It is specifically agreed that the Employer assumes no obligation, financial or otherwise, arising out of provision of this Article, and the Union hereby agrees to remit that it will indemnify and hold the Employer harmless from any deduction claims, action or proceedings by any employee arising from deductions made by the Employer pursuant to this provision promptly Article. Once the funds are remitted to the local OAPSE representative together with Union, their disposition thereafter shall be the sole and exclusive obligation and responsibility of the Union.
Section 3.7. It is agreed that neither the employees, not the Union, shall have a claim against the Employer for errors in processing of deductions unless a claim of error is made to the Employer in writing within sixty (60) days after the date such an itemized statement showing error is claims to have occurred. If it is found an error was made, it will be corrected at the name next pay period that the Union dues deduction would normally be made by deducting the proper amount. Payroll collection of each employee dues shall be authorized for the exclusive bargaining agent only, and for no other organization attempting to represent the employees within the bargaining unit as herein determined.
Section 3.8. In the event a deduction is not made for any Union member during any particular month, the Employer, upon written verification from whose the Union, will make the appropriate deduction from the following pay period in which dues are normally deducted, if the deduction does not exceed the total of two (2) month's regular dues from the pay of any Union member. The Employer will not deduct more than one (1) month's regular dues for more than one (1) consecutive month.

Section 2. The initiation fees, a PEOPLE deduction as provided for dues or assessments so deducted shall be in a written authorization. Section 5. The OPBA hereby agrees to remit defend the City upon request and to hold the City harmless from any deduction made pursuant to and all liabilities or damages which may arise from the performance of its obligations under this provision promptly to the local OAPSE representative together with an itemized statement showing the name Article 3, “Dues Check-Off,” and under Article 4, “Service Fees” of each employee from whose pay such deductions have been made this Agreement, and the amount deducted during OPBA shall indemnify the period covered by City for any such liabilities or damages that may arise.
Section 6. The Employer’s obligation to check off OPBA dues will terminate when an employee separates employment, transfers to a job classification outside the remittancebargaining unit, or properly notifies the Employer and the OPBA in writing that they have revoked their dues check off authorization in accordance with the terms and conditions of the card. 2.4 The Board agrees to deduct from the wages of any employee who is a member of OAPSE, a PEOPLE deduction as provided for in a written authorization. Such authorization must be executed by the employee and may be revoked by the employee at any time by giving written notice to both the Board and OAPSE. The Treasurer agrees to remit any deduction made pursuant to this provision promptly to the local OAPSE representative together with an itemized statement showing the name of each employee from whose pay wages such deductions have been made and made, no later than the amount deducted 15th day of the following month, for which such deductions have been made. The employer's obligations to make such deductions shall terminate automatically upon termination of the employee who signed the authorization or upon his/her transfer to a job not covered by this Agreement, except that deductions shall be resumed if an employee, terminated by layoff, is rehired during the period covered life of the contract then in existence provided proper authorization is given. The Union agrees that it will indemnify and save the Employer harmless from any and all liability, claim, responsibility, damage or suit which may arise out of any action taken by the remittanceEmployer in accordance with the terms of this Article in an amount not to exceed the sum received by the Union on account of the deductions made from the earnings of such employee or employees.
Section 2.2 At least one bulletin board in the School Administration Building shall be reserved for the posting of official Union notices or announcements.
Section 2.3 The Board agrees that there will be no lockout of any employee or employees during the life of this Agreement. The Union agrees that there will be no strike or other form of work stoppage during the life of this Agreement.
Section 2.4 The Board will provide each employee with a copy of this Agreement within thirty (30) days after the date of the signing of this Agreement; new employees will be provided with a copy of this Agreement at the time of hire.
Section 2.5 A total of no more than three (3) officers or designees shall be chosen by the Union for contract negotiations. If contract negotiation sessions with the Board are held during the workday, two (2) members shall be afforded the time to attend without loss of pay.

DUES CHECK-OFF. 2.1 Section 1. The Board Employer agrees to deduct regular monthly Union dues from earned wages of those employees who individually request such deduction and sign an authorization card provided by the pay of Union and approved by the school employeesEmployer, authorizing the stated monthly dues for the Ohio Association of Public School Employees and the local union when so authorized, in writing, and to remit the dues to the State Association Treasurer monthly together with a list showing the names of the employees and the amount deducteddeduction be made. Deductions shall be in sixteen (16) consecutive payroll deductions beginning in the first pay period in October. DUES CHECK-OFF. 2.1 4.1 The Board agrees to Employer, for all employees who sign individual authorizations on the form of the applicable Trade Union, shall, in accordance with such authorization, deduct from the pay periodic pay, Union dues. 2.4 The Board agrees to deduct from the wages of any employee who is a member of OAPSE, a PEOPLE deduction as provided for in a written authorization. Such authorization must be executed claim by the employee or any Union benefiting from this check off position that such dues have been illegally assessed or levied. It is further agreed by and may be revoked between the parties to this agreement that the Union on whose behalf the authorization has been executed will indemnify and hold harmless the Company from any claim, loss, damage or expense or legal fees incurred by reason of any action or inaction taken by the Company in reliance upon any employee at check off authorization or revocation thereof.
4.4 All employees in the Bargaining Unit who have not provided to CMHA signed union dues check off authorizations within 60 days after the effective date of this Agreement (or, for probationary employees hired after the effective date of this agreement, with in 60 days of the initial date of employment) shall pay a fair share fee in accordance with this Article.
4.5 The Union shall certify in writing to CMHA the amount of the fair share, which shall represent only the non-members’ proportionate share of Union expenditures germane to collective bargaining and shall in no event exceed regular periodic dues charged to Union members. Such certification by the Union shall be deemed to include the Union’s certification that the computed fair share does not include any time by giving written notice amounts that are not reflective of expenses germane to both collective bargaining and that such fair share complies in all respects with applicable law including required procedures for employee challenges to fair share determinations.
4.6 CMHA will begin fair share fee deductions for all employees subject thereto for the Board first full pay period following receipt of the Union’s certification of the amount of the fair share, and OAPSE. will remit such to the Union in accordance with the procedures of this agreement for remitting dues.
4.7 The Treasurer Union agrees to remit indemnify CMHA, the members of the CMHA Board of Commissioners and all agents thereof, of and from any cost, loss or expense, including damages and attorney fees, incurred by reason of any fair share deduction made pursuant to this provision promptly to the local OAPSE representative together with an itemized statement showing the name of each employee from whose pay such deductions have been made and the amount deducted during the period covered by the remittancein reliance on a Union certification.
