Call Out. When a day off is canceled because of staff and training meetings, the employee shall be given another day off in conjunction with their remaining scheduled day off. If more than one (1) day off is canceled for the above training then the employee shall be given an equal amount of consecutive days off within the same fourteen (14) day cycle. Notice shall be given to the affected employees in writing, postmarked at least fourteen (14) days in advance of such meetings. Should such meetings be canceled, reasonable notification of the rescheduled meetings will be provided where circumstances permit in consideration of operational needs. Call Out. When a day off is canceled because (a) Employees called in for work outside of staff and training meetings, the employee their regular working hours shall be given another day off paid at the overtime rate. Shift differential shall not be considered in conjunction with their remaining scheduled day offcomputing the overtime rate. Such pay shall be computed from the time employee arrives at the reporting location to the time of completion of his/her work and return to the designated reporting location of the Department, provided that he/she shall not be paid at the overtime rate for any work falling within his/her regular working hours. An employee called in for such work under the terms of this paragraph will receive a minimum of three (3) hours pay at his/her overtime rate for each time he/she is called out; however, this minimum pay is not to apply if called out less than thirty (30) minutes prior to his/her regular shift starting time. (b) The Commission’s responsibility to distribute overtime “as equally as possible” includes overtime payable under Section 8 also. If more than one (1) day off is canceled for the above training then the employee shall be given an equal amount of consecutive days off within the same fourteen (14) day cycle. Notice shall be given to the affected employees in writing, postmarked at least fourteen (14) days in advance of such meetings. Should such meetings be canceled, reasonable notification of the rescheduled meetings will be provided where circumstances permit in consideration of operational needs. If the employee is not initially given a fourteen (14) day advance notice, the employee is entitled to one and one-half (1½) hours for each hour spent in such training or meetings, including actual necessary travel time. When an employee is called out under Section 8 in error (such as when another employee with lower overtime hours should have been called) the Commission shall not be liable for any missed call-out pay to the employee who was not called. However, if any employee is not called due to error more than once during a six-month period, then the Commission shall be liable for missed call-out pay for each occasion during the six-month period after the first occasion. (c) If an employee not regularly scheduled between 11:00PM and 5:00AM is required due to emergency or receives call-out during such hours, the employee’s starting time for the following day’s shift shall be adjusted back based upon actual hours worked between 11:00PM and 5:00AM if the employee did not have an eight (8) hour rest period between work periods. The regular starting time can be adjusted up to five (5) hours (noon) with no loss in pay for the late start and the ending time of their shift shall not be adjusted. If the eight (8) hour rest period exceeds five hours of the next scheduled shift, the entire shift will be paid as straight rest time. (d) If the emergency or call-out continues into the regularly scheduled shift, sixteen hour worked per day provisions apply. If this event occurs, once the employee obtains sixteen hours, they are excused from work and the remaining part of the regularly scheduled shift will be paid as straight rest time. (e) An employee who has worked sixteen (16) hours or more continuously or who has worked more than sixteen (16) non-continuous hours in a twenty-four (24) hour period, shall, upon release be entitled to an eight (8) hours rest period before returning to work. If, during the eight (8) hour rest period the employee is recalled to work by his/her supervisor on any scheduled day off, even if the day off falls on a holidayfor emergency response, the employee affected shall be guaranteed a minimum of four (4) hours of work for which they shall be given a minimum of four (4) hours of compensating time or one and one-half (1½) hours of compensating time for each hour worked, whichever is greater. In lieu of compensating time, upon mutual agreement, employees may be paid one and one-half (1½) their hourly at the overtime rate for each hour worked. This does not include employees who are scheduled to work a holiday. Investigators who are called out to work by their supervisor after the end of their regular workday all hours worked on that shift and up to the beginning of their next regular workday, with the exception of scheduled days off or holidays, shall be guaranteed a minimum of four (4) hours of pay or for hours actually worked at the rate of one and one-half (1½) times their regular rate, whichever is greater. An employee who reports for call out 2.5 hours or less prior to the start of his/her core period shall continue working all continuing shifts until the beginning of his/her core employee has been able to receive an eight (8) hour rest period, unless otherwise authorized by a supervisor. Also, Fire Investigators who are engaged in work-in-progress for more than twelve (12) hours from the time he/she commenced working on a regular workday, which twelve (12) hours need not be continuous but which work must be in progress as of the end of a regular workday, shall be guaranteed a minimum of two (2) hours of pay at one and one- half (1½) times the base hourly rate for such hours worked in excess of twelve (12). If an employee at one and one- half the request of the employee’s supervisor consents to return to work before the expiration of the nine (9) times hour rest period, the employee will be paid at overtime wage rate for all work performed on the employee’s regular shift. If not so requested to return to work, the employee will remain at rest for a nine (9) hour period or be paid at base hourly rate for such hours worked in excess of twelve (12). If more than one (1) day off is canceled for the above training then the employee shall be given an equal amount of consecutive days off within the same fourteen (14) day cycle. Call Out.
