Drug Free Work Place Certification. As required by Executive Order No. 90-5 dated April 12, 1990, issued by the Governor of Indiana, the LPA hereby covenants and agrees to make a good faith effort to provide and maintain a drug-free workplace. The LPA will give written notice to the State within ten (10) days after receiving actual notice that the LPA, or an employee of the LPA in the State of Indiana, has been convicted of a criminal drug violation occurring in the workplace. False certification or violation of this certification may result in sanctions including, but not limited to, suspension of contract payments, termination of this Contract and/or debarment of contracting opportunities with the State for up to three (3) years. In addition to the provisions of the above paragraph, if the total amount set forth in this Contract is in excess of $25,000.00, the LPA certifies and agrees that it will provide a drug-free workplace by: A. Publishing and providing to all of its employees a statement notifying them that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the LPA's workplace, and specifying the actions that will be t aken against employees for violations of such prohibition;

Drug Free Work Place Certification. By executing this Agreement, CONTRACTOR certifies that it will provide a drug-free workplace in accordance with the requirements of the Drug-Free Workplace Act of 1990 (California Government Code Sections 8350, et seq.), by doing all of the following:

Drug Free Work Place Certification. If the actual or ETHICS CERTIFICATE: By submitting an offer and/or providing the requested goods or services, Contractor certifies that it has complied and will comply with, and has not induced, and will not, induce a person to violate Title 8, Chapter 13 of the South Carolina Code of Laws, as amended (the Ethics Act). The Authority may rescind any Agreement and recover all amounts expended as a result of any action taken in violation of this provision. GOVERNING LAW & FORUM: The Authority is a public body, corporate and politic of the State of South Carolina. Accordingly, the solicitation and/or any ensuing order or Agreement, as well as any dispute, claim, or controversy relating thereto, and all the rights and obligations of the parties shall, in all respects, be interpreted, construed, enforced and governed in accordance with the laws of the State of South Carolina without giving effect to any choice or conflict of law provision or rule (whether of the State of South Carolina or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of South Carolina. Any legal suit, action or proceeding arising out of or relating to the solicitation and/or any ensuing order or Agreement shall be instituted in the federal or state courts of the State of South Carolina and each party irrevocably submits to the exclusive jurisdiction of such courts in any such suit, action or proceeding. Venue for any action regarding the Agreement shall lie in Charleston County, South Carolina. Nothing contained herein or otherwise in the solicitation, order or Agreement shall be construed as waiving any immunity to suit or liability, including without limitation, sovereign immunity or immunity under the Eleventh Amendment of the United States Constitution, which may be available to the Authority.

Landlord will give written notice to the Tenant and the Department of Administration within ten (10) days after receiving actual notice that Landlord or an employee of the Landlord has been convicted of a criminal drug violation occurring in the Landlord's workplace. False certification or violation of the certification may result in sanctions including, but not limited to, suspension of lease payments, termination of this Lease and/or debarment of leasing opportunities with the State for up to three (3) years. In addition to the provisions of the above paragraphs, if the total lease amount set forth in this Lease is in excess of $25,000.00, Landlord hereby further agrees that this agreement is expressly subject to the terms, conditions and representations of the following certification: This certification is required by Executive Order No. 90-5, April 12, 1990, issued by the Governor of Indiana. Pursuant to its delegated authority, the Indiana Department of Administration is requiring the inclusion of this certification in all leases with and grants from the State of Indiana in excess of $25,000.00. No award of a lease shall be made, and no lease, purchase order, or agreement, the total amount of which exceeds $25,000.00, shall be valid unless and until this certification has been fully executed by the Landlord and made a part of this Lease or agreement as part of the lease documents. The Landlord certifies and agrees that it will provide a drug-free workplace by: A. Publishing and providing to all of its employees a statement notifying employees that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the Landlord's workplace and specifying the actions that will be taken against employees for violations of such prohibition; and

False certification or violation of this certification may result in sanctions including, but not limited to, suspension of payments under the Agreement, termination of the Agreement and/or debarment of contracting opportunities with the State for up to three (3) years. In addition to the provisions of the above paragraph, if the total amount set forth in the Agreement is in excess of $25,000.00, the Company agrees that it will provide a drug-free workplace by: A. Publishing and providing to all of its employees a statement notifying them that the unlawful manufacture, distribution, dispensing, possession or use of a controlled substance is prohibited in the Company’s workplace, and specifying the actions that will be taken against employees for violations of such prohibition;

  • Escrow Format Specification Deposit’s Format. Registry objects, such as domains, contacts, name servers, registrars, etc. will be compiled into a file constructed as described in draft-xxxxx-xxxxxxx-registry-data-escrow, see Part A, Section 9, reference 1 of this Specification and draft-xxxxx-xxxxxxx-dnrd-objects-mapping, see Part A, Section 9, reference 2 of this Specification (collectively, the “DNDE Specification”). The DNDE Specification describes some elements as optional; Registry Operator will include those elements in the Deposits if they are available. If not already an RFC, Registry Operator will use the most recent draft version of the DNDE Specification available at the Effective Date. Registry Operator may at its election use newer versions of the DNDE Specification after the Effective Date. Once the DNDE Specification is published as an RFC, Registry Operator will implement that version of the DNDE Specification, no later than one hundred eighty (180) calendar days after.   • Attachment  C_ CONTRACT AFFIRMATIONS For purposes of these Contract Affirmations, HHS includes both the Health and Human Services Commission (HHSC) and the Department of State Health Services (DSHS). System Agency refers to HHSC, DSHS, or both, that will be a party to this Contract.   • Exhibit D - Debarment Certification By signing and submitting this Contract, the Contractor is agreeing to abide by the debarment requirements as set out below.
