Discretionary Leave. 1A. All regularly employed Teachers shall earn discretionary leave at the rate of twelve (12) days for each year of service in the employ of Manhattan School District Number 3. B. The full amount of current year discretionary leave and accumulated sick leave will be in effect from the starting date of the contract.
C. Discretionary leave may be used for illness or personal business. E. The School District shall notify each Teacher in writing, at least 50% annually, of the number of discretionary and sick days accrued.
F. All leaves granted under the provisions of this Section will be in units of full days or half days. Appropriate and non-habitual absences of 2/7 or less may not result in a loss of benefits. This determination will be made by the building administrator.
G. Teachers will be granted discretionary leave for personal business with pay during each school year upon written application to the principal.
1. Discretionary Leave. 1. Discretionary Leave. A. Three (3) days of discretionary leave with pay per year shall be available to all employees for any reason.
B. No more than fifteen (15) percent of staff per building (rounded up to the nearest whole number) will be granted leave for any given day. Discretionary leave on the days directly before or after holidays, the first or last day of school, the day before or after the winter break, the day before or after the February break, or the day before or after the April break will be counted as two (2) days.
C. The procedures for obtaining such leave are as follows:
1. Full-time employeesIf at all possible, including those on extended contractthe employee must give notice for such leave, identifying it as employee discretionary leave, to the principal or supervisor five (5) days in advance of taking said leave.
2. Supervisor’s signature does not necessarily imply approval of paid leaves. The absence report will then be entitled forwarded to Human Resources to ensure that negotiated agreement allowable leave requirements have been met.
D. In an effort to provide employees flexibility regarding the use of discretionary leave, three (3) days of discretionary leave per may be carried forward for use in the following year (for a total of six (6) days in the next school year). Employees on a contract of at least 50% but less than 100% If carried forward such days must be used or they will be awarded discretionary leave on a pro-rated basislost. Short-term (less than 50% or less than 90 days) contracted employees The carry forward days are not eligible for cash out. Except for the days which can be carried forward into the following year, discretionary leave is noncumulative. Employees will be electronically notified of the opportunity to “roll over” eligible discretionary leave days not less than three (3) weeks prior to the June 10 deadline for submission. Once the request has been submitted, it is irrevocable.
E. Employee discretionary leave may not be used for any day on which the District operates under an emergency schedule due to inclement weather, unless such leave is prearranged at least five days in advance, when possible, as outlined in item #3a of this section. However, when the district is operating on an emergency, shortened schedule due to inclement weather, any employee arriving after the start of the adjusted student day will use employee discretionary leave first (if available), and then leave for illness, injury, and emergencies in half-hour increments (see Section 7.1.K).
F. Employees with unused employee discretionary leave as of June 30 of the preceding school year will be eligible to receive remuneration for unused leave. The employee must have the equivalent of at least one-half workday balance in order to exercise this option. Remuneration shall be equal to the then daily guest employee rate times the number of discretionary leave days balance. The discretionary leave balance shall be reduced to zero (0). Payment shall be made no later than July. Employees who submit notice of resignation or retirement by April 1 will automatically receive per diem remuneration for any unused discretionary leave. Discretionary Leave. 1The Board of Directors recognizes that situations arise during the year in which the teacher must be absent in order to handle problems of a Discretionary nature. All such written requests shall be acted upon within thirty (30) days prior after the receipt thereof, and such requests may be granted upon approval of the President. The five (5) year waiting requirements specified above in paragraph one (1) shall not apply in cases of discretionary leave requested for health, medical, or job training reasons.
B. Scheduled increment adjustments in salary and other credits are not allowed for such leave; and, during any such leave, the employee shall not accrue seniority but shall remain on the seniority list and from the commencement of the leave shall accumulate no further rights for any paid leaves of absence. Upon approval of such leave, the College shall be free, in its sole discretion, to leave the position open or may proceed to fill the same.
C. An employee who is granted discretionary leave shall have the following reemployment rights:
1. If the discretionary leave does not extend beyond ninety (90) days, upon giving forty-five (45) days’ advance written notice to his/the President, such employee shall at the expiration of the period for which leave was granted be reassigned to his or her immediate supervisororiginal position; and

Discretionary Leave. A. Three (3) days of discretionary leave with pay per year shall be available to all employees for any reason.
