Injured on Duty. 33.1 Employees prevented from completing a shift due to a bona fide injury sustained while on duty will be paid for the full shift at straight time rates of pay, unless they receive Worker’s Compensation benefits for the day of the injury in which case the employees will be paid the difference between such compensation and payment for their full shift.
Injured on Duty. 43.01 An employee who is injured on the job or suffers a recurrence of an injury on the job shall, as soon as possible, report the matter to the Supervisor or Department Head and file a Workers' Compensation claim.
(a) An employee who is injured on the job or suffers a recurrence of an injury on the job and who has his Workers' Compensation claim approved shall receive benefits pursuant to the Workers' Compensation Act.
(b) Employees who are receiving compensation benefits under the Workers' Compensation Act shall earn vacation and sick leave credits in accordance with Articles 26 and 27. However, vacation leave credits may only be earned up to one leave year as per Article 26.01.
43.03 The absence of an employee who is injured on the job or suffers a recurrence of an injury on the job and who is waiting for approval of a Workers' Compensation claim, and/or who is receiving benefits under the Workers' Compensation Act shall not be charged against the employee's sick leave credits, vacation credits, or any other accumulated credits except as provided in 43.04.
43.04 Notwithstanding Article 43.03, an employee, who as a result of having suffered an injury on the job is without revenue while waiting to receive compensation benefits pursuant to the Workers' Compensation Act, may apply for a monetary advance from the Employer subject to the following conditions:
(a) that he has requested such advance at least three (3) days before each of his regular pay days;
(b) that he agrees to assign compensation payments equal to the same amount and same period of time;
(c) that the employee has the necessary vacation and/or sick leave credits; or is eligible for a sick leave advance under 27.14.
(d) payment shall commence following a three (3) day waiting period stipulated under the

(f) if the claim is not approved, the employee shall be entitled retroactively to use any accumulated sick leave credits in accordance with Article 27;
(g) the Employer will credit any sick leave days used for this purpose to the employee's accumulated sick leave upon receipt of the assigned compensation payments following approval of the claim;
(h) for the purpose of calculating the monetary advance, one full accrued sick leave credit shall be used for each of the employee's scheduled working days; and

Injured on Duty. The Town of Cape Xxxxxxxxx provides Workers' Compensation Insurance Coverage for all employees. Any employee who sustains a personal injury or compensable illness arising out of and in the course of employment shall be paid during each week of total incapacity to work resulting from the injury an amount sufficient, when added to the weekly payment of Workers' Compensation paid with the laws of the State, to equal regular salary or normal wage. Such additional payments shall not be continued beyond 8 weeks except upon approval by the Town Manager. No additional payments shall be made in any instance when, in the opinion of the Director of Public Works and Town Manager, the accident occurred as a result of intoxication, violation of rules and regulations on the part of the employee, or while the employee was in the employ of any other person, firm, entity or corporation.
Injured on Duty. All of the persons in the Unit shall be covered by the provisions of the Worker's Compensation Act, of the Province of New Brunswick. An employee receiving compensation benefits under the Worker's Compensation Act for injury on the job shall receive the difference between the employee's regular pay and the benefit that is paid by WorkSafeNB during the employee's period of total temporary disability. The absence of an employee who is receiving compensation benefits under the Worker's Compensation Act shall not be charged against the employee's sick leave credits or vacation credits. For the purpose of this Article, where WorkSafeNB benefits are reduced by the amount of any Canada Pension Plan payments, these payments shall be deemed to form part of WorkSafeNB benefits.
Injured on Duty. Net Pay" for the purposes of Article 19.01 shall mean fifty percent (50%) of the net pay of the member's full time position.
Injured on Duty. An employee receiving compensation benefits under the Workers' Compensation Act for injury on the job shall receive the difference between the total of Workers' Compensation Benefits and all other revenues (i.e., Canada Pension Plan Disability Benefits) and his net take home pay had he continued to work. Such benefit will be limited to the period of time such employee is totally temporarily disabled.
Injured on Duty. 30.01 An employee prevented from performing their regular work with the Employer on account of an occupational accident that is covered by the Workers Compensation Act shall be paid by the Workers' Compensation Board.
30.02 Notwithstanding Article 30.01, in the event that the salary of an employee, at the time of a claim under the Workers' Compensation Act, exceeds the maximum annual earnings established by regulation, the Employer shall, during the period the employee is in receipt of temporary earnings loss benefits, continue to pay the employee an amount equal to 80% (85% after 38 weeks) of net income on a bi- weekly basis on that portion of salary which is in excess of the maximum earnings recognized by the Workers' Compensation Board. The calculation of net pay entitlement shall be made in the same manner as the calculation made by the Workers' Compensation Board up to the maximum earnings.
30.03 When an employee is in receipt of Workers Compensation Board benefits for a period of ten (10) working days or more, the Employer will pay, during the period while the employee is receiving temporary earnings loss benefits pursuant to the Workers Compensation Act, the full costs of the employee's premiums where the employee prior to their injury participated in Group Life, Group Medical and Group Long-Term Disability Insurance Plans described in Article 39 and will make the employee's pension contributions.
30.04 The absence of an employee who is receiving compensation benefits under the Workers' Compensation Act shall not be charged against the employee's sick leave credits or vacation credits.
30.05 An employee who is receiving compensation under the Workers Compensation Act, shall continue to earn the benefits of this Agreement, save and except statutory holidays.
30.06 An employee who is injured during working hours, and is required to leave for treatment or is sent home as a result of such injury, shall receive payment for the remainder of the shift at their regular rate of pay, without deduction from sick leave, unless the employee has sought treatment and the attending physician states that the employee is fit for further work on that shift.
30.07 Pending the initial decision of a Workers Compensation claim, a Permanent Employee shall continue on payroll and shall be paid at the level which is equivalent to their entitlement under the Workers Compensation Act. Injured on Duty. 23.01 Employees injured while at work will not be required to make accident reports before they are given medical attention, if required, but will make them as soon as practicable thereafter. Proper medical attention will be given at the earliest possible moment.
