Architect's Certificate. The certificate of the Architect shall bind the parties as to: (a) the percentage of the Total Rentable Area of the Building damaged or destroyed; (b) whether or not the Premises are rendered untenantable and the percentage of the Premises rendered untenantable; (c) the date upon which either the Landlord's or Tenant's work of reconstruction or repair is completed or substantially completed and the date when the Premises are rendered tenantable; and (d) the state of completion of any work of the Landlord or the Tenant.

Architect's Certificate. To the extent that Borrower engages any architect during the term of the Loan in connection with the construction of Improvements at the Project, Borrower shall provide to Lender a certificate from any such architect of Borrower (“Borrower’s Architect”) certifying to Lender that: (1) the Plans and Specifications to the Project comply, in all material respects, with all Development Requirements and Project Agreements; (2) if the Project is constructed in accordance with the Plans and Specifications, the Project will comply with all applicable Development Requirements and Project Agreements; (3) all permits, licenses and approvals necessary for construction and completion of the Project have been issued by all environmental protection and other governmental agencies as having jurisdiction over the Project or will be obtained by Borrower prior to the date Borrower takes any actions requiring the same to be obtained; and (4) adequate ingress and egress to the Premises is available over public streets, rights of way or perpetual easements.
Architect's Certificate. An Architect’s certificate executed by Borrower’s Architect, if applicable, certifying with respect to those matters deemed necessary by Lender regarding the items to be paid pursuant to the applicable Request for Advance, the current status of the construction of the Improvements, the current accuracy of the Project Budget and such other matters as Lender deems relevant to the proposed Request for Advance.

Architect's Certificate. It is understood and agreed by Tenant that wherever a certificate of the Architect is required or deemed appropriate by Landlord, the certificate of the Architect shall bind the parties hereto as to completion of construction of the Premises and the availability of services, the percentage of the Premises or Building destroyed or damaged and the number of days required to make repairs or reconstruct and the state of tenantability of the Premises, and the state of completion of any work or repair of either Landlord or Tenant.

Architect's Certificate. The certificate to be issued by Architect either (i) if Landlord is not designated by Tenant to perform Tenant's Work, that Landlord's Work has been completed in accordance with the Plans and Specifications, to the extent necessary so that Tenant may commence Tenant's Work, or (ii) if Landlord is designated by Tenant to perform Tenant's Work, that the Building and the Demised Premises have been Substantially Completed in accordance with the Plans and Specifications.
Architect's Certificate. The Architect’s Certificate will certify all of the following: (1) All items set forth in Section 7.03(c)(iv)(A)(2) - (4). (2) That the Release Parcel, the remainder of the Mortgaged Property after the Land Release, and the construction of the Additional Improvements, will each comply with all applicable zoning, building, subdivision, land use, parking and other requirements of any Governmental Authority that are applicable to the Release Parcel and the Mortgaged Property. (3) That construction of the Additional Improvements on the Release Parcel will not affect the utility or operation of the Mortgaged Property (excluding the Release Parcel) in any material adverse respect. (4) That any connection to, or contemplated shared use of, other portions of the Mortgaged Property in order to provide utility services and access to the Release Parcel will not affect the availability of any such services or access to the Mortgaged Property.
Architect's Certificate. Whenever for any purpose of this Article an opinion or certificate of the Architect Is required, the same shall be given in writing to both Landlord and Tenant. Landlord covenants that it shall request such opinion or certificate promptly following the event which gives need for same and shall cause the Architect to act diligently and expeditiously. The certificate of the Architect shall bind the parties: (a) as to whether or not the Premises are untenantable and the extent of such untenantability; and (b) with respect to the time required for and the date upon which the Landlord’s work or Tenant’s work of reconstruction or repair Is commenced or completed or substantially completed and the date when the Premises are rendered tenantable. If either Landlord or Tenant wishes to make representations or reasonable objections to the Architect regarding the Architect’s opinions in the certificate, the parties shall have an opportunity to do so forthwith and the certificate will not be binding until the Architect has considered the representations or objections and amended the certificate if the Architect deems such amendment appropriate.
