Common use of Central Bargaining Clause in Contracts

Central Bargaining. Notwithstanding the foregoing provisions, in the event the parties to this Agreement agree to negotiate for its renewal through the process of central bargaining, either party to this Agreement may give notice to the other party of its desire to bargain for amendments on local matters proposed for incorporation in the renewal of this Agreement and negotiations on local matters shall take place during the period from 120 to 60 days prior to the termination date of this Agreement. Negotiations on central matters shall take place during the period commencing forty-five days prior to the termination date of this Agreement. It is understood and agreed that “local matters” means those matters which have been determined by mutual agreement between the central Negotiating Committees respectively representing each of the parties to this Agreement as being subjects for local bargaining directly between the parties to this Agreement. It is also agreed that local bargaining shall be subject to such procedures that may be determined by mutual agreements between the central Negotiating Committees referred to above. For such purposes, it is further understood that the central Negotiating Committees will meet during the sixth month prior to the month of termination of this Agreement to convey the intentions of their principals as to possible participation in central negotiations, if any, and the conditions for such central bargaining. Where the existing payroll system does not allow for such separate cheque/deposit, the rates specified above are prior Employer will supply the employee with a detailed explanation of the retroactive pay calculations. Retroactivity will be paid in respect of all remuneration to all eligible employees on the application payroll as of the expiry date of the previous agreement (September 28, 2017) and to all new such employees hired since that date. Payment is to be made within three (3) full pay periods of the date of ratification (December 20, 2018). In the event an eligible employee shall have terminated his/her employment since September 29, 2015 general wage increase. The Relief Plant Operators will receive a $2.00 per hour premium when assigned 2017, the Employer shall advise the employee within 30 days by notice in writing by registered mail to relieve Plant Operators. Relief Plant Operator Premiums will not be applied until the full complement last known address on the records of Plant Operators and Relief Plant Operators are trained the Employer and the schedule is implementedemployee shall have sixty (60 days from the posting within which to claim any payment due to him/her. Retroactivity will be paid within two pay periods (bi-weekly) of the employee making such claim.

(b) If an employee refuses to take the application of September 29recommended or required vaccine required under this provision, 2015 general wage increaseshe or he will be reassigned during the outbreak period, unless reassignment is not possible, in which case he or she will be placed on unpaid leave. The Relief Plant Operators will receive a $2.00 per hour premium when assigned If an employee is placed on unpaid leave, she or he can use banked lieu time or vacation credits in order to relieve Plant Operatorskeep her or his pay whole. Relief Plant Operator Premiums It is further agreed that any such reassignment will not adversely impact the scheduled hours of other employees. (c) If an employee refuses to take the recommended or required vaccine because it is medically contra-indicated, and where a medical certificate is provided to this effect, she or he will be applied until reassigned during the full complement outbreak period, unless reassignment is not possible, in which case the employee will be placed on paid leave. It is further agreed that any such reassignment will not adversely impact the scheduled hours of Plant Operators other employees. (d) If an employee gets sick as a result of the vaccination and Relief Plant Operators are trained and applies for WSIB, the schedule is implementedHospital will not oppose the claim.
