EXHIBIT “C” INSURANCE (Attach Insurance Certificate as Exhibit “C”) EXHIBIT “D” CASE WEIGHTING CITY OF FEDERAL WAY PUBLIC DEFENSE STANDARDS Policy: Provide high quality public defense services by engaging experienced public defenders. Definition of a Case: A case is defined as the filing of a document, which may include multiple citations from the same incident, with the court naming a person as a defendant or respondent, to which an attorney is appointed in order to provide representation.1 Definition of Appointment: Appointment of a public defender is defined as assignment to represent a defendant as a result of indigent screening. The caseload for attorneys with less than five years misdemeanor and/or gross misdemeanor experience will be 300 weighted cases per year.2 (300 cases/year ÷ 48 weeks (240 working days) = 6.25 cases/week ÷ 5 days = 1.25 cases/day) The caseload for attorneys with at least five years misdemeanor and/or gross misdemeanor criminal experience increase caseload will be increased to a total of 450 weighted cases per year.3 (450 cases/yr ÷ 48 weeks (240 working days) = 9.375 cases/week ÷ 5 days = 1.875 cases/day) The caseload for attorneys with at least five years misdemeanor and/or gross misdemeanor coupled with five years felony criminal experience will be increased to a total of 540 cases per year.4 (540 cases/yr ÷ 48 weeks (240 working days) = 11.25 cases per week ÷ 5 days = 2.25 cases/day) Policy: Provide Public Defenders at the arraignment or first appearances even though the defendant has not been screened to determine qualifications for indigent defense. The Municipal Court of Federal Way has a daily in custody calendar, which includes arraignments/first appearances; and an out of custody arraignment calendar one day per week, which includes arraignments.5 Through contract negotiations the Primary Public Defense Firm serves as attorney of the day at all arraignments to provide information and counsel to all defendants even though they may not be appointed to defend them. As a result, the City recognizes the additional time, but will not count each matter as a case because it does not meet the definition of a case per the Supreme Court Order (i.e. the attorney has not been assigned to the case), and it could be an unconstitutional gift of public funds for those d...
Contractor Responsible for Taxes. CONTRACTOR and each of its employees and representatives will be solely responsible for and will pay any income, Social Security, Medicare, unemployment, Workers' Compensation or Federal highway use assessments or taxes with respect to any amounts paid to CONTRACTOR hereunder. Payment of any taxes or other amounts shall be directly made by CONTRACTOR, and CONTRACTOR will file all required forms or documents with the Internal Revenue Service or any state. CARRIER shall not be responsible for and will not withhold on behalf of CONTRACTOR or its employees and representatives any sums for income tax, unemployment insurance, Social Security or any other withholdings pursuant to any law or requirement of any governmental body. Neither CONTRACTOR not its employees or representatives shall have any claim under this Agreement for pension or retirement benefits, social security, workers compensation, health, disability, professional malpractice, or unemployment insurance benefits of any kind. CONTRACTOR will indemnify and hold harmless the CARRIER from any and all loss or liability, including attorneys fees and costs (at all levels including appeal), arising from its failure to make such payments, withholdings and benefits, if any.

  • Litigation, Environmental and Labor Matters (a) There are no actions, suits, proceedings or investigations by or before any arbitrator or Governmental Authority pending against or, to the knowledge of the Borrower, threatened against or affecting the Borrower or any of its Subsidiaries (i) as to which there is a reasonable possibility of an adverse determination and that, if adversely determined, could reasonably be expected, individually or in the aggregate, to result in a Material Adverse Effect or (ii) that involve this Agreement or the Transactions.

  • Compliance with Laws; Payment of Taxes (i) Comply, and cause each of its Subsidiaries to comply, with all Requirements of Law, judgments and awards (including any settlement of any claim that, if breached, could give rise to any of the foregoing), except to the extent the failure to so comply could not reasonably be expected to have a Material Adverse Effect.
