DAYS AND HOURS OF WORK AND OVERTIME. (a) Regular full-time employees will normally be scheduled for a 40-hour work week consisting of eight hours per day (five days per week) or 10 hours per day (four days per week), as required by the Employer. (b) In case of unanticipated emergency, or where fewer hours of work are required by the Employer, regular full-time employees may be scheduled to work less than 40 hours per week. (c) The Employer agrees that if it becomes necessary to work overtime, such overtime will be distributed as equally as possible amongst those employees concerned who normally perform such work. Where overtime is required for CSR’s the CSR or CSR Xxxxxxx is to inform the Service Manager or some other responsible management person, so that the circumstances can be surveyed and a decision forthcoming immediately as to what action should be taken. Employees may, for legitimate reasons, refuse to work overtime. All overtime must be approved by Management. When CSR’s work overtime the person authorizing the overtime shall sign the employee’s time card. (d) Employees absent from work who would otherwise be laid off (i.e. sickness, accident or vacation) and cannot be contacted to be given layoff notice, shall be entitled to be given layoff notice at the beginning of their first shift to commence at the end of that shift. (e) Overtime for all employees shall be paid as follows: (i) one and one-half times the regular wage for hours worked in excess of 40 hours a week, and double the employee’s regular wage for any time worked over 48 hours a week; (ii) the Employer and Union recognize that CSR’s are sometimes able to complete their route in less than the scheduled daily hours, while on other days additional time beyond the scheduled daily hours is required to complete the route. The Employer and Union agree that the existing practice of: 1. permitting employees to leave work early if they finish their route inside the scheduled daily hours; 2. expecting employees to finish their route without payment of daily overtime in circumstances where extra time beyond the scheduled daily hours is required to finish the route; is mutually advantageous and should be continued. Accordingly, the Employer and Union agree that overtime is not payable for hours worked on a daily basis and is only payable on hours worked in excess of 40 hours in a week in accordance with paragraph

DAYS AND HOURS OF WORK AND OVERTIME. Each employee shall work and be guaranteed eight ( 8 ) hours each day with a half hour unpaid lunch and a consecutive guaranteed five (a5) Regular full-time employees will normally be scheduled for a days, forty (40-) hour work week. The work week consisting shall be Monday to Friday. All overtime shall be calculated and paid each pay period, except banked overtime as described Article of eight hours per day (five days per week) this Agreement. (d) Employees absent from work who would otherwise be laid off (i.e. sickness, accident or vacation) and cannot be contacted to be given layoff notice, in reverse seniority. All employees shall be entitled to a paid break of fifteen (15)minutes twice (2) a day during their shift. When overtime is to be given layoff notice at the beginning of their first shift worked, employees will be entitled to commence at the end of a paid fifteen (15) minute coffee break before overtime. After two (2) overtime, employees will be entitled to an additional paid coffee break plus a five dollar ($5.00) meal allowance. In order that shift.
(e) Overtime for all employees there shall be no dispute involving the matters of the number of hours an employee has worked or overtime, the Employer shall install a system of time cards for the accurate recording of each time and pay will be made accordingly. Shift notices will be posted no later than the Thursday for the following week. Any employee who commences work at designated starting time shall always be guaranteed pay for the amount of hours normally worked for that day, i.e. eight ( 8 ) . All shifts will be based upon qualifications and seniority basis. When any employee is called to work on days off, shall receive a minimum of four (4) hours' pay at overtime rates. Employees who have not worked forty (40) hours during the current work week will be paid as follows:
(i) one time and one-half times the regular wage for hours worked in excess of 40 hours a week, and double the employee’s regular wage for any time worked over 48 hours a week;
(ii) the Employer and Union recognize that CSR’s are sometimes able to complete their route in less than the scheduled daily hours, while on other days additional time beyond the scheduled daily hours is required to complete the route. The Employer and Union agree that the existing practice of:
1. permitting employees to leave work early if they finish their route inside the scheduled daily hours;
2. expecting employees to finish their route without payment of daily overtime in circumstances where extra time beyond the scheduled daily hours is required to finish the route; is mutually advantageous and should be continued. Accordingly, the Employer and Union agree that overtime is not payable 1 for hours worked on a daily basis sixth or seventh day. (e) Overtime When an employee is called to work on one (1) of his days off, he shall receive a minimum of four (4) hours pay at overtime rates, and if called to work on a regular work day, he shall receive a minimum of eight (8) hours' pay at straight time rates.
