Costs of Suspension. The Independent Certifier will: (a) subject to the Independent Certifier complying with Section 8, be entitled to recover the extra costs incurred by the Independent Certifier by reason of a suspension directed under Section 5.1(b) valued as a Functions Variation under Section 8; and (b) have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under Section 5.1(a).

Costs of Suspension. E2.1 The Referee will have no entitlement to be paid any costs, expenses, losses or damages arising from a suspension under this Referee Agreement.

Costs of Suspension. If the suspension is directed due to any act or omission of the Contractor or its Personnel (including a breach of the Contract by the Contractor) then the Contractor shall bear the costs of the suspension. Otherwise, the Principal shall be liable for the direct costs which the Contractor demonstrates it has reasonably, necessarily and not prematurely incurred by the Contractor by reason of the suspension and which the Contractor demonstrates it cannot reasonably mitigate.
