Costs of Suspension. The Independent Certifier will:
(a) subject to the Independent Certifier complying with Section 8, be entitled to recover the extra costs incurred by the Independent Certifier by reason of a suspension directed under Section 5.1(b) valued as a Functions Variation under Section 8; and
(b) have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under Section 5.1(a).
Costs of Suspension. E2.1 The Referee will have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under this Referee Agreement.
Costs of Suspension. If we suspend the Services because you have failed to comply with Our Terms, we may make a charge to you to reflect our costs in suspending and, if applicable, starting the Services again. You may also be liable for all charges for Services during this period of suspension.
Costs of Suspension. Within thirty (30) days of the effective date of any suspension by Company, Provider shall submit an itemization of expenses and time expended through the effective date of the suspension, together with cost, pricing, or other documents or data required by Company. Suspensions may only be withdrawn by written notice from Company, specifying the effective date and scope of the withdrawal. Provider shall immediately resume performance unless otherwise specified in such notice. If Provider believes that an adjustment to the Services Costs or the Schedule hereunder or under an Order is justified as a result of the suspension or withdrawal of suspension, such suspension or withdrawal of suspension shall constitute a Change and Provider shall request such adjustment in accordance with the Change Control Process provisions hereunder. The Annual Budget and Cost Baseline for determining Provider’s Shared Savings shall be equitably modified to take into account any period of suspension hereunder.
Costs of Suspension. The Owner must continue to pay any Reimbursable Cost due during the period of suspension for the relevant Project if:
33.3.1 the Owner directs suspension (other than as a result of a breach of this Agreement by a NOP or where the suspension is necessary to ensure that the Works comply with the requirements of this Agreement); or
33.3.2 the Participants suspend the whole or any part of the Works under clause 33.1.
Costs of Suspension. The Independent Engineer, provided it is in compliance with Section 8, shall be entitled to recover from the Private Partner any additional costs incurred by the Independent Engineer by reason of a suspension pursuant to Section 5.1.2 and, where applicable, pursuant to Section 8 (except to the extent that, following the application of the provisions of Section 8.4 the Independent Engineer is entitled to any additional compensation). The Independent Engineer shall not be entitled to seek reimbursement from either PA Party of any costs, expenses, losses or damages or any nature and kind howsoever arising (including but not limited to loss of revenue, loss of profit, loss of contract, loss of goodwill and indirect loss of any nature) resulting from a suspension pursuant to Section 5.1.1 or a suspension following a failure to comply with Section 2.7.
Costs of Suspension. The Independent Monitor will:
(a) subject to Clause 8.3(b), have no right to be paid any costs, expenses or damages arising from a suspension under Clause 8.2; and
(b) subject to the Independent Monitor complying with Clause 11, be entitled to recover the costs reasonably incurred by the Independent Monitor by reason of a suspension directed under Clause 8.2(b) valued as a Variation to the IM Services under Clause 11.5.
Costs of Suspension. If the suspension is directed due to any act or omission of the Contractor or its Personnel (including a breach of the Contract by the Contractor) then the Contractor shall bear the costs of the suspension. Otherwise, the Principal shall be liable for the direct costs which the Contractor demonstrates it has reasonably, necessarily and not prematurely incurred by the Contractor by reason of the suspension and which the Contractor demonstrates it cannot reasonably mitigate.
Costs of Suspension. Any cost or loss incurred by:
(a) the Customer by reason of a suspension directed by Xxxxxx Xxxxx in accordance with clause 13.1 will be borne by the Customer and it is barred from bringing any Claim against Hunter Water or any Personnel in respect of such direction; or
(b) Hunter Water in taking action of the type contemplated in clause 13.3 will be payable to Hunter Water by the Customer as a debt due and payable.
Costs of Suspension. The Independent Certifier will:
