Data Protection 6. Ochrana osobních údajů
6.1. Sponsor, and Institution agree to comply with all Applicable Laws protecting the fundamental rights and freedoms of persons and the right to privacy, with regard to the processing of personal data in the scope of the Study, including but not limited to General Data Protection Regulation 2016/679 (“GDPR”), together with any additional implementing legislation, (“Data Protection Laws”).
6.1. Zadavatel a Poskytovatel souhlasí s tím, že budou dodržovat veškeré Platné právní předpisy chránící základní práva a svobody osob a právo na soukromí, pokud jde o zpracování osobních údajův rámci Studie, mimo jiné obecné nařízení o ochraně osobních údajů 2016/679 (dále jen „GDPR“) spolu s dalšími prováděcími právními předpisy, (dále jen „Právní předpisy o ochraně osobních údajů“).
6.2. As regards the processing of Study Subject personal data within the framework of performing the Agreement and conducting the Study, the Parties understand that they qualify as independent controllers. Sponsor shall determine the purpose and means of processing personal data contained in pseudonymized Study records and processed according to the Protocol and the Study Subject informed consent form. Institution shall determine the purpose and means of processing personal data contained in source documents, medical records or otherwise needed for purposes of medical care or with respect to direct communications with Study Subjects.
6.2. Pokud jde o zpracování osobních údajů Subjektu studie v rámci plnění Smlouvy a provádění Studie, Strany berou na vědomí, že jsou považovány za nezávislé správce údajů. Zadavatel určí účel a prostředky zpracování osobních údajů obsažených v pseudonymizovaných záznamech Studie a zpracovaných v souladu s Protokolem a formulářem informovaného souhlasu Subjektu studie. Poskytovatel stanoví účel a prostředky zpracování osobních údajů obsažených vezdrojových dokumentech, lékařských záznamech nebo jinak nezbytných dokumentech pro účely lékařské péče nebo s ohledem na přímou komunikaci se Subjekty studie.
6.3. The categories of data subjects, personal data and special category personal data identified below are processed for purposes of the Study in accordance with the Agreement: 6.

6.1. Zadavatel, Zdravotnické zařízení a Hlavní zkoušející souhlasí s tím, že budou dodržovat veškeré Platné právní předpisy chránící základní práva a svobody osob a zejména právo na soukromí, pokud jde o zpracování osobních údajů mimo jiné obecné nařízení o ochraně osobních údajů 2016/679 (dále jen „GDPR“) spolu s dalšími prováděcími právními předpisy (dále jen „Právní předpisy o ochraně osobních údajů“).
6.2. Sponsor agrees to collect, use and disclose all data collected or generated in the Study and pursuant to the Protocol including that which identifies or could be used to identify a Study Subject (hereinafter “Subject Data”) only in accordance with the Informed Consent(s) obtained from each Study Subject and for the purpose of complying with Applicable Law. Sponsor will use reasonable efforts: (1) to protect the privacy and security of Subject Data; (2) to require its business partners who receive Subject Data to protect its confidentiality; and (3) to disclose to such business partners only such Subject Data as may be necessary for such business partners to perform and carry out activities for which they have been engaged. For the sake of clarity, Sponsor shall have the right to use personal data for secondary research purposes and for its continuing internal, non-commercial academic research and education purposes as allowed under the Informed Consent, 6.

Data Protection 6. 1. The Institution and the Sponsor agree to process and protect personal data acquired pursuant to this Agreement in accordance with the provisions and principles of all relevant data protection legislation. The Institution agrees to implement appropriate measures, to protect the personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access. The Institution and Sponsor/ shall take particular care where the processing involves the transmission of data over a network, and against all other unlawful forms of processing. At any time upon request by the Sponsor, the Institution shall inform the Sponsor in writing of any and all personal data stored by the Institution and modify, complete, 6.

The Institution and the Sponsor agree to process and protect Personal Data acquired pursuant to this Agreement in accordance with the provisions and principles of all relevant data protection legislation. The Institution understands that it may be required to process Personal Data on behalf of the Sponsor. As such, the Institution agree to process such Personal Data only on instructions from and for the purposes determined by the Sponsor, and to implement appropriate measures, to protect the Personal Data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access. The Institution shall take particular care where the processing involves the transmission of data over a network, and against all other unlawful forms of processing. At any time upon request by the Sponsor, the Institution shall inform the Sponsor in writing of any and all Personal 6.
