Banked Overtime. (a) Compensating time off shall not be given in lieu of overtime pay unless the employee so chooses. Employees who wish to bank overtime must confirm same in writing to the Company between March 1st and March 15th and again between September 1st and September 15th of each calendar year. Employees shall be entitled to cancel their decision to bank overtime at any time. In such cases, the employee shall provide the Company with a written notice confirming same, and shall not be eligible to resume banking overtime until the following March 1st or September 1st, as the case may be. (b) Accumulated banked overtime hours shall be shown on the employee's weekly pay stub until implementation of the Workbrain System, at which point such information will be available for review through that System. (c) Banked overtime shall accumulate at the rate of one and one-half (1½) or two (2) hours of paid time off, as the case may be, for each hour of overtime worked. Banked Overtime. (d) Employees shall have the option of cashing in all or any portion of said banked overtime at any time he or she chooses. Banked overtime that is subsequently cashed in by an employee shall be paid to the employee at the regular hourly rate of pay said employee was being paid at that time. Banked Overtime. Transit Operators may bank a maximum of seventy-five (a75) Compensating hours of overtime in a payroll year.
1) This banked time may be used in single or part day increments according to the following:
a. Employees must show their intent to bank either 37.5 or 75 hours overtime at the time of the Annual Vacation sign-up by signing the overtime banking intent sheet.
b. Overtime shall be banked commencing in the first pay period of the pay year, then in subsequent pay periods until the maximum elected accumulation has been reached, after which all overtime beyond the elected accumulation will be paid.
c. The scheduling of any banked time off shall not be subject to staffing requirements as determined by the Employer.
2) Any unused portion in a Transit Operator's overtime bank may be paid out at any time at the request of the transit operator, subject to the following;
a. the request shall be made in writing;
b. the written request must be given to the Depot Supervisor not less than seven (7) calendar days prior to the commencement of the pay period in lieu which the Transit Operator wishes to receive the overtime bank pay-out;
c. the overtime bank pay-out will be included in the Transit Operator's paycheque;
3) Any unused portion of a Transit Operator's overtime pay unless bank remaining at the employee so chooses. Employees who wish end of the payroll year shall be carried over to the following payroll year to an amount not exceeding:
a. seventy-five (75) hours, if the Transit Operator has elected to bank overtime must confirm same in writing to the Company between March 1st and March 15th and again between September 1st and September 15th of each calendar year. If, however, at the end of the contract year, an employee has less than eight (8) hours banked whatever period of time remaining in the bank may be taken as time off and may not be carried over into the next contract year.
(v) Time off for overtime hours must be requested by the employee in advance and may only be taken at a time mutually convenient to the Employer and the employee.

Banked Overtime.

Banked Overtime. For each overtime hour worked an employee shall have the option of receiving overtime pay at the evaluated rate or banking time at the equivalent evaluated rate. This clause shall apply to all classifications of "both permanent and non- permanent employees." The employee must designate at the time of work their choice of cash payment or time. An employee may bank the dollar equivalent of one hundred and twenty (a120) Compensating hours evaluated pay. Once an employee has banked the dollar equivalent of one hundred and twenty (I20) hours evaluated pay, any subsequent overtime worked shall be paid at the applicable overtime rates. When an employee is assigned by the head of a department to substitute for any period of time in a position that is not covered by this Collective Agreement, the employee shall receive the lesser of a thirteen percent (13%) wage increase or the maximum for the position, but in no case will the employee receive less than they are currently being paid. Senior work assignments of a seasonal nature shall be posted in accordance with Article Any non-permanent employee reporting for work and March 15th and again between September 1st and September 15th being sent home by the xxxxxxx or supervisor because of each calendar year. (c) Banked overtime shall accumulate at the rate of one and one-half (1½1.5) or hour’s pay at the employee’s current rate of pay. If any employee works two (2) or more hours of paid time offin any regular one-half day before being sent home they shall be entitled to the full one-half day at the appropriate rate. A maximum of four (4) employees per day shall be entitled to use their banked overtime. These amounts may be increased from time to time at the discretion of the Company.
(f) All banked time off requests must be submitted by the Monday of the week preceding the requested time off. The minimum amount of such time off that can be taken at any one time shall be four (4) hours. The Employer agrees to respond to the employee’s request within twenty-four (24) hours. Should no response be given by the Employer, then permission for the time off will be deemed to have been granted
(g) For the purpose of using banked overtime for regularly scheduled days off (excluding shut downs), In each employee shall have the ability to use a maximum of forty (40) hours while working eight (8) hour shifts and forty-eight (48) hours while working continental shifts per calendar year. All other overtime banked shall be paid out to employees upon request. Should an employee want to take off more than the maximum hours off noted above per calendar year, a written request the City will reimburse, upon receipt, apprentice mechanics and journeyman mechanics up to towards the replacement or repair of consumable tools (as per consumable tool list). All metric tools required for and over shall be provided by the Employer and shall remain the property of the City. The City will provide fire and theft insurance for the mechanic's tools under its umbrella insurance policy. The mechanics will be submitted to responsible for paying the Company deductible ($500) for consideration and will be approved at the Company’s discretionany claims.
(h) No requests for time banked time off for regularly scheduled days off, between April 15th – December 31st of each year will be approved until after the vacation planner has been finalized for the year. Once the planner has been finalized all requests will be granted on a first come first serve basis.
(i) No employees will have the ability to request regularly scheduled days off (excluding shut downs) during the prime time vacation period for the use of banked overtime.
(j) All employees hired after April 15, 2015 will not be eligible to bank overtime.