B. No more than fifteen (15) percent of staff per building (rounded up to the nearest whole number) will be granted leave for any given day. Discretionary leave on the days directly before or after holidays, the first or last day of school, the day before or after the winter break, the day before or after the February break, or the day before or after the April break will be counted as two (2) days. If used on the days listed above and the discretionary leave balance is less than two (2) days, after the discretionary leave balance is exhausted using the two for one ratio, leave without pay will be deducted for the time not covered by available EDL using a one for one ratio (straight time).
C. The procedures for obtaining such leave are as follows:

Discretionary Leave. 1A. All regularly employed Teachers shall receive twelve (12) discretionary leave days each school year. FullPart-time employees, including those on extended contract, teachers will be entitled to granted pro-rated discretionary leave based upon their FTE.
B. The full amount of current year discretionary leave and accumulated sick leave will be in effect from the starting date of the contract.
C. Discretionary leave may be used for illness or personal business. In the event of district is operating on an emergency, shortened schedule due to inclement weather, any employee arriving after the start of the adjusted student day will use employee having used all accrued discretionary leave first (if available), and then leave for illness, injury, and emergencies in half-hour increments (see Section 7.1.K).
F. Employees with unused employee discretionary leave as of June 30 of the preceding school year will be eligible to receive remuneration for unused leave. The employee must have the equivalent of at least one-half workday balance in order to exercise this option. Remuneration shall be equal to the then daily guest employee rate times the number of discretionary leave days balance. The discretionary leave balance shall be reduced to zero (0). Payment shall be made no later than July. Employees who submit notice of resignation or retirement by April 1 will automatically receive per diem remuneration for any unused discretionary leave, may request up . Discretionary Leave. 1. Full-a. 7e. No more than 10 percent (2 teachers) of the teaching staff may take discretionary leave at any one time. Requests shall be filled on a first- come first-serve basis. A written absence request form for discretionary leave must be submitted to the building principal at least two (2) days prior to the day(s) of absence. In the event that the teacher fails to submit a leave request in a timely manner, such leave request may be granted or denied at the building principal’s discretion. Those utilizing the discretionary leave days for legitimate medical leave reasons are not subject to this restriction. No more than 5 discretionary days can be used consecutively without medical documentation in support of the leave. Should special circumstances arise and subs be available, administration may, at their discretion, extend beyond the 10 percent cap in this section.
f. Unless required for unanticipated medical or emergency reasons, discretionary leave may not be used during the first five (5) and last five (5) days of discretionary leave may be used in any student attendance of the school year.
8g. The total of unused discretionary leave days shall be listed on the itemized salary statement that accompanies the warrant each month.
h. Unused, accumulated sick leave will be "bought back" from the individual tenured teacher at the time of his or her termination from the school district at a rate of 1/4 of the current daily rate of pay. Discretionary Pay Out = ¼(Number of Days Accumulated X Current Daily Rate of Pay) Any member who willfully terminates employment during the term of his/her contract shall forfeit entitlement to payment of discretionary leave.
i. At the end of each school year, any days of accumulated sick leave not used in excess of 160 shall be “bought back” by the district at the same rate as listed in section h. If notification of intent to terminate occurs after May 1, the district may delay payment until the regular July board meeting of that year.
j. Any temporary medical condition that requires an absence of five (5) or more consecutive days or a total of ten (10) or more total school days must be verified in writing by the physician of record. Such a written statement shall specify the probable length of time required for the individual to recover from the temporary disability to the point where he or she is capable of resuming full performance of teaching duties and responsibilities.
k. In cases of suspected abuse, the administration may require a doctor’s statement of illness.
l. A teacher who is unable to teach because of illness or disability and who has exhausted all leave days available, shall either request days from the sick leave bank, if he/she is a member, or be granted a leave of absence without salary for the duration of the illness or disability or for one year, whichever is less.
m. For any deviation from regulations set forth herein, the Board of Trustees must give prior approval. It is understood and agreed that no payment will be made at the time of termination of employment will be added to accrued sick or at any other time for unused leave for compensation under the Sick Leave Reimbursement Plan. Discretionary Leave. Up to four (4) half days or two (2) full days of leave shall be granted each year to each employee to attend to personal matters, with no restrictions. (1) discretionary leave day shall be allowed each certificated employee for important compelling personal matters. FullThis discretionary leave day shall not be used for conducting income-time employeesproducing business. Discretionary leave shall not be used for a strike against the Puyallup School District. The District shall grant Discretionary Leave in the order the requests are received provided the requests are made in compliance with the above conditions. After February 1, including those only fourteen (14) discretionary leave requests shall be honored on extended contractFridays.
