DOMICILIUM. 24.1 The Parties chose as their respective domicillia citandi et executandi (the address nominated by the Parties where notices may be sent) the physical, postal address and/or email address stated in clauses 1.1 and 1.2 of the Contract of Sale.
24.2 Either party shall be entitled to change the domicilium address by giving written notice thereof to the other which may be delivered by hand, by facsimile, by email or by prepaid registered post.
24.3 Any notice which is given by either party to the other party’s domicilium address, being the physical, postal, email addresses or facsimile number stated in clauses 1.1 and 1.2 of the Contract of Sale, shall be deemed to have been duly given:
24.3.1 if hand delivered; on the day on which hand delivery takes place, either by handing such notice to the party concerned or by placing/affixing it in a prominent place at the party’s domicilium;
24.3.2 if posted by pre-paid registered post; on the fourth day following the date of posting of such notice;
24.3.3 where sent by email to the stated email address; on the day on which the email is actually sent which date shall be established by reference to the aforesaid machine’s activity report used to send such notice.
24.4 Notwithstanding anything to the contrary herein contained, a written notice or communication actually received by either party shall be an adequate written notice to it notwithstanding that it was not sent or delivered to its chosen domicilium citandi et executandi.
DOMICILIUM. The Parties elect the following addresses as their respective domicilium citandi et executandi:
DOMICILIUM. 25.1 The parties choose as their respective domicilia citandi et executandi for all purposes of this agreement, including the service of any legal process, their respective addresses set out in the schedule.
25.2 Any notice by the seller to the purchaser shall be deemed to have been received:
DOMICILIUM. 12.1 The parties agree that their respective physical and/or e-mail addresses as herein-before set out shall be the addresses to which all notices or other documents may be sent in relation to this Agreement. They accordingly respectively select such addresses as their domicilium citandi et executandi. However, in the event of the PURCHASER having taken possession of the PROPERTY in terms of clause 4 (four) above, he hereby selects, in addition to his e-mail address the address of the PROPERTY as his domicilium citandi et executandi from such date of possession, irrespective of whether he physically occupies the property.
12.2 Any notice or communication required or permitted to be given in terms of this Deed of Sale shall only be valid and effectual if in writing and it shall be competent to give notice by e-mail.
12.3 Any party hereto may by notice to any other party, change the physical address chosen as its domicilium citandi et executandi to another physical address in the Republic of South Africa, or his email address to another email address, provided that the change shall become effective only on the fifth business day from the deemed receipt of the notice by the other party.
12.4 Any notice to a party –
12.4.1 sent by prepaid registered post in a correctly addressed envelope to it at an address chosen as its domicilium citandi et executandi shall be deemed to have been received on the fifth business day after posting (unless the contrary is proved);
12.4.2 delivered by hand to a responsible person during ordinary business hours at the physical address chosen as its domicilium citandi et executandi shall be deemed to have been received on the day of delivery; or
12.4.3 sent by e-mail to its chosen e-mail address stipulated above, shall be deemed to have been received on the first business day after date of despatch (unless the contrary is proved).
12.4.4 Notwithstanding anything to the contrary herein contained, a written notice or communication actually received by a party shall be an adequate written notice or communication to it notwithstanding that it was not sent to or delivered at its chosen domicilium citandi et executandi.
12.4.5 For the purposes of this Deed of Sale, "business day", means any day other than a Saturday, Sunday or public holiday.
DOMICILIUM. 24.1. The PURCHASER hereby chooses as his domicilium citandi et executandi for all purposes under this Agreement, whether in respect of Court process, notices or other documents or communications of whatever nature, the following address: PHYSICAL ADDRESS FAX NO EMAIL CELL NUMBER TEL NUMBER
24.2. Any notice or communication required or permitted to be given in terms of this Agreement shall be valid and effective only if in writing but it shall be competent to give notice by telefax.
24.3. Any notice by the SELLER: -
24.3.1. sent by prepaid registered post in a correctly addressed envelope to the PURCHASER at his domicilium citandi et executandi shall be deemed to have been received on the fifth business day after posting (unless the contrary is proved);
24.3.2. delivered by hand to a responsible person during ordinary business hours at the physical address chosen as the PURCHASER’S domicilium citandi et executandi shall be deemed to have been received on the day of delivery; and
24.3.3. sent by telefax to the PURCHASER’S chosen telefax number stipulated in clause 24.1 herein shall be deemed to have been received on the date of despatch (unless the contrary is proved).
24.4. Notwithstanding anything to the contrary herein contained, a written notice or communication received by the PURCHASER shall be an adequate written notice or communication to the PURCHASER notwithstanding that it was not sent or delivered to the PURCHASER’S domicilium citandi et executandi.
DOMICILIUM. 10.1 Any notice under this Agreement shall be sufficiently served if posted by registered post to: 000 Xxxxxxxx Xxxxxx Xxxxxxxx Pretoria 0083
10.2 Each party shall be entitled at any time to change its domicilium to any other address within the Republic of South Africa, provided that such change shall take effect only upon delivery or deemed delivery of notice thereof to the other party.
DOMICILIUM. For purposes of this agreement, the Employee/Member elects the residential address in this document as the domicilium citandi et executandi.
DOMICILIUM. 10.1 The SELLER and PURCHASER select as their respective domicilia citandi et executandi for all purposes hereunder the address set out in Clause 1.
10.2 Any notice dispatched to the SELLER or PURCHASER by prepaid registered post or facsimile to the PARTIES’ said domicilium citandi et executandi shall be deemed to have been received by such a party 7 (SEVEN) days from date of dispatch thereof.
DOMICILIUM. 16.1 You choose the customer address as your domicilium citandi et executandi and to receive all notices arising out of this agreement.
16.2 AMC chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, the address listed in section 1.2 above.
DOMICILIUM. 17.1. The parties choose as their domicilia citandi et executandi for all purposes under this Agreement, whether in respect of court process, notices or other documents or communications of whatsoever nature (including the exercise of any option), the addresses contained in the relevant definitions in clause 1.
17.2. Any notice or communication required or permitted to be given in terms of this Agreement shall be valid and effective only if in writing but it shall be competent to give notice by fax.
17.3. Any Party may by notice to any other Party change the physical address chosen as its domicilium citandi et executandi vis-à-vis that Party to another physical address where postal delivery occurs in South Africa or its postal address or its fax number, provided that the change shall become effective vis-à-vis that addressee on the 7th business day from the receipt of the notice by the addressee.
17.4. Any notice to a Party –
17.4.1. sent by prepaid registered post (by airmail if appropriate) in a correctly addressed envelope to it at an address chosen as its domicilium citandi et executandi to which post is delivered shall be deemed to have been received on the 7th business day after posting (unless the contrary is proved); or
17.4.2. delivered by hand to a responsible person during ordinary business hours at the physical address chosen as its domicilium citandi et executandi shall be deemed to have been received on the day of delivery
17.5. Notwithstanding anything to the contrary herein contained a written notice or communication actually received by a Party shall be an adequate written notice or communication to it notwithstanding that it was not sent to or delivered at its chosen domicilium citandi et executandi.
