Commencement and Application. This Agreement commences on the date which is 7 days after approval of the Agreement by Fair Work Australia. It applies to schools listed in Schedule H and general staff employed in those schools, covered by this Agreement pursuant to clause 4 of the Agreement, whilst this Agreement is in operation.
Commencement and Application. 1.1 The Agreement between ASK4 and the Customer shall commence on the date on which the Service Confirmation is issued by ASK4 (the “Commencement Date”) however so delivered and shall continue on the terms set out herein until the Termination Date. It is assumed that the Customer requires the Service and/or any Additional Services to be provided without delay. Accordingly, on acceptance of these user terms by the Customer, the Customer shall be deemed to have made an express request in accordance with paragraph 36 (1) (a) of the Distance Selling Regulations for the Service and/or any Additional Services to be provided before the end of the cancellation period (as referenced in paragraph 30 (1) of the Distance Selling Regulations) and ASK4 shall issue the Service Confirmation as soon as practicable after the Customer submits the Service Oder. If the Customer does not wish to take the Service and/or any Additional Services until the end of the said cancellation period the Customer should not submit the Service Order and should contact ASK4 on the Support Telephone Number.
1.2 The terms of this Agreement apply to the extent that they are relevant to the Service the subject of this Agreement. In the event of any inconsistency between the terms set out in this document and the terms set out in the Service Confirmation the terms of the Service Confirmation shall prevail.

Commencement and Application. 2.1 This Agreement shall commence on the Commencement Date, unless the Purchaser has been notified that its application has been declined by the Company, and endure and apply to all transactions between the Company and the Purchaser, until all the obligations of the Purchaser in terms hereof (particularly in respect of all amounts due under outstanding Orders) have been fully discharged unless otherwise terminated in terms hereof.
2.2 This Agreement and particularly these terms and conditions shall apply to all transactions between the Company and the Purchaser for –
2.2.1 the sale and acquisition of Goods; and
2.2.2 the advance of Credit to the Purchaser.
2.3 The provisions of this Agreement and particularly these terms and conditions shall override any terms or provisions provided or imposed on the Purchaser (to the extent of any inconsistencies with these terms and conditions) when purchasing or ordering Goods from the Company, it being specifically agreed and recorded that all transactions relating to the advance of Credit and the purchase and sale of Goods shall be governed only by the terms of this Agreement.
2.4 The withdrawal, cancellation or termination of any particular Order, Accepted Order or Quotation shall not affect the provisions of this Agreement which will remain binding on the Parties unless otherwise agreed in writing between the Parties.
2.5 Notwithstanding the provisions of clause 2.1, the Company shall at any time and on 10 (ten) days' written notice to the Purchaser, be entitled to terminate this Agreement in which event the Outstanding Amount shall immediately become due and payable.
Commencement and Application. 2.1 This agreement shall commence upon the date that these terms are received by Instructing Party and shall continue, unless terminated in accordance with clause 11 (Termination), until conclusion of the Services, when it shall terminate automatically.
2.2 These terms shall apply to govern the agreement to the exclusion of any other terms, including any terms of the Instructing Party over which, these terms shall prevail. They are the only basis upon which the Expert shall accept Instructions.
2.3 These terms shall be deemed to be accepted by the Instructing Party upon their receipt (electronically by a PDF or by a hyperlink or by post) and do not require a signature. In the event that the Instructing Party has already provided Instructions, these terms shall apply notwithstanding any contrary terms included in the Instructions.
2.4 In addition to these terms, the scope and purpose of the Services and of the Report shall be as defined in the Instructions provided by the Instructing Party. The Instructions shall form part of this Agreement.
Commencement and Application. This Agreement shall commence on the Effective Date and endure indefinitely thereafter unless otherwise terminated in accordance with its terms. Notwithstanding anything to the contrary herein contained, it is expressly agreed between the Parties that the provisions of this Agreement shall apply to all Confidential Information that has been disclosed or provided by the Disclosing Party or received by the Receiving Party at any stage during the relationship between them, regardless of whether such Confidential Information was disclosed or provided by the Disclosing Party or received by the Receiving Party prior to the Signature Date.
Commencement and Application. 2.1 These terms are binding and shall apply to govern the agreement to the exclusion of any terms of the Instructing Party over which, these terms shall prevail. Together with the accompanying email or letter sent by the Expert, they are the entire agreement and the only basis upon which the Expert shall accept Instructions.
2.2 These terms shall be deemed to be accepted by the Instructing Party upon their request for Services following the sending out of these terms by the Expert (electronically, by a PDF, by a hyperlink or by other media). In the event that the Instructing Party has already provided Instructions, these terms shall govern the Services, notwithstanding any contrary terms included in the Instructions.
2.3 This agreement shall commence upon the date that the Instructing Party sends, and the Expert receives, the request of the Instructing Party to commence the Services following the accompanying email or letter sent by the Expert (Commencement Date) and shall continue, unless terminated in accordance with clause 11 (Termination), until full payment of the Fees, when the agreement shall come to an end.
2.4 In the event of any conflict between these terms and the accompanying email or letter sent by the Expert, the accompanying email or letter shall take precedence.
