CONTRACT PRICELIST. The Contract Pricelist shall be made available to Authorized Users and posted publically on the OGS website, and shall include at a minimum, the Make(s), Model(s), Model Code(s), estimated delivery time (After Receipt of Order (“ARO”)), NYS Contract Prices (i.e., for the Base Item, Additional Body Section, and Optional Equipment), Additional Options NYS Discount, and configuration of the Base Item and associated Optional Equipment, which have been approved by Procurement Services for inclusion in the Contract. Notwithstanding the foregoing, where an Authorized User does not have the capability to access Contract information electronically, it shall be the Contractor’s responsibility, upon Authorized User request, to furnish, without charge, Contract Pricelists pursuant to the Contract, to Authorized Users who request them. Contract Pricelists may be furnished to Authorized Users in either hard-copy or electronic format. If available in both formats, they shall be furnished in the format preferred by the requesting Authorized User. Upon request, the Contractor shall assist Authorized Users in the use of Contract Pricelists. In order to receive approval for additions and deletions of Product from the Contract Pricelist, the Contractor must submit a completed Contract Modification Form (see Appendix C: School Bus Contract Documents, Number 5: Contract Modification Procedure) and to the Procurement Services Contract administrator. If approved, Procurement Services shall notify the Contractor in writing and post the revised Contract Pricelist to the OGS website.

The Contract Pricelist submitted to NYSPro shall include at a minimum an item number, description, MSRP, discount, and NYS Net Contract Price for all Base Items and associated OEM Options offered under the Contract. If available in both formats, they shall be furnished in the format preferred by the requesting Authorized User. Upon request, the Contractor shall assist Authorized Users in the use of Contract Pricelists.
CONTRACT PRICELIST. The Contractor has been awarded the following Lot(s), and will offer the awarded Model(s) at the Base Item Unit Price listed. The Authorized User may elect to add or delete Options and Aftermarket Components from the Base Item awarded, and the Contractor shall adjust the Base Item Unit price in accordance with the Dump Body or Plow AOAC Discount awarded. Additional Options and Aftermarket Components (AOAC) to be offered under the Contract are limited to products that are (1) listed on the OEM or Contractor-Published Pricelist(s), and (2) may be installed on the awarded Body and Plow Product Line by the Contractor, or third-party. Additional Truck Body and/or Plow Models may be offered under the Contract at the Dump Body Discount and/or Plow Discount, as applicable. The discount(s) shall be applied to the MSRP for additional Models offered under the Contract.

CONTRACT PRICELIST. OGS reserves the right to reject Product from the Contract Pricelist that is determined, at the sole discretion of OGS, to have an unreasonably high Ceiling Price. Such determination shall be based on available industry Heavy Equipment Rental pricing guide(s) and comparison with Rental Prices offered by competitors in the same geographic area.
CONTRACT PRICELIST. Contractor shall maintain an all-inclusive Contract pricelist, as set forth in Appendix D, Number 2, Multifunctional Printers (MFPs) (Ledger Size) and Options Pricelist. Contractor shall update the Contract pricelist in accordance with §17, Addition of Options. Contractor shall post the Contract pricelist on Contractor’s website in accordance with §24, Internet Access to Contract and Pricing Information.
CONTRACT PRICELIST. A. OGS reserves the right to reject Product from the Contract Pricelist that is determined, at the sole discretion of OGS, to have an unreasonably high Ceiling Price. Such determination shall be based on available industry Heavy Equipment Rental pricing guide(s) and comparison with Rental Prices offered by competitors in the same geographic area. B. All Rental Prices included on a Rental Quote shall be equal to or less than the Ceiling Price listed on the Contract Pricelist. A Rental Quote that includes a Rental Price that exceeds the published Ceiling Price(s) for the Rental of the Heavy Equipment shall be deemed non-responsive and shall result in the rejection of the Rental Quote for that Rental Quote Request. C. The Ceiling Prices shall include all Contractor costs to maintain and provide to the Authorized User fully functioning Heavy Equipment that meets the requirements set forth in Section III.2 Heavy Equipment Requirements, without additional compensation. The Ceiling Price includes, but is not limited to: 1. Labor, parts, material and equipment costs to maintain the Heavy Equipment as recommended by the OEM. See also Sections III.3 Rental Service Requirements, Paragraph G Maintenance, and Paragraph H Routine Service; 2. Repairs and replacement of parts resulting from routine use, as necessary.
