Buy American Provision. Each Party that receives funds made available under title I or II of WIOA or under the Xxxxxx-Xxxxxx Act (29 U.S.C. Section 49, et. seq.) certifies that it will comply with Sections 8301 through 8303 of title 41 of the United States Code (commonly known as the “Buy American Act.”) and as referenced in WIOA Section 502 and 20 CFR 683.200(f).

Buy American Provision. 2.2.1. The Caterer will purchase, to the maximum extent practicable, domestic agricultural commodities or products for Program meals and snacks in accordance with 7 CFR 210.21(d) and 7 CFR 220.16(d). 2.2.2. A “domestic commodity or product” is defined as one that is either produced in the U.S. and its territories or is processed in the U.S. and its territories substantially using agricultural commodities that are produced in the U.S. and its territories. “Substantially” means the final processed product contains over 51% domestically grown agricultural commodities. Buy American Provision. The Offeror certifies that Offeror is in compliance with the Buyer America Provision that safeguards the health and well-being of our Nation’s children and supports the U.S. economy, American farmers, and small and local agricultural businesses (7 CFR 210.21 (d) and Memo SP 38-2017). School food authorities (SFAs) in the continental United States* must purchase domestic agricultural commodities and food products. For foods that are unprocessed, the agricultural commodities must be domestic, and for foods that are processed, they must be processed domestically using domestic agricultural food components that are comprised of over 51% domestically grown items, by weight or volume. A domestic creditable food component is the portion that counts toward a reimbursable school meal (meats/meat alternates, grains, vegetables, fruits, and fluid milk).
Buy American Provision. In accordance with the Buy American provision of the National School Lunch Act, ARAMARK and District agree to specify and/or purchase domestic commodities and products to the maximum extent practicable.
Buy American Provision. 2.2.1. The Caterer will Buy American domestic commodities and products for school meals and snacks to the maximum extent practicable. Domestic products are those that are produced in the United States and those that are processed in the United States substantially (51 percent or more) using agricultural commodities produced in the United States. [7 CFR 210.21(d)] 2.2.2. Exceptions to the Buy American Provision should be used as a last resort; however, an alternative or exception may be approved upon request. Exceptions include:(1) The product is not produced or manufactured in the U.S. in sufficient and reasonable available quantities of a satisfactory quality, or (2) competitive bids reveal the costs of a U.S. product are significantly higher than the non-domestic product. 2.2.3. To be considered for the alternative or exception, the request must be submitted in writing to a designated official of the SFA, a minimum of <Insert number> days in advance of delivery. The request must include: (1) the alternative substitutes that are domestic and meet the required specifications, with price of the domestic food alternative substitute and the availability of the domestic alternative substitute in relation to quantity ordered and (2) the reason for exception, whether limited/lack of availability or price. If price, include the price of the domestic food product and the price of the non-domestic product that meets the required specification of the domestic product. 2.2.4. The SFA will approve the Caterer’s requests for exception to the Buy American Provision and keep on file.

Buy American Provision. The Contractor acknowledges to and for the benefit of the Owner that it understands the goods and services under this Agreement are being funded with monies made available by the American Reinvestment and Recovery Act of 2009 (Recovery Act) and section 1605 of such law contains provisions commonly known as “Buy American.” The Buy American requirement prohibits the use of Recovery Act funds for a project for the construction, alteration, maintenance, or repair of a public building or public work unless all of the iron, steel, and manufactured goods used in the project are produced in the United States (“Buy American requirement”) including iron, steel, and manufactured goods provided by the Contractor pursuant to this Agreement.
