Broadcast Station Programming Policy Statement. Licensee has adopted and will enforce a Broadcast Station Programming Policy Statement (the "Policy Statement"), a copy of which appears as Attachment III hereto and which may be amended in a reasonable manner from time to time by Licensee upon notice to Programmer. Programmer agrees and covenants to comply in all material respects with the Policy Statement, to all rules and regulations of the FCC, and to all changes subsequently made by Licensee or the FCC. Programmer shall furnish or cause to be furnished the artistic personnel and material for the programs as provided by this Agreement and all programs shall be prepared and presented in conformity with the rules, regulations and policies of the FCC and with the Policy Statement set forth in Attachment III hereto. All advertising spots and promotional material or announcements shall comply with applicable federal, state and local regulations and policies and shall be produced in accordance with quality standards established by Programmer. If Licensee determines that a program supplied by Programmer is for any reason, within Licensee's sole discretion, unsatisfactory or unsuitable or contrary to the public interest, or does not comply with the Policy Statement it may, upon prior written notice to Programmer (to the extent time permits such notice), suspend or cancel such program without liability to Programmer. Licensee will use reasonable efforts to provide such written notice to Programmer prior to the suspension or cancellation of such program.
Broadcast Station Programming Policy Statement. I. No Plugola or Payola. Except for commercial messages aired in compliance with 47 C.F.R. (S)73.1212, Programmer shall not receive any consideration in money, goods, services, or otherwise, directly or indirectly (including to relatives) from any persons or company for the presentation of any programming over the Stations without reporting the same to Licensee's station managers. The commercial mention of any business activity or "plug" for any commercial, professional, or other related endeavor, except where contained in an actual commercial message of a sponsor, is prohibited.
Broadcast Station Programming Policy Statement. Licensee's Broadcast Station Programming Policy Statement (the "Policy Statement"), a copy of which is annexed hereto as Attachment II, may be amended in a reasonable manner from time to time by Licensee upon notice to Programmer. Programmer shall comply in all material respects with the Policy Statement, with all rules and policies of the FCC, and with all changes subsequently made by Licensee or the FCC in any of the foregoing: provided, that no breach of the provisions of such Policy Statement or the FCC rules and policies by Programmer shall be a cause for termination of this Agreement unless such breach or a series of such breaches would reasonably be expected to cause revocation or non-renewal of the Station's FCC Licenses. Licensee's recourse for any other breach of Programmer's obligation in the preceding sentence shall be limited to (a) recovery of Damages, as defined below, suffered by Licensee with respect thereto and (b) Programmer's immediate discontinuance and, if applicable, cure of any such breach. Programmer shall furnish or cause to be furnished the artistic personnel and material for the programs as provided by this Agreement and all programs shall be prepared and presented in conformity with the rules, regulations and policies of the FCC and with the Policy Statement. All advertising spots and promotional material or announcements shall comply with applicable federal, state and local regulations and policies and shall be produced in accordance with quality standards established by Programmer. If Licensee determines, in the exercise of Licensee's sole discretion, that any broadcast material supplied by Programmer is for any reason unsatisfactory, unsuitable or contrary to the public interest, or does not comply with the Policy Statement, Licensee may, upon prior written notice to Programmer (to the extent time permits such notice), suspend or cancel the broadcast of such material without incurring liability to Programmer. Licensee will use reasonable efforts to provide such written notice to Programmer prior to the suspension or cancellation of such material. Programmer shall use reasonable efforts to notify Licensee 24 hours in advance of material changes in the programming provided by Programmer for broadcast on the Station.
Broadcast Station Programming Policy Statement. Licensee agrees to adopt and enforce the Broadcast Station Programming Policy Statement set forth hereto as Attachment IV (the "Policy Statement"), which may be amended from time to time by Licensee upon notice to Programmer. Programmer agrees and covenants to comply in all material respects with the Policy Statement, with all rules and regulations of the FCC, and with all reasonable changes subsequently made by Licensee or the FCC. If Licensee reasonably determines that a program supplied by Programmer does not comply with the Policy Statement it may suspend or cancel such program and shall provide written notice to Programmer of such decision. All Programming shall comply with the Policy Statement, the Communications Act and FCC rules and regulations. All advertising spots and promotional material or announcements included in the Programming shall comply with applicable federal, state and local regulations and policies, the Policy Statement, and shall be produced in accordance with quality standards established by Programmer.
