Controllers. 6.1 User* must nominate Controller* where Connection Point* exceeds threshold
(a) If the User* is not the Controller* of a Connection Point* then the User* must, by notice to Western Power* before the Start Date* of the relevant Services*, or as soon as reasonably practicable thereafter (but in all cases no later than 30 Business Days* after the Start Date* of the relevant Services*), nominate a person as the Controller* for a Connection Point* where:
(i) the Generating Plant* with installed capacity exceeding 30 kVA is connected at the Connection Point*; or
(ii) the Connection Assets* for the Connection Point* are operated at 66 kV or greater; or
(iii) the rating of the largest motor connected at the Connection Point* is greater than 0.4% of the three phase short circuit fault level at the Attachment Point*.
(b) The User* may, from time to time, by notice to Western Power*, change the person the User* nominates as the Controller* of a Connection Point*.
(c) The Parties* must amend the Connection Point Database* following any variation made under this clause 6.1.
(d) Western Power*, acting as a Reasonable and Prudent Person*, may at any time on reasonable technical or commercial grounds object to a person nominated by the User* as a Controller* under clause 6.1, in which case the User* must either:
(i) Dispute* Western Power*’s objection; or
(ii) nominate a different person as a Controller*.
(e) If Western Power* requires, the User* must use reasonable endeavours to procure that the person nominated by the User* as a Controller* enters into a Connection Contract* with Western Power* in respect of the Connection Point*.
6.2 Where the User* is not the Controller*
(a) Subject to clause 6.2(f), if the User* is not the Controller* of a Connection Point*, and the Controller* of that Connection Point* has not entered into a Connection Contract* with Western Power* in respect of the Connection Point*, then the User* must ensure that the Controller* of that Connection Point* complies, and will continue to comply, with the obligations set out in this Contract*, to the extent that such compliance is reasonably necessary for the Parties* to satisfy their obligations under this Contract*, including, but not limited to:
(i) clause 11 (Good Electricity Industry Practice*); and
(ii) clause 12 (Technical Rules*); and
(iii) clause 13 (Technical characteristics of Facilities and Equipment*); and
(iv) clause 14 (Cooperation); and
(v) clause 15 (Access to premises); and

Controllers. Any Controller shall perform such duties and possess such powers as the Board of Directors, the Chief Executive Officer or any Vice President may from time to time prescribe.

Controllers. A controller shall also be appointed to each division. Each controller shall be responsible for the implementation of accounting policies and procedures, the installation and supervision of all accounting records, including the preparation and interpretation of financial statements, the compilation of production costs and cost distributions and the taking and valuation of physical inventories. The controller shall also be responsible for the maintenance of adequate records of authorized appropriations and the approval for payment of all checks and vouchers. The controller shall, in general, perform all duties incident to the office of controller. The foregoing shall be accomplished in a manner consistent with policies and procedures established by, for or with respect to Alcoa.

Controllers. Where a person is a Controller in relation to the Personal Property, the parties agree, to the maximum extent permitted by law, that Part 4.3 of the PPSA will not apply to the enforcement of any Security Interest in the Personal Property by that Controller. Notices or documents required or permitted to be given to the Grantor for the purposes of the PPSA must be given in accordance with the PPSA. Each Grantor consents to the Secured Party effecting a registration on the PPSR (in any manner the Secured Party considers appropriate) in relation to any Security Interest arising under or in connection with this agreement and each Grantor agrees to provide all assistance reasonably required by the Secured Party to facilitate this. Including without limitation, the registration of a PMSI interest on the PPSR. The Grantor waives its right to receive any notice under the PPSA (including notice of a verification statement) unless the notice is required by the PPSA and cannot be excluded.
Controllers a) Both Parties shall be considered independent Controllers with regard to the Personal Data Processed. The Parties shall not Process Personal Data as joint Controllers.
b) Both Parties shall commit to complying with the obligations incumbent on them pursuant to the Data Protection Legislation with regard to the Processing of Personal Data.
c) This Amendment shall not apply to the Processing of Personal Data acquired by a Party for i ts own purposes from a third party and not the other Party, such as the Processing of credit card data received by Verifone directly from the payer in a payment transaction.
Controllers. Description - Perform all accounting services necessary to properly maintain and report on the books and records of Client Company. Provide investor relations services. Expected Allocation Factors - 1) composite*; 2) total capitalization; and 3) total assets
Controllers. 10.1 User must nominate Controller if User is not the Controller
(a) If User is not the Controller of a Connection Point then User must, by Notice to ADEWAP before the Reference Service Start Date, or as soon as reasonably practicable thereafter (but in all cases no later than 20 Business Days after the Reference Service Start Date), nominate a person as the Controller for a Connection Point.
(b) User may, from time to time, by Notice to ADEWAP, change the person User nominates as the Controller of a Connection Point.
(c) The Parties must amend the Connection Point Details following any variation made under this clause 10.1.
(d) XXXXXX, acting as a Reasonable and Prudent Person, may at any time on reasonable technical or commercial grounds object to a person nominated by User as a Controller under this clause 10.1, in which case User must either:
(i) Dispute ADEWAP’s objection; or
(ii) nominate a different person as a Controller.
(e) If ADEWAP requires, User must use reasonable endeavours to procure that the person nominated by User as a Controller enters into a Connection Agreement with ADEWAP in respect of the Connection Point.
(f) If User requests ADEWAP to do so, ADEWAP must use reasonable endeavours and act in good faith to enter into a Connection Agreement with a Controller (validly nominated by User under clause 10.1(a)) in respect of the Connection Point.