Banked Overtime. (a) An employee who has worked overtime and who requests compensating time off in lieu of being paid for overtime shall be credited with such compensating off providing the granting of such time off shall be at the discretion of the department head. Compensating time off will be equivalent to the number of hours for which the employee would have been paid for the overtime worked. (Such overtime shall be calculated in the manner set forth in Clause If all of the credited compensating time off has not been used by August October October of the next year following the year in which the overtime was worked entitling the employee to such compensating time off, or prior to leaving the service of the Employer for any reason, whichever event occurs first, the employee shall be paid in cash for the overtime for which no compensation was received at the rate at which it was earned. The following provisions shall apply to Regular Full-Time Employees and Temporary Full-Time Employees: An employee who is called back to work by the Employer at any time after the completion of the regular shift, except where such employee is required to work overtime as a consequence of an oral or written notice given prior to the end of the employee's previous shift as provided in Clause shall be paid at the rate of double the regular rate of pay for the time actually worked and in addition thereto one (1) hour at double the regular rate of pay for travelling time to and from home. Except as otherwise provided in Clause an employee who is called back to work under this Section shall be paid a minimum of three (3) hours (the minimum includes one (1) hour for travelling time) at double the regular rate of pay. If, after a callout, an additional call or calls are made upon the employee before the expiry of the minimum three (3) hour period or before arrival home, whichever shall last occur, the additional call or calls shall not be given in lieu of overtime pay unless qualify the employee so choosesfor an additional minimum three (3) hour period or periods but the employee shall be paid at double the regular rate of pay for the time actually worked and an additional one (1) hour at double the regular rate of pay for travelling time to and from home. Where two (2) separate calls are completed by the employee within a three (3) hour period the employee shall be paid at double the regular rate of pay for a minimum of four (4) hours (the minimum includes two (2) hours for travelling time). Notwithstanding the callout minimum, an employee who is at the work place prior to the commencement of the employee's regular shift and who is required to commence work prior to the commencement of the employee's regular shift, shall be paid in accordance with the overtime provisions for the actual time worked prior to the commencement of the employee's regular shift. Banked Overtime. Transit Operators may bank a maximum of seventy-five (75) hours of overtime in a payroll year.
1. This banked time may be used in single or part day increments according to the following:
(a) Compensating time off shall not be given in lieu of overtime pay unless the employee so chooses. Employees who wish must show their intent to bank overtime must confirm same in writing to the Company between March 1st and March 15th and again between September 1st and September 15th of each calendar year. Employees shall be entitled to cancel their decision to bank either 37.5 or 75 hours overtime at any time. In such cases, the employee shall provide time of the Company with a written notice confirming same, and shall not be eligible to resume Annual Vacation sign-up by signing the overtime banking overtime until the following March 1st or September 1st, as the case may beintent sheet.
(b) Accumulated banked overtime hours Overtime shall be shown on banked commencing in the employee's weekly first pay stub until implementation period of the Workbrain Systempay year, at then in subsequent pay periods until the maximum elected accumulation has been reached, after which point such information all overtime beyond the elected accumulation will be available for review through that Systempaid.
(c) Banked The scheduling of any banked time off shall be subject to staffing requirements as determined by the Employer.
2. Any unused portion in a Transit Operator's overtime shall accumulate bank may be paid out at any time at the rate request of one the transit operator, subject to the following;
(a) the request shall be made in writing;
(b) the written request must be given to the Depot Supervisor not less than seven (7) calendar days prior to the commencement of the pay period in which the Transit Operator wishes to receive the overtime bank pay-out;
(c) the overtime bank pay-out will be included in the Transit Operator's paycheque;
(d) a Transit Operator who has requested to have his or her overtime bank paid out will not be permitted to bank any overtime hours for the remainder of the payroll year.
3. Any unused portion of a Transit Operator's overtime bank remaining at the end of the payroll year shall be carried over to the following payroll year to an amount not exceeding:
(a) seventy-five (75) hours, if the Transit Operator has elected to bank that amount for the following payroll year; or
(b) thirty-seven and one-half (1½37½) or two (2) hours, if the Transit Operator has elected to bank that amount for the following payroll year and any amount in excess of 37½ hours of paid time off, as the case may be, for each hour of overtime worked. Employees shall only bank overtime exceeding one (1) hour. If overtime worked does not exceed one hour, such overtime shall remaining will be paid outout in the paycheque for the first pay period of the following payroll year.
4. The Employer will make available a slot each day (dFridays and statutory holidays not included) Employees shall have the option of cashing in all or any portion of said banked overtime at any time he or she chooses. Banked overtime that is subsequently cashed in by an employee shall be paid to the employee at the regular hourly rate of pay said employee was being paid at that time. All banked overtime must be used or cashed in by the end of the calendar year in which it was earned, unless otherwise mutually agreed to between the employee concerned and the Company.
