Common use of Benefits While on Leave Clause in Contracts

Benefits While on Leave. (a) Members who are on leave with pay shall be entitled to continue to participate in these benefit plans on the same basis as members who are not on leave. The Employer and the member shall each continue to pay their respective shares of benefit premiums. (b) Members who are on pregnancy leave, parental leave, or sick pay or long-term disability leave, whether paid or unpaid, shall be considered to be on leave with pay for the purposes of determining benefit entitlements. (c) Members who are on unpaid leave shall be entitled to participate in any of the benefit plans during their leave provided that they pay for both the Employer’s and the member’s shares of the relevant benefit plans.
