Contract Goal. 11.2.3.1. Concessionaire shall make Good Faith Efforts, as defined in City of Houston Ordinance No. 99-893, as amended and 49 CFR Parts 23 and 26, to ensure that at least 36% of the Gross Sales earned under this Agreement are attributable to small business concerns at least 51% owned by one or more individuals who are both socially and economically disadvantaged or, in the case of a corporation, in which 51% of each class of voting stock outstanding and 51% of the aggregate of all stock outstanding is owned by one or more such individuals, and whose management and daily business operations are controlled by the socially and economically disadvantaged individuals who own it. If the Consultant fails to achieve the Contract goal stated therein, it shall be required to provide documentation demonstrating that it made Good Faith Efforts. DBE prime contractors must meet goals and make Good Faith Efforts on the same basis as other Consultants, but DBEs may count toward goals the work that they commit to perform with their own work force, as well as work performed by DBE subcontractors and DBE suppliers. The Consultant shall establish and maintain records and submit regular reports, as required by the Director and the Director of the Office of Business Opportunity, which shall identify and assess progress in achieving DBE subcontract goals and other DBE affirmative action efforts.

Contract Goal. Architect/Engineer shall make Good Faith Efforts, as defined in City of Houston Ordinance No. 99-893 and 49 CFR Part 26, to subcontract _15 % of the dollar value of the Agreement to DBEs. For purposes of this Section, DBEs are businesses certified as such by a member of the Texas Unified Certification Program pursuant to 49 CFR Part 26.
Contract Goal. Concessionaire shall make Good Faith Efforts, as defined in City of Houston Ordinance No. 99‐893, as amended, and 49 CFR Parts 23 and 26, to ensure that at least 10% of the Concessionaire's operating expenses under this Agreement (exempting expenses for payroll, depreciation, Concession fees payed to the City under this Agreement, and cost of goods sold) for are attributable to Certified ACDBEs, as defined in the City’s ACDBE Program. In the event that the company performing work to be counted as an operating expense of the Concessionaire is owned by a joint venture that is partially owned by a Certified ACDBE, credit towards the Contract Goal will be granted for a percentage of the joint venture’s invoiced expenses equal to the percentage of the joint venture owned by ACDBEs, if consistent with all relevant FAA regulations, 49 CFR Part 23, City ordinances, and City of Houston Office of Business Opportunities’ policies. If the Concessionaire is unable to achieve this goal under joint venture, partnership, franchise, or similar legal arrangement, Concessionaire shall seek to obtain the required ACDBE participation by other means, such as purchase of goods, services, supplies and/or products from Certified ACDBE vendors.
