Common use of Breaking of Seniority Clause in Contracts

Breaking of Seniority. Seniority shall be broken by discharge, resignation, retirement, layoff, or movement into a different category of position. If a reduction in force is in effect, the Employee shall retain seniority for recall purposes. However, seniority shall not accrue while an Employee is not working as a result of a reduction in force. When an Employee moves into a different category of position, she/he will not carry her/his seniority to the new category of positions, however, she/he will retain but not accrue seniority in the previous category of position.
