The Settling Parties acknowledge the Company’s representation that, despite the shift of fixed costs to the volumetric portion of the rate, collectively customers taking the rate will generate an appropriate amount of revenue as compared with cost of service for the rate; if the shift in fixed charges to the volumetric portion of the rate results in either a significant over- or under-collection of revenue, the Company shall reevaluate the customer charge in its next distribution rate case. Attachment D provides the Company’s analysis that supports lowering the customer charge to $16.50, which is also supported by the design of Rate R-OTOD-2 as provided in Attachment C. Customers shall no longer be able to select R-OTOD once the Commission approves this settlement agreement, and Eversource shall file a cancellation of the relevant tariff pages. Upon Commission approval of this settlement agreement, Eversource shall notify all existing R-OTOD customers that R-OTOD has been discontinued and offer those customers the option to switch to either Rate R or R-OTOD-2, with a default switch to Rate R, if the customer makes no selection by the applicable deadline. Eversource shall consult with these customers on which of the available rates will likely be most appropriate and advantageous for them to enroll in based on their energy usage, their potential for shifting energy usage to off-peak periods, using the analysis with bill comparisons included in Attachment B. The Settling Parties agree that, if existing R- OTOD customers do not select either available rate within six months following Commission approval of this settlement agreement, then those customers shall be switched to Rate R rather than leaving them on the discontinued R-OTOD following that time.
