ARCHAEOLOGICAL FINDS. The Owner AGREES that it, or its agents, builders or contractors shall immediately cease work and notify the Ministry of Tourism, Culture and Sport, of any discovery of any archaeological resources, including but not limited to artifacts or burials, during development and housing construction. The Owner further AGREES that if during construction any archaeological or cultural heritage resources (including human remains) are found, that all work shall cease and the Ministry of Tourism, Culture and Sport be notified and only commenced with the Ministry’s concurrence.
ARCHAEOLOGICAL FINDS. The Site is located on an archeological sensitive area. If Licensee discovers any artifacts during excavation and/or construction, Licensee shall stop all affected work and notify Trustees. Trustees will employ, at Trustees’ cost and expense, the services of a Native American monitor and archeologist to be present whenever excavation of the Site occurs at any depth. Licensee is responsible to notify Trustees in advance of any digging or excavation so these monitors can be scheduled. If Licensee discovers human remains, Licensee shall notify Trustees who will be responsible for contacting the county coroner and a qualified archaeologist. Licensee shall be entitled to a day-for-day extension pursuant to Section 8.6 for any impact on schedule due to any delays or stoppage of installation work pursuant to this Section 8.16.] Applicable only on certain campuses.
ARCHAEOLOGICAL FINDS. Valuable minerals, fossils, articles or objects of antiquity or of anthropological or archaeological (including indigenous) interest and articles of value found on the Site shall as between the parties be and remain the property of Total. Immediately upon the discovery of these things the Sub-Contractor must:
a. take precautions to prevent their loss, removal or damage;
b. give Total immediate notice of the discovery;
c. comply with any directions of the Superintendent or relevant authority; and
d. (to the extent possible), continue to perform its obligations under the Sub-Contract.
ARCHAEOLOGICAL FINDS. .01 If the Contractor's operations expose any items that may indicate an archaeological find, such as building remains, hardware, accumulations of bones, pottery, or arrowheads, the Contractor shall immediately notify the Contract Administrator and suspend operations within the area identified by the Contract Administrator. Notification may be verbal provided that such notice is confirmed in writing within 2 Days. Work shall remain suspended within that area until otherwise directed by the Contract Administrator in writing, in accordance with clause GC 7.10, Suspension of Work.
.02 Any delay in the completion of the Contract that is caused by such a suspension of Work shall be considered to be an event entitling the Contractor to request payment for the cost of such delays in accordance with clause GC 3.07.01.
.03 Any Work directed or authorized in connection with an archaeological find shall be considered as Extra Work in accordance with clause GC 3.10.02,
ARCHAEOLOGICAL FINDS. The Owner further AGREES that if during construction any archaeological or cultural heritage resources (including human remains) are found, that all work shall cease and the Ministry of Citizenship and Multiculturalism be notified and only commenced with the Ministry’s concurrence. Within 300 metres of any waterbody/watercourse, or in an area of archaeological potential according to the Heritage Officer of the City, the Owner will submit a Phase 1 and Phase 2 archaeological study to the satisfaction of the City and the Province, and may be required to submit further phases of archaeological study, as required by the City or the Province as a result of the outcome of the Phase 1 and Phase 2 studies. No work will proceed unless and in accordance with the recommendations in the archaeological studies. In the case of a find of Indigenous origin, the Owner via their archaeologist will contact all potentially impacted First Nations, as that term is defined in Council Policy CP2022-007, and will consult with First Nations as per the requirements set out in that Policy.

During the life of this Contract the Contractor is herewith required to immediately notify the following organizations in the event that any articles such as "charcoal," "bone," "shell," "cultural objects - fire cracked stones or stone flaking material" or any other such related items of historical significance are discovered:
a) City by Title (Mayor, Director of Public Utilities, etc.);
b) Local Historical Society by Official name; and

If the remains are determined to be Native American, the CSU shall contact the appropriate tribal representatives to oversee removal of the remains.

If the Service Provider discovers human remains, the Service Provider shall notify the Corporation who will be responsible for contacting the county coroner and a qualified archaeologist. If the remains are determined to be Native American, the Corporation shall contact the appropriate tribal representatives to oversee removal of the remains.
