Artefacts. 6.4.1 Subject to 6.4.2, when this agreement ends for any reason, any artefacts which belong to one partner authority but which are in the custody of the other partner authority shall, if requested, be returned to the owner. 6.4.2 Where this agreement ends and artefacts are stored by one party on behalf of the other party, then to the extent that those artefacts are not collected by the owner within 1 month from the date of termination, the storing party shall continue to store artefacts for 1 year from the date of termination, subject to the payment of reasonable storage charges by the owner.

Artefacts. Any artefacts discovered on or under the surface of the Construction Area is the absolute property of the Landlord and must be notified to the Landlord.

In this operation mode, a set of two point light sources corresponding to a vehicle passing beam headlamp each having a reference luminous intensity 1,750 cd and being separated each other laterally by 1.3 m and located at a distance of 250 m away from the CMS shall be distinguishable as two point light source. This requirement is applicable to Class I, Class II and Class III devices for indirect vision.

If the system is in a mode where point light sources are not rendered as described above, this shall be indicated to the driver. The information indicated shall be explained in the operator's manual.

(b) If an Artefact is discovered on the Site or any part of it, then Project Co must: (i) immediately notify the State of that discovery; (ii) take every reasonable precaution to prevent the Artefacts from being damaged or removed until appropriate arrangements for dealing with, or removing, the Artefacts have been made; (iii) continue to perform its obligations in accordance with this Agreement, except to the extent otherwise: A. directed by the State; B. ordered by a court or tribunal; or C. required by Law; and (iv) comply with any direction of the State or State Associates in connection with any Artefact.

(b) If an Artefact is discovered in the Health Campus or any part of it, then the Operator must: (i) immediately notify the State of that discovery; (ii) take every reasonable precaution to prevent Artefacts being damaged or removed until appropriate arrangements for dealing with, or removing, the Artefacts have been made; (iii) continue to perform its obligations in accordance with this Agreement, except to the extent otherwise: A. directed by the State; B. ordered by a court or tribunal; or C. required by Law; (iv) at the request of the State, provide all reasonable assistance in connection with the discovery of the Artefact; and (v) comply with any direction of the State in respect of any Artefact.

(b) If an Artefact is discovered in the Site or any part of it, then the Operator must: (i) immediately notify the State of that discovery; (ii) take every reasonable precaution to prevent Artefacts being damaged or removed until appropriate arrangements for dealing with, or removing, the Artefacts have been made; (iii) continue to perform its obligations under this Agreement, except to the extent otherwise: A. directed by the State; B. ordered by a court or tribunal; or C. required by Law; (iv) at the request of the State, provide all reasonable assistance in connection with the discovery of the Artefact; and (v) without limiting the Operator's right to seek reimbursement or compensation pursuant to this Agreement, comply with any direction of the State in respect of any Artefact.
Artefacts. (a) Artefacts found on or under the Site will, as between the parties, be and remain the property of Tetra Tech. (b) The Contractor must: (i) as soon as reasonably practicable and in any event within 5 Business Days of discovery, notify Tetra Tech when any Artefacts are found, and immediately take precautions to prevent their loss, removal or damage; (ii) notify Tetra Tech’s Representative immediately of any direction or order received from any relevant Government Agency in respect of such Artefacts and provide copies of such directions or order to Tetra Tech; (iii) comply with any direction from Tetra Tech or any directions or orders received from any relevant Government Agency by the Contractor or Tetra Tech in respect of such Artefacts; and (iv) permit and allow Tetra Tech, the relevant Government Agency responsible for such Artefacts or any person authorised by Tetra Tech to watch or examine any excavations on the Site. (c) If compliance with any direction under this Clause 6.6 causes the Contractor to incur more or less cost than otherwise would have been incurred had the Contractor not been given the direction, the difference will be valued as a Variation in accordance with Clause 18.8.