(f) When an employee goes on to a higher rated job, than his normal job, for all employees four (4) hours or more, he shall be paid at the higher rate for the full day. If he goes on to such a job for less than four (4) hours, he will only get paid for the actual time worked on that job. Time would include any preparation work or the gathering of materials involved in such job. An employee's wage rate shall not be lowered when working in a lower paid job on a temporary basis, where the employee is temporarily assigned by the Employer for the Employer's convenience.
(g) In order that an accurate record of hours worked are kept, the Employer shall install a time clock and time cards. Each employee commencing work for the Employer shall be issued a time card. Said time card shall be punched before commencing work and upon completion of an employee's work, and all time shown thereon be paid as follows:stated above.
(h) If an employee reports late for work, that employee will only be paid from the time he commences work and for the time actually worked, but continual tardiness will warrant dismissal. If an employee on a classified job reports late for work exceeding thirty (30) minutes without a legitimate reason and there is a rush job waiting to be done which involves this employee, the Employer may put another employee on that job for that day and the employee who is late for work on the job the other employee left.
(i) one When employees are advised to report for work at a specified time, they shall be paid from that time, even though there may be no work for them to do.

20.01 Employees shall work and be guaranteed eight (a8) hours each day, provided they commence work at the start of their shift, with a half (½) Regular hour off for lunch. The normal work week shall be five (5) consecutive days, forty (40) hours per week, 00:01 a.m. Sunday through Saturday midnight, except that Okanagan Drivers may be scheduled on a Monday through Sunday shift. Part time employees may work any time to replace regularly scheduled employees who are absent for vacation, sick, A.T.O., or leave of absence, to meet overload requirements, and to supplement staff levels provided full-time employees will normally be have been scheduled for a 40-hour to the maximum of the basic work week consisting of eight hours per day (five days per week) or 10 hours per day (four days per week), as required by the Employer.
(b) In case of unanticipated emergency, or where fewer hours of work are required by the Employer, regular full-outlined above. Part time employees hired after April 19, 2007 may be scheduled to work shifts that are less than 40 eight (8) hours in duration. Full-time employees performing regularly scheduled shifts commencing on Saturday or Sunday will receive a premium of ten dollars ($10.00) per shift worked. Drivers on Okanagan runs are not eligible for the weekend premium.
20.02 Any hours worked in excess of eight (8) on a regular day, as defined in Section 20.01 above in any one (1) day, shall be at the rate of time and one-half (1 ½) for the first one (1) hour and double time thereafter. −21−
20.03 Employees shall work and be guaranteed seven and one-half (7 ½) hours each day, provided they commence work at the start of their shift, with a half (½) hour off for lunch. The normal work week shall be five (5) consecutive days, thirty-seven and one-half (37 ½) hours per week, Sunday through Saturday. Employees hired after April 19, 2007 may be scheduled to work shifts that are less than seven and one-half (7 12) hours or eight (8) hours as applicable. Any vacancy created as a result of a current full-time person who resigns, retires or is terminated must be filled by a full time employee provided that the Company had not previously advised the Union that it is considering a reduction of the position to part time.
20.04 Any hours worked in excess of seven and one-half (c7 ½) on a regular day, as defined in Section 20.03 above, in any one (1) day, shall be at the rate of time and one-half (1 ½) for the first hour and double time (2X) thereafter.
20.05 All time worked on the sixth (6th) day shall be paid at the rate of time and one-half (1 ½) for the first two (2) hours and double time thereafter. All hours worked on the seventh (7th) day shall be paid at the rate of double time, with a minimum of four (4) hours guarantee.
20.06 The Driver on the Okanagan run shall work a period of twenty-four (24) hours over a forty-eight (48) hour period of any two (2) consecutive days, Sunday through Saturday at straight time rates of pay. Whenever there is an available trip to the Okanagan and a driver has had two (2) trips in that particular week that driver may take a third (3rd) trip provided that the available trip has first been offered to all other drivers in order of seniority and no other driver wishes to take the trip. The third (3rd) trip will be paid at the applicable rates plus any applicable premiums.
20.07 Any hours worked over the twenty-four (24) hours shall be paid at double time rate of pay. Overtime worked on his other two (2) work days shall be paid as set out in 20.02 above.
20.08 Upon representation of expense receipts, this driver shall be reimbursed.
20.09 Drivers who make deliveries to Vancouver Island shall continue to work the five (5) days as set out in 20.01 above for any one (1) day, and shall receive $8.00 lunch money and be given one-half (½) hour lunch time. Effective August 1st, 1995, the lunch money will be increased to $9.00.
20.10 Any employee called back to work in any emergency after his working day has been completed shall be paid a minimum of three (3) hours' pay at the rate of double time.
20.11 If an employee reports late for work, that employee will only be paid from the time he commences work and for the time actually worked.
