Credits that would apply if only the hub Site had failed.
4.3.3 For Sites in India, faults on Access Lines will not be considered Qualifying Faults. (Access Line charges will be used in the calculation of Service Credits for all other Qualifying Faults).
Application of Service Credits. Any Service Credit shall be applied as an extension in days to the current Service Term for the affected Silverline DDoS Protection Services.

A Service Credit will be applicable and issued only if the credit amount for the applicable monthly billing cycle is greater than one dollar ($1 USD). Service Credits may not be transferred or applied to any other account.
