Construction Quality Acceptance Staff Levels. 21 The size of the construction quality acceptance staff must reflect the volume of quality 22 acceptance activities necessary for the Work in progress and Developer shall maintain such 23 staff size in accordance with the approved CQMP. The IQF staff must perform quality 24 acceptance oversight, inspection, and testing services typically performed by ADOT on 25 traditional projects, unless otherwise indicated in the TPs. 26 Developer shall update the construction quality acceptance staffing requirements as necessary 27 throughout the Construction Period to reflect changes in the actual construction schedule. 28 Developer shall ensure that adequate construction quality acceptance staff is available and that 29 CQMP activities are undertaken in a manner consistent with the Project Schedule and in a 30 manner that enables Developer to timely achieve the Substantial Completion Deadline and Final 31 Acceptance Deadlines.

Construction Quality Acceptance Staff Levels. The size of the construction quality acceptance staff shall reflect the volume of quality acceptance activities necessary for the Work in progress and Developer shall maintain such staff size in accordance with the approved CQMP. The CQAF staff shall perform quality acceptance oversight, inspection, and testing services typically performed by TxDOT on traditional projects, with the exception of monitoring testing. Developer shall update the construction quality acceptance staffing requirements as necessary throughout the Construction Period and where applicable for Renewal Work during the O&M Period to reflect changes in the actual construction schedule. Developer shall ensure that adequate construction quality acceptance staff is available and that CQMP activities are undertaken in a manner consistent with the Project Schedule and in a manner that will enable Developer to achieve the Substantial Completion and Final Acceptance Deadlines. Should TxDOT determine that Developer is not complying with CQMP because of lack of staff, in addition to TxDOT’s rights and remedies under the Agreement, TxDOT shall have the right, without penalty or cost, including time extensions or delay damages, to restrict Work efforts until appropriate levels of staffing consistent with the CQMP and satisfactory to TxDOT are obtained or TxDOT may contract with a separate firm to perform these services and withhold payment to Developer for such services.
