Changes in Pricing. The definition of "Applicable Pricing Rate" contained in Section 1.1(1) of the Credit Agreement is hereby amended to delete the table contained therein in its entirety and to substitute the following table therefor:
Changes in Pricing. The list price for the Hybrid Solution will be reviewed by the Steering Committee on an annual basis, or sooner upon the request of a Party hereto.
Changes in Pricing. (a) Clause (a) of Section 3.1 is hereby amended to read in its entirety as follows:
(a) At all times while such Loan is a Base Rate Loan, at a rate per annum equal to the Base Rate from time to time in effect, plus for any day the Applicable Margin on such day;"
(b) The definitions of "Applicable Commitment Fee" and "Applicable Margin" set forth in Section 13 of the Existing Credit Agreement are hereby amended to read in their entirety as follows:
Changes in Pricing. Schedule B (Applicable Pricing Margin) to the Credit Agreement is hereby amended as follows:
(a) by deleting “Level 7” in Section 3 thereof and replacing it with “Level 6”; and
(b) by deleting the table contained therein in its entirety and substituting the following table therefor: The above amendments to the table contained in the definition of Applicable Pricing Rate will become effective in an equivalent manner to the adjustment mechanism contemplated in Schedule B to the Credit Agreement.
Changes in Pricing. To reflect the agreement of the parties hereto to eliminate the Fixed Rate as a pricing option under the Credit Agreement and to modify the spread applicable to Floating Rate Loans, effective as of the Effective Date:
(a) All Loans funded under the Credit Agreement from and after the Effective Date shall be funded as Floating Rate Loans;
(b) No Floating Rate Loans outstanding under the Credit Agreement on the Effective Date may be continued as or converted into Fixed Rate Loans at the end of their respective Interest Periods;
(c) All Loans outstanding as Fixed Rate Loans shall continue to bear interest at the rate applicable thereto on the Effective Date to and including the earlier to occur of: (1) the last day of the current Interest Period therefor and (2) August 31, 2001, at which earlier date such Fixed Rate Loans shall be converted to Floating Rate Loans; and
(d) The definition of the term "Applicable Margin" as set forth in Article I of the Credit Agreement is hereby amended in its entirety as follows:
Changes in Pricing. Notwithstanding anything else to the contrary contained herein or in any of the Contract Documents, HICO and Buyer acknowledge and agree that (1) manufacturers other than HICO or any of its affiliates (each a “Third Party Manufacturer”), of any new or used spare parts with respect to the Work (each individually a “Spare Part” and collectively the “Spare Parts”) may from time to time, and without prior notice, make modifications to Spare Parts being offered for sale by HICO in connection with the Work;
Changes in Pricing. ABADIAN reserves the right to change prices without notice. However, price changes, other than those relating to on-going maintenance service, shall not be changed with respect to previously executed Client Orders.
Changes in Pricing. Prices for Subscription Features are subject to change at the sole discretion of the Company. If changes occur and you are currently subscribed to Subscription Features, the Company will notify you of the change through the Service or via email, as determined by the Company or as required by applicable law, at least thirty (30) days prior to the effective date of the change. Your continued use of the Subscription Features after the price changes become effective signifies your agreement to pay the revised amount. If you do not agree to the new prices, please follow the instructions provided in the "Cancel Subscription Features or Close Your Account" section below. You (and not the Company) are responsible for any charges or fees payable to third parties in connection with the Service, such as ambulances and other emergency responders.
Changes in Pricing. The Pricing Schedule is amended in its entirety and replaced by the Pricing Schedule attached hereto.
Changes in Pricing. Pricing will apply to the first truckload purchased by Customer. Thereafter, unless otherwise specified in the Sales Agreement, Supplier may change the pricing of product upon 30 days’ advance written notice to Customer; provided, however, Customer may cancel this Agreement in the event of any increase in price by Supplier. Notwithstanding the foregoing, if Customer and Supplier have agreed in a Sales Agreement that the price shall be fixed over a period of time or a volume of shipments, then the pricing shall remain fixed over that period (except as it may be modified in the case of deliveries by a fuel cost surcharge, as is described more fully at xxx.XxxxxXxxxx.xxx under our Diesel Fuel Price Adjustment Policy).