20.12 All overtime shall be broken down into five (5) minute units, based on one-twelfth (1/12th) of the applicable hourly rate, times the appropriate overtime rate.
20.13 When employees are advised to report for work at a specified time on any day, they shall be paid for that day, even though there may be no work for them to do, provided they are ready for work, excepting as set out in Section 20.06 herein.
20.14 The Employer agrees that if when it becomes is necessary to work overtimeovertime in a department or work area, such overtime will be distributed as equally as possible amongst those to the employees concerned who normally perform such workof that department or work area. Where The person in charge of that department shall go to each employee in the department in order of seniority and request if they desire to work overtime. When overtime is required available in the office, and the work to be done does not belong to any particular classification, that overtime must be distributed in order of overall office seniority. Some examples of this are: transferring files to boxes for CSR’s the CSR or CSR Xxxxxxx is to inform the Service Manager or some other responsible management personstorage, so that the circumstances can be surveyed meat department receiving, month end work, stock taking work, and a decision forthcoming immediately as to what action should be takenspecial projects, etc. Employees may, may for a legitimate reasons, reason refuse to work overtime. All overtime must , however if all employees so refuse, then the junior employees in the number required shall be approved by Management. When CSR’s work overtime the person authorizing the overtime shall sign the employee’s time cardobligated to work.
(d) Employees absent from work who would otherwise be laid off (i.e. sickness, accident or vacation) and cannot be contacted to be given layoff notice, 20.15 Non bargaining unit persons shall be entitled allowed to be given layoff notice at the beginning take stock, provided that there is one (1) bargaining unit employee with each non-bargaining unit person who is tabulating figures of their first shift to commence at the end of that shiftstock items.
(e) Overtime 20.16 The day shift for all employees warehouse and drivers shall be paid as follows:eight (8) consecutive hours from 5:00
A. M. to 6:30 P.M. with a half (i½) one hour for lunch. Employees will be scheduled the same shift time for five consecutive days except that drivers recognize that some flexibility in the scheduling of shifts may be required to supply an acceptable level of service. The day shift for office personnel shall be seven and one-half times (7 ½) consecutive hours between 7:00 A.M. and 5:00 P.M with a half (½) hour for lunch. Whenever two (2) or more employees are performing essentially the same job and an option to start at a different time than other employees on the shift is available, the option must be given to the senior employee. When two (2) or more floaters can perform the same positions they are scheduled to relieve, the senior floater will be given any scheduling option that might be available.
20.17 Any shift starting prior to the regular wage for hours worked in excess of 40 hours a week, and double the employee’s regular wage starting time for any Department as set out above or ending after the quitting time worked over 48 set out above, shall be a premium shift and any second or third shift shall be a premium shift and paid for as follows.
20.18 Employees shall work seven (7) hours and receive eight (8) hours' pay, with a week;lunch period of thirty (30) minutes without pay. July 31, 2000 shift length 8 hours. July 31, 2000 shift premium $3.00/hour. August 5, 2001 shift premium $2.00/hour. August 4, 2002 shift premium $1.00/hour.
20.19 Where there are only two (ii2) men on a second or third shift and one (1) has to leave due to injury or illness, the other may also leave for safety purposes and be entitled to his full eight (8) hours' pay for such shift, provided the Employer is notified and Union recognize that CSR’s are sometimes able given the opportunity to complete their route in less than the scheduled daily hours, while on other days additional time beyond the scheduled daily replace staff.
20.20 The Employer shall give to each employee whose shift is to be changed a minimum of twenty-four (24) hours advance notice prior to such shift becoming applicable.
20.21 Where help is required for unloading at Cash & Carry or I.G.A. loads, such help will be provided at destination.
20.22 It is intended that every employee should have a minimum of eight (8) hours rest between the end of one (1) shift and the commencement of another. In the event that any employee is recalled to complete work before a period of eight (8) hours elapses, he shall be paid at overtime rates of double time for the routeentire shift that he is called in to work before he has received his full eight (8) hour break. The Employer and Union agree No employee shall be permitted to resume work on his own accord until eight (8) full hours have elapsed.
20.23 Where shift work is in operation, it is agreed that the existing practice of:
1. permitting all employees to leave work early if they finish their route inside the scheduled daily hours;
2. expecting employees to finish their route without payment of daily overtime in circumstances where extra time beyond the scheduled daily hours is required to finish the route; is mutually advantageous and should such job classifications involved shall not be continued. Accordingly, the Employer and Union agree rotated or altered unless specifically requested by a particular employee that overtime is not payable for hours worked on a daily basis and is only payable on hours worked in excess of 40 hours in a week in accordance with paragraphhe be changed.
