Catastrophic Illness Leave. The objective of this section is to allow donation of accrued time to affected employees, so that he/she can remain in a paid status for a longer period of time, thus partially ameliorating the financial impact of the illness, injury or condition. An employee holding a full-time position with permanent status who has completed one (1) year of continuous service shall be eligible for the catastrophic illness leave benefit upon receiving a prior favorable recommendation therefore from the department head concerned and only upon the specific approval of the City Manager. Employee can utilize up to 500 hours of donated sick leave initially. Under extraordinarily desperate conditions, a one-time additional increment of up to 500 hours of accrued vacation leave may be approved by the City Manager. The combination of all such donations would result in time away from work not to exceed twelve months in duration per incident (whether such leave is taken continuously or intermittently). A minimum of one (1) year must elapse following the termination of the catastrophic illness leave before an employee may be permitted further catastrophic illness leave. However, if subsequent catastrophic illness occurs within a year following the termination of the previous catastrophic illness leave, an employee may be permitted to use whatever accumulated paid leave he/she has and then whatever catastrophic illness leave he/she was eligible for but did not use.

Catastrophic Illness Leave. The objective (a) Upon complete exhaustion of earned paid illness allowance provisions of this section is to allow donation Agreement, a unit member with a minimum of accrued time to affected employees, so that he/she can remain in a paid status for a longer period of time, thus partially ameliorating the financial impact of the illness, injury or condition. (b) Upon exhaustion of such paid Catastrophic Illness Leave, the unit member may reapply for an additional paid illness leave of up to ninety-five (95) days. The granting of such additional leave is discretionary on the part of the Superintendent and is contingent upon the unit member applying for a retirement (disability or regular service) or resignation at the time of their application for an additional ninety-five (95) paid illness days and resigning from employment with the City School District at the end of such leave. No seniority shall accrue during Catastrophic Illness Leave. (c) Employees diagnosed with an illness or injury or a catastrophic nature while on Extended Sick Leave at One- Half (1/2) Pay may also apply for Catastrophic Illness Leave retroactive to the date of the diagnosis. An employee who has received a prior Extended Sick Leave at One-Half (½) Pay as set forth in Section 3 of this Article shall be eligible for the catastrophic illness leave benefit upon receiving a prior favorable recommendation therefore from the department head concerned and Catastrophic Illness Leave as provided for in paragraph B above only upon the specific approval of the City Manager. Catastrophic Illness Leave. The objective 11.11.1 Unit members who have exhausted all Sick Leaves and other time off may use Catastrophic Illness Leave under the following provisions: 11.11.1.1 Catastrophic Illness Leave shall begin only after all other accumulated Sick Leave (exclusive of differential paid leave), vacation, accrued compensatory time off and other paid leaves have been exhausted. 11.11.1.2 Maximum leave is not to exceed twelve (12) consecutive calendar months, or the maximum number of hours donated pursuant to this section section, whichever is less. 11.11.2 To request Catastrophic Illness Leave, the unit member or his/her designee, shall submit a request in writing to allow donation of accrued time the Association President stating the facts which support a need for such leave. 11.11.2.1 To qualify for such leave, the employee will have suffered an illness or injury that is expected to affected employees, so that he/she can remain in a paid status incapacitate the employee for a longer an extended period of time, thus partially ameliorating the financial impact or that incapacitates a member of the illnessemployees' family which incapacity requires the employee to take time off from work for an extended period of time to care for that family member, injury or conditionand taking extended time off work creates a financial hardship for the employee because s/he has exhausted all of her/his Sick Leave and other paid time off. Eligible employees may receive up Catastrophic Illness Leave Pool for future use pursuant to a maximum of 1,000 hours of donated leave benefits from full-time employees due to a catastrophic illness. Employee can utilize up to 500 hours of donated sick leave initially. Under extraordinarily desperate conditions, a one-time additional increment of up to 500 hours of accrued vacation leave may be approved by this section. 11.11.4 In the City Manager. The combination of all such donations would result in time away from work not to exceed twelve months in duration per incident (whether such leave is taken continuously or intermittently). A minimum of one (1) year must elapse following the termination of the catastrophic illness leave before event an employee exhausts her/his donated Catastrophic Illness Leave from the Catastrophic Illness Leave Pool, the employee or her/his designee may be permitted further catastrophic illness leaverequest additional Catastrophic Illness Leave pursuant to this section. Completed forms shall be returned to the Superintendent. 9.3.3 In order to donate a Certificated Employees must maintain minimum of twenty (20) days of Sick Leave per school year. 9.3.4 Donated Sick Leave days may be utilized in increments of one- half work day. 9.3.5 If the days of donated Sick Leave are not useused, those days will be retained by the donor. 9.4 The Association agrees that it will not file, on its own behalf or on behalf of any Certificated Employee, any grievance, claim or lawsuit of any kind related to any attempt by a Certificated Employee to retrieve donated Sick Leave used by another unit member pursuant to this Article. The Association also agrees that it will not file, on its own behalf or on behalf of any Certificated Employee, any grievance, claim or lawsuit of any kind which attempts to challenge in any way the legality or enforcement of this Article. 9.4.1 The Association agrees to indemnify and hold the District harmless from any loss or damage arising from the implementation of this Article. 9.4.2 In the event of any grievance, claim or lawsuit challenging the legality or enforcement of this Article, the District may terminate this Article upon written notice to the Association.

Catastrophic Illness Leave. The objective (a) Upon complete exhaustion of earned paid illness allowance provisions of this section is to allow donation Agreement, a unit member with a minimum of accrued time to affected employees, so that he/she can remain in a paid status for a longer period of time, thus partially ameliorating the financial impact of the illness, injury or condition. An employee holding a full-time position with permanent status who has completed one (1) year of continuous service employment from the employee’s most recent date of hire with the Rochester City School District may request from the Superintendent of Schools a Catastrophic Illness Leave. The Superintendent shall convene a joint committee chaired by the Chief of Human Capital to review the request. The remainder of the joint committee shall consist of the Director of Employee Benefits, Director of Support Personnel Services and the RAP President. If the joint committee recommends and the Superintendent approves, a unit member may receive up to ninety-five (95) illness days. (b) Upon exhaustion of such paid Catastrophic Illness Leave, the unit member may reapply for an additional paid illness leave of up to ninety-five (95) days. The granting of such additional leave is discretionary on the part of the Superintendent and is contingent upon the unit member applying for a retirement (disability or regular service) or resignation at the time of their application for an additional ninety-five (95) paid illness days and resigning from employment with the City School District at the end of such leave. No seniority shall accrue during Catastrophic Illness Leave. (c) Employees diagnosed with an illness or injury or a catastrophic nature while on Extended Sick Leave at One- Half (1/2) Pay may also apply for Catastrophic Illness Leave retroactive to the date of the diagnosis. An employee who has received a prior Extended Sick Leave at One-Half (½) Pay as set forth in Section 3 of this Article shall be eligible for the catastrophic illness leave benefit upon receiving a prior favorable recommendation therefore from the department head concerned and Catastrophic Illness Leave as provided for in paragraph B above only upon the specific approval of the City Manager.
