Sick Leave Donation for Catastrophic Illness a. In the event a non-probationary full-time Employee has exhausted all of his/her leave days and has either exhausted or has no available catastrophic leave days, as described above, Employees may make a donation of up to two (2) sick days (a one day donation at a time) to such Employee. b. The District will notify Employees of the opportunity to donate days. Any Employee willing to donate such days shall notify the personnel department at the District office no later than one (1) week after the request. A list shall be generated in inverse order of seniority, which shall guide the donation of days. The donated sick days must be used in the school year in which the days were donated. c. The number of donated sick days available for use, per event, by an Employee may not exceed the number of work days during that Employee’s normal work year (defined as July 1 through June 30.) d. The use and allocation of these days will be monitored by the Communication Council.

Sick Leave Donation for Catastrophic Illness. The City recognizes that during times of serious illness, often times an employee’s financial integrity is at risk. To enable employees to help their fellow workers suffering a catastrophic illness without a direct financial outlay, the City and the Union agree to offer a leave donation program. The program is outlined to allow full-time bargaining unit employees to donate leave from their sick account to other employees within the unit as outlined below: (a) Any full-time bargaining unit employee who suffers a catastrophic illness and has exhausted all their accumulated leave (compensatory time, sick leave, personal leave, vacation, etc.) may be eligible to receive sick leave donations from other employees within the FOP bargaining unit. (b) Catastrophic illness is defined as: a) a life-threatening illness that requires hospitalization of a minimum of five days and recovery at home or in another facility (the hospitalization must not be due to elective surgery); or b) a disease or illness certified by a duly licensed physician practicing within the scope of the physician’s license which disables the individual from performing all his/her job functions for an extended period of time (at least thirty (30) calendar days). (c) Employees may request this leave donation by submitting a leave request with appropriate medical certification to their supervisor two weeks in advance of when the leave donation is needed. Failure to provide notice two weeks in advance may result in denial of the leave donation, unless due to circumstances beyond the employee’s control, the appropriate notice could not be given. The Department Director may also initiate a request for sick leave donation. (d) Payment begins on the first day following a five (5) consecutive unpaid work day elimination period. (e) Employees who wish to donate sick leave to another employee’s sick account for catastrophic illness (as defined above) may do so by completing a sick leave donation form and submitting it to the Police Department administrative offices. The maximum donation allowed per incident from any one employee is forty (40) hours. Employees making the donation must have a minimum eighty (80) hour balance in order to donate. Donations must be made in increments of not less than eight hours. (f) The maximum payable to any one employee for catastrophic illness from employee donations is two hundred forty (240) hours. In such cases, the District shall notify Bargaining Unit Members of the opportunity to donate days. Sick Leave Donation for Catastrophic Illness. A unit member who has a minimum sick leave balance of 100 hours may voluntarily donate to other unit members up to five (5) days of their accumulated sick leave days per year. In no instance shall the unit member sell and/or exchange sick leave for monetary or other considerations. If a unit member wishes to donate sick leave days as stipulated above, he/she must contact the Human Resources Department to verify the number of accrued sick leave days they have available, and complete the appropriate form and submit it to the Human Resources Department in order to have the days transferred.

  • Sick Leave Donation 10.3.1 A worker may donate days of sick leave to individual District workers who, due to a serious health condition, have exhausted all accumulated sick leave. Donating workers must retain a sixty (60) day balance of sick leave after their donation. No worker may receive more than 40 days of donated leave per year. 10.3.1.1 A “serious health condition” is defined as an illness, injury, impairment or physical or mental condition which involves inpatient care in a hospital, hospice, or residential health care facility, or continuing treatment or continuing supervision by a health care provider as defined in 29 USC 825.114(a) and as certified by a worker’s physician or other qualified medical practitioner. 10.3.1.2 The Vice Chancellor of Human Resources and the Chief Stewards by mutual agreement will verify the certification for eligibility. If the certification from the worker’s physician is insufficient, a certification by a physician of the District’s choosing may be required, at District expense. The District may require additional medical opinions. 10.3.2 Donated leave must be in one-day increments (no less than 8 hours). Recipients of donated sick leave shall be solely responsible for any state and federal taxes on the donated time. Such taxes shall be withheld at the normal rate for the recipient worker. In the event that the state or federal governments rule that tax liability is due other than as taxed, the recipient shall be solely liable for such liabilities. 10.3.2.1 The donated sick leave may be used only when the worker has exhausted accumulated sick leave and either is not eligible for long- term disability or is eligible but has not begun to receive the long-term coverage. 10.3.2.2 The Vice Chancellor of Human Resources shall be notified of solicitation of donations. Solicitations of donations may be made by the individual or his/her representative(s). 10.3.2.3 Donation of sick leave shall be authorized by a signed pledge form prepared by and filed with the District Office of Human Resources. In the event several workers donate sick leave, the sick leave shall be used in the order in which the signed pledge forms are filed with Human Resources. 10.3.2.4 If the worker does not use all donated sick leave, the sick leave shall be returned to the donating worker(s).