Broadcast Station Programming Policy Statement. Owner has adopted a Broadcast Station Programming Policy Statement (the “Policy Statement”), a copy of which is attached as Schedule I and which may be amended from time to time by Owner upon notice to Programmer. Programmer agrees and covenants to comply in all material respects with the Policy Statement, with the Act and all FCC Rules, and with all changes subsequently made by Owner or the FCC. Programmer shall furnish or cause to be furnished the artistic personnel and material for the programs as provided by this Agreement and all programs shall be prepared and presented in conformity with the Act, the FCC Rules and with the Policy Statement. All advertising spots and promotional material or announcements shall comply with the Act, the FCC Rules, and all other applicable federal, state and local regulations and policies and the Policy Statement, and shall be produced in accordance with quality standards established by Programmer. If Owner in its sole discretion determines that a program, commercial announcement or promotional material, or any portion thereof, supplied by Programmer is contrary to the public interest, or does not comply with the Policy Statement, the Act or the FCC Rules, it may act pursuant to Section 1.6. The submission by Programmer of any programming, announcement, advertising or other matter that is slanderous, defamatory, obscene or indecent and therefore in violation of the Policy Statement, or that is otherwise in violation of the Policy Statement, shall constitute a material breach of this Agreement, and shall entitle Owner, at its sole discretion, to terminate this Agreement immediately, effective within 24 hours of notice by Owner to Programmer of such termination, notwithstanding the provisions of Section 6.
Broadcast Station Programming Policy Statement. The FCC Licensee has adopted, and the FCC Licensee and Freedom will enforce, a Broadcast Station Programming Policy Statement (the "Policy Statement"), a copy of which appears as Attachment III hereto. Programmer agrees and covenants that all pro gramming, advertising spots, promotional material and announcements that it provides for broadcast on the Station shall comply in all material respects with (i) the Policy Statement; (ii) all applicable federal, state and local laws and regulations, including the rules and regulations of the FCC and the Federal Trade Commission ("FTC'), and the Communications Act of 1934, as amended ("Act"); and (iii) all subsequent changes to such rules and regulations and the Act. Programmer acknowl edges that Freedom has not urged, counseled or advised the use of any unfair business practice. If either Freedom or the FCC Licensee determines that a program supplied by Programmer, within its sole discretion, does not comply with the Policy Statement or conform to the rules and regulations of the FCC is may, upon prior written notice to Programmer (to the extent time permits such notice), suspend or cancel such program without liability to Freedom or the FCC Licensee, subject to Section 7.2 herein. Freedom will use reasonable efforts to provide such written notice to Programmer prior to the suspension or cancellation of any such program, subject to the notice provided to it by the FCC Licensee.
Broadcast Station Programming Policy Statement. ARS has adopted and will enforce a Broadcast Station Programming Policy Statement (the "Policy Statement"), a copy of which appears as Attachment I hereto and which may be amended to meet changing regulatory requirements by ARS upon reasonable advance written notice to Programmer. Programmer agrees and covenants to comply in all material respects with the Policy Statement and with all rules and regulations of the Commission. If ARS reasonably determines that a program, commercial or other material supplied by Programmer does not comply with the Policy Statement, or ARS reasonably believes that some or all of a program, commercial or other material is unsuitable or contrary to the public interest, it may suspend or cancel such program, commercial or other material and shall provide written notice to Programmer of such decision. Programmer shall provide programs only in accordance with the Policy Statement and Commission requirements. All advertising spots and promotional material or announcements shall comply with applicable federal, state and local regulation and policies and the Policy Statement, and shall be produced in accordance with quality standards established by ARS.
Broadcast Station Programming Policy Statement. Licensee has adopted a Broadcast Station Programming Policy Statement (the "Policy Statement"), a copy of which appears as Attachment 3.1 hereto and which may be amended from time to time by Licensee upon notice to Programmer. Programmer agrees and covenants to comply in all material respects with the Policy Statement, with all rules and regulations of the FCC, and with all changes subsequently made by Licensee or the FCC. Programmer shall furnish or cause to be furnished the artistic personnel and material for the programs as provided by this Agreement and all programs shall be prepared and presented in conformity with the rules, regulations and policies of the FCC and with Policy Statement set forth in Attachment 3.1
Broadcast Station Programming Policy Statement. ICFG has adopted and will enforce a Broadcast Station Programming Policy Statement (the "Policy Statement"), a copy of which appears as Attachment 3 hereto and which may be amended in a reasonable manner from time to time by ICFG upon notice to SBS. SBS agrees and covenants to comply in all material respects with the Policy Statement, to all rules and regulations of the FCC, and to all changes subsequently made by ICFG or the FCC. SBS shall furnish or cause to be furnished the artistic personnel and material for the programs as provided by this Agreement and all programs shall be prepared and presented in conformity with the rules, regulations and policies of the FCC and with the Policy Statement set forth in Attachment 2 hereto. All advertising spots and promotional material or announcements shall comply with applicable federal, state and local regulations and policies and shall be produced in accordance with quality standards established by SBS. If ICFG reasonably determines that a program supplied by SBS is unsatisfactory or unsuitable or contrary to the public interest, or does not comply with the Policy Statement it may, upon prior written notice to SBS, suspend or cancel such program without liability to SBS.
Broadcast Station Programming Policy Statement. Pappas has adopted a Broadcast Station Programming Policy Statement (txx "Xxlicy Statement"), a copy of which appears as Exhibit A hereto and which is incorporated herein by reference as though fully set forth herein. The Policy Statement may be amended from time to time by Pappas, upon prior written notice to AIC. AIC agrees and covenants to xxxxxx in all material respects with the Policy Statement, the Communications Laws, and with all changes subsequently made by Pappas to the Policy Statement or by any governmental authority pursuaxx xx the Communications Laws.
