Disallowances and Adjustments. DEVELOPER shall account to CITY for any and all Program funds expended by DEVELOPER or its officer, employee, agent, or representative, whether or not such officer, employee, agent, or representative was acting within the scope of his or her employment. DEVELOPER shall repay CITY, on demand, the full amount of any improperly expended HOME Program funds, and shall comply with requirements of 2 CFR 200.344. CITY may retain any funds of DEVELOPER in CITY's possession to liquidate (in whole or in part) the debt resulting from any such improper expenditure.
