Auxiliary Employees. A seniority pool will be established for Auxiliary Employees. Access to each Auxiliary Seniority Pool will be extended to all Auxiliary Employees as follows: (a) As soon as an Auxiliary Employee has worked 1200 hours within two consecutive calendar years, such employee will gain entry onto the auxiliary seniority list in their jurisdiction and will be deemed to possess seniority. Auxiliary Employees. A The Parties recognize that it is beneficial to both the Company and Employees that auxiliary employment opportunities be made available to help supplement the regular full-time workforce, afford Employees more opportunities for time-off, and reduce the Company’s utilization of Supplemental Staffing. Auxiliary employment opportunities meet the following needs of the business: Approved time off such as leaves of absence, vacation and crew down To help provide coverage for absenteeism To help reduce situations of mandatory overtime Program launches and quality containment situations To provide coverage for illness and disability-related leaves and accommodation issues To provide weekend and holiday coverage Emergency situations Other situations as agreed to by Management and the Union Auxiliary Employees will not be utilized while any seniority pool Employees are on lay-off, and regular full time Employees will be canvassed for premium overtime opportunities (i.e. weekends and holidays) prior to Auxiliary Employees being utilized. Auxiliary Employees must be available to work on a consistent as-needed basis, subject to the operational needs of each Plant. Auxiliary Employees must be at least 18 years of age. Auxiliary Employees will be eligible to work on either a part-time or full-time basis. The plant-specific allocation between part-time and full-time Auxiliary Employees will be determined based on the operational needs of each plant and set out in the respective Local Appendix. Unless otherwise agreed to by the Parties, the number of Auxiliary Employees utilized by a Plant will not exceed a number equal to fifteen percent (15%) of the number of seniority employees. The Parties acknowledge that the Company’s utilization of Part-Time Students will be accommodated under this Auxiliary Employee program. Auxiliary Employees will be eligible for overtime pay, statutory holiday pay, and vacation pay in accordance with the Employment Standards Act, 2000 (as amended from time to time). Auxiliary Employees will be eligible for shift premiums at the applicable rate of a new full-time hire. Auxiliary Employees will be subject to a sixty (60) shift trial period. Following successful completion of the sixty (60) shift trial period, Auxiliary Employees will be eligible for safety shoes. At all times, retention of Auxiliary Employees shall be at the sole discretion of the Company. Auxiliary Employees will be paid at the rate established by each plant’s Local Appendix. The Employee Advocate will be provided with an Auxiliary Employee hours worked summary, as well as a seniority list and overtime equalization list, on a monthly basis to be discussed at monthly manpower meetings with the General Manager. Except as stated in this Memorandum of Understanding, Auxiliary Employees will not be eligible for any employment-related benefits or rights conferred by the Collective Bargaining Agreement and will not otherwise acquire seniority rights. Auxiliary Employees will not be used to establish a production standard on any operation. Should an Auxiliary Employee be hired for a full-time opportunity, he/she will serve an abbreviated probationary period equal to 30 shifts provided that he/she has, at the time of the full-time hire, worked as an Auxiliary Employee has worked 1200 hours within two consecutive calendar years, such employee will gain entry onto at the auxiliary seniority list in their jurisdiction and will be deemed to possess seniorityDivisions for a minimum of 2080 hours.

(ii) if the Auxiliary Employee is one of several registered and qualified applicants, the appointment to the said position shall be based on their relative skills, knowledge and ability, and if their skills, knowledge and ability are considered to be equal, then the registered and qualified applicant possessing the greatest total Auxiliary seniority with the City shall be appointed.

Auxiliary Employees. A seniority pool Seniority Pool will be established for Auxiliary Employees. Access to each Auxiliary Seniority Pool will be extended to all Auxiliary Employees as follows:
(a) As soon as an Auxiliary Employee has worked 1200 hours within two consecutive calendar years, such employee will gain entry onto the auxiliary Auxiliary seniority list in their jurisdiction and will be deemed to possess seniority.
(b) Upon gaining entry onto the Auxiliary seniority list, an employee will be credited with the number of hours worked in any class of positionsor position, and will hold class seniority in any such class accordingly.
(c) An employee who has gained entry onto the Auxiliary seniority list, will continue to accumulate class seniority in any class in which the employee works in accordance with the number of hours worked in a position within such class.
(d) An Auxiliary Employee's seniority will be lost as the result of a break in service with the City Board which exceeds one year.
(e) Where pay ranges exist, eligibility for advancement from one step to the next (increment) shall be based on the number of hours served by a Regular Full-Full- Time Employee for such eligibility.
(f) In accordance with the Regional Memorandum of Agreement dated 1978 April 21, the City has determined that Auxiliary class seniority is to be exercised departmentally with the exception of the Parks and Engineering Departments where class seniority is to be exercised within the following divisions: - Administration - Operations - Aquatics - Concessions - Fine Arts - Playgrounds and Centres - Rinks - Museum Engineering - Administration - Operationsbargaining unit-wide.
(g) In the event of a layoff of Auxiliary Employees within a class, those employees having greatest seniority within the class shall be the last ones laid off.
(h) Except in cases of inclement weather, strikes, lockouts lockouts, or other circumstances beyond the control of the CityBoard, the City Board shall notify Auxiliary Employees, who have acquired seniority rights, and who are to be laid off, at least ten (10) working days prior to the effective date of layoff. If the employee has not had the opportunity to work during the ten (10) days referred to above, the employee shall be paid for those days for which work was not made available.
(i) Other than as might be provided for pursuant to the terms of paragraph (g) herein, no Auxiliary Employee shall have the right to bump another employee after having been laid off.
(j) An Auxiliary Employee having class seniority, and having been laid off, must, if the employee wishes to be considered for future Auxiliary employment, elect to register with the City Board for future Auxiliary employment in which case the employee will be given preference in hiring for future vacancies within various classes on the basis of the employee's class seniority.
(k) Registration for future Auxiliary employment will be made upon a standard form which will be signed and dated by the applicant and which will state the classes within which the applicant would be willing to accept a position. The completed form will be signed and dated by an authorized representative of the City Board and both the applicant and the Union will be provided with a copy by way of receipt.
(l) When an Auxiliary Employee who has attained class seniority, who has been laid off and who has registered for future auxiliary Auxiliary employment, also registers a desire to be taken into consideration for Auxiliary work in a class for which the employee does not possess class seniority, such employee shall be taken into consideration for appointment to a position within such new class on the basis of the employee's skills, knowledge and ability, and in any case where there is no registered applicant possessing seniority in the new class in question, and where the employee's skills, knowledge and ability are sufficient so as to render the employee qualified, then
(i) if the Auxiliary Employee is the only registered and qualified applicant, the employee shall be appointed to the said position.
