Good Electricity Industry Practice. Except to the extent a relevant standard is expressly or impliedly provided under a Licence, the National Electricity Rules or the Distribution Code or other relevant code as a standard equal to or above which an obligation should be fulfilled, each Party must fulfil its obligations under this Agreement in accordance with good electricity industry practice. Coordinated equipment replacement Without limiting clause 4.6(b) the Parties must co-operate in replacing and in adjusting both primary (high voltage) equipment and secondary (control, communication and protection systems) equipment where specific compatibility must be maintained to ensure both Parties remain satisfied that intended functionality is maintained. Specifically, a Party must replace its equipment at its own cost in order to maintain compatibility and co-ordinated functionality with the other Party’s equipment, provided that: the other Party is replacing existing functionality and not augmenting capability or service levels; the other Party is undertaking such replacement to maintain compliance with good electricity industry practice; and where a Party intends replacing any of its equipment, and where that Party acting reasonably could determine that clause 4.6(a) may require the other Party to also replace equipment, then the intending Party must give sufficient notice to the other Party of the intended equipment replacement to allow the other Party reasonable time to meet its obligations under clause 4.6(a). Consistent with clause 5.3, either Party may notify the other Party of any safety concern that requires remedial action or equipment changes. The notifying Party must specify the nature of the concern, and the required action. Upon the receipt of notice of a safety concern as provided under clause 4.6(c) the notified Party must act promptly to undertake the remedial action or equipment changes in accordance with the required action stated in the notice. The notified Party must undertake all such remedial actions and equipment changes at its own expense. If the notified Party has been obliged to act under clause 4.6(d) but disputes the validity of the safety concerns as set out in the notice, then the notified Party may subsequently make use of the dispute provisions as provided in clause 26 of this Agreement.
