Discipline and Other Action. (a) If an employee tests positive for the first time, the employee is not subject to discipline or discharge. The employee shall receive such treatment or counseling as may allow the employee to return to work drug/alcohol free. Payment of said treatment shall be determined by the level of coverage in the City’s insurance policy and the requirements and conditions of said policy. Employees may utilize sick leave and then vacation or personal leave for such counseling. An employee must test clean in two (2) consecutive random specimens prior to returning to work. Upon return to work such employee shall be subject to random drug/alcohol testing for a period of one year. (b) If an employee after reinstatement tests positive for illegal drugs, prove abuse of prescription drugs, or alcohol a second time, such employee can be subject to discipline, including possible termination. (c) The provisions of this Article do not apply to an officer who has consumed or in the possession of drugs or alcohol in the official performance of their duties.
Discipline and Other Action. 1. Except as described in paragraph 2 of this Article, prohibited conduct described in Section D1, D4 and D5 above shall result in termination. Prohibited conduct described in Sections D2, D3 and D6 shall result in actions specified in Section G below. 2. Employees found to have committed prohibited conduct described in Section D5 as a direct result of undercover police work assignments shall be subject to the requirements of Section H of this Article.
