Broadband. Broadband infrastructure that is designed to provide service to unserved or underserved households and businesses and that is designed to, upon completion: (i) Reliably meet or exceed symmetrical 100 Mbps download speed and upload speeds; or (ii) In cases where it is not practicable, because of the excessive cost of the project or geography or topography of the area to be served by the project, to provide service meeting the standards set forth in paragraph (e)(2)(i) of this section: (A) Reliably meet or exceed 100 Mbps download speed and between at least 20 Mbps and 100 Mbps upload speed; and (B) Be scalable to a minimum of 100 Mbps download speed and 100 Mbps upload speed.

Broadband. 4.1 In order to use the VOIP Service, it is the Customer’s respon- sibility to procure at its cost a Broadband connection, either through Company or through a supplier approved by Com- pany. 4.2 Where Broadband is supplied by a third party, then Company does not assume any liability or responsibility for the third party Broadband service.

If an alternative unapproved Broadband connection is to be supplied by the customer, then Vaioni will require the customer to sign a disclaimer with regards to Quality of Service. 4.3 Vaioni will not be responsible for any failure to deliver the Service when the obligation set out in Clause 4.1 and 4.2 has not been fulfilled.
Broadband. The Broadband agreement runs for the term detailed on the order form and or line rental agreement, it will be renewed unless notice of termination is provided. The Broadband agreement may be terminated with effect from the end of the Agreement minimum term, or any subsequent anniversary thereof, by either party giving at least 90 days’ notice to the other to expire on the last day of the Agreement Term or on an anniversary of that day.

Broadband. 8.1 We will endeavour to activate your broadband service by the date notified to you following your order, however all dates are estimates and we cannot guarantee that they will be met. 8.2 When the broadband service is being activated at your premises, you may lose your telephone service for approximately two hours as your existing connection needs to be adjusted to allow you to access the broadband service. We will endeavour to make any loss of telephone service as brief as possible however where we need to work with a third party to make your connection the timing may be outside of our control. 8.3 We cannot accept any liability for any costs, expenses, losses, damages or other liabilities (howsoever arising) which you may incur as a result of the timing of the activation or the period of any loss of service referred to in clause 8.2 above.

In addition, AB 127 the General Government trailer bill establishes a new State Broadband Enterprise Middle-Mile Fund for the continued operational support and lease of state middle-mile investments and includes trailer bill language to extend the California Public Utilities’ Last Mile Program application deadlines until September 2024.
