Death on duty. When an officer dies in the performance of his/her duties within the course and scope of his/her employment, his/her spouse and/or other surviving dependents who are enrolled in the County’s Health Plan or unborn children of the Officer and enrolled spouse will be allowed to remain on the County health plan with the same coverage and restrictions as retirees and their families. A spouse may elect to continue coverage as long as he/she is not employed or remarried and by virtue of that employment or remarriage becomes eligible to participate in another group plan with equivalent benefits and costs. Surviving children may continue coverage for as long as they have no equivalent coverage and are not eligible for insurance coverage by virtue of the employment of the surviving parent, legal guardian, or spouse until age 26. Effective July 1, 1999, only those dependents of the active employee, who are covered by the current plan at the time of the employee's death, are eligible for continuation with the county plan. Newly acquired dependents of the surviving dependent (new spouse or new children) are not eligible for coverage under the county plan.
