Equipment Condition Sample Clauses
Equipment Condition. All Equipment must be in good working order on the Start Date or when additional equipment is added to the Addendum. Upon reasonable request by Motorola, Customer will provide a complete serial and model number list of the Equipment. Customer must promptly notify Motorola in writing when any Equipment is lost, damaged, stolen or taken out of service. Customer’s obligation to pay maintenance and support fees for this Equipment will terminate at the end of the month in which Motorola receives the written notice. If Equipment cannot, in Motorola’s reasonable opinion, be properly or economically maintained for any reason, Motorola may modify the scope of Services related to that Equipment; remove that Equipment from the Agreement; or increase the price to maintain that Equipment.
Equipment Condition. Prior to the beginning of the Rental Period, Heavy Equipment shall, at a minimum, be provided to the Authorized User in the following condition as applicable to the Heavy Equipment type.
1. Shall be completely assembled, clean, lubricated, serviced, fully functional and capable of performing the task(s) it was designed to perform under the OEM’s guidelines. The Contractor shall be responsible for all costs and expenses necessary to provide Heavy Equipment that is in good working condition and repair. The Authorized User shall not be liable for damage caused by improper maintenance of the equipment by the Contractor;
2. All safety devices, including rear view camera and/or backup alarm, shall be in place and operational per the OEM’s design. Safety stickers shall be in place and legible;
3. Fuel tank shall be at full capacity;
4. All required documents shall be provided (e.g., vehicle registration, inspection and emissions stickers, certificate of insurance);
5. Shall meet the OEM’s minimum recommendations for Gross Vehicle Weight Rating (GVWR), Front Gross Axle Weight Rating (FGAWR), Rear Gross Axle Weight Rating (RGAWR) and curb weight.
6. Shall have vandalism/theft protection covers or other security system in place.
Equipment Condition. The Equipment has been manufactured with new parts except that in some cases, the Lessor uses fully operating controllers and power supplies from devices returned to the Lessor at the end of lease terms. No pads or any other portion of the device that is intended to come into contact with the treated person is reused and all such materials are new. Reuse of fully operational controllers and power supplies allows Lessor to provide the Equipment to the Lessee without creating additional electronic waste and allows Lessor to provide its devices at a reasonable cost. Because of the Lessor's method of reusing controllers and power supplies that if functional, can last indefinitely despite prior use, the Equipment is only available for rent and/or sale in the condition described above and not in a traditional distinction of new or used.
Equipment Condition. Seller makes no warranties regarding the Equipment outlined in Exhibit A hereto, including without limitation warranties as to merchantability and fitness for a particular purpose, either expressed or implied.
Equipment Condition. 1.2.1 IronPlanet recommends (however, not required) that all equipment should be in good operating condition, cleaned, and prepared for inspection and sale by IronPlanet. This may include, but not limited to, the exterior, interior, and tires.
Equipment Condition. The Vendor must furnish only new equipment, if any, in response to this RFP.
Equipment Condition. ○ The renter acknowledges receiving the equipment in good condition and agrees to return it in the same condition. ○ Any damage or issues with the equipment must be reported immediately upon return.

Equipment Condition. 6.1. The Third Party Service Provider shall maintain each bus in a clean condition throughout, both interior and exterior, at all times that the bus is in service for the City. All buses must be swept, mopped, interiors wiped down (i.e., dashboards, stanchions, bars, etc.).
6.2. All vehicles placed into revenue service shall have all safety items fully operational (i.e., lights, brakes, horn, tires, etc.).
6.3. Spare buses shall be available to replace any bus that may become disabled or otherwise unavailable for operations.
6.4. The Third Party Service Provider shall ensure regular and frequent maintenance checks of bus lifts and ramps and will keep all lifts and ramps are in good running condition.
Equipment Condition a. Warranty: WHILE PARTIES MAKE NO EXPRESS OR IMPLIED WARRANTY AS TO THE FITNESS OF THE EQUIPMENT, THEY RECOGNIZE AND AFFIRM THEIR RESPONSIBILITIES UNDER THE FEDERAL MOTOR CARRIER SAFETY REGULATIONS.
b. Pre-Trip Inspection: Motor Carriers will conduct a pre-trip inspection prior to departing with interchanged Equipment that will include those items set forth in Exhibit A to this Agreement. All Equipment shall be deemed to be in good condition and repair when released by Operator, except as expressly noted at the time of release.
c. Redelivery: Motor Carrier will return the Equipment to the Operator in the same condition, reasonable Wear and Tear excepted.
