Certificates of Insurance and Other Requirements. 9.3.1 Within thirty (30) days after the date of execution of this Contract, the Contractor shall furnish the State with certificate(s) of insurance verifying insurance coverage or providing satisfactory evidence of self-insurance as required above (the "Certificates"). 9.3.3 The Contractor shall have the right to assume in whole or in part, through a program of self-insurance, any and all risks otherwise required by the Contract to be insured against.
9.3.4 The ultimate parent corporation for the Contractor and its affiliates makes all required disclosures in its Annual Reports on Form 10-K and Quarterly Reports on Form 10-Q, which are updated in Reports on Form 8-K, all of which are filed with the Securities and Exchange Commission. Those Reports include disclosures of material litigation, investigations and other matters as required by federal law and are publicly available (“Proceeding”). In the event that any such Proceeding disclosed by the Contractor, or of which the Department or an Eligible User otherwise becomes aware, during the term of this Contract, would cause a reasonable party to be concerned about the ability of the Contractor (or a Subcontractor hereunder) to continue to perform this Contract in accordance with its terms and conditions, or whether the Contractor (or a Subcontractor hereunder) in performing Services for the State is engaged in conduct which is similar in nature to conduct alleged in such proceeding, which conduct would constitute a breach of this Contract or a violation of Florida law, regulatio...
