Common use of Dues Deduction Clause in Contracts

Dues Deduction. A. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

Dues Deduction. A. The Board College shall deduct and transmit to the Association, commencing with the first pay check in September, all dues and uniform assessments upon receipt of Education agrees, upon the voluntary a written request from any certified employee submitted authorization form signed by a faculty member. Any certified employee submitting a written request for such dues deduction first pay check in September shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deductedcommence as provided in Section 5.02. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues or service fee by means of payroll deduction. C. The amount of the each such deduction from each paycheck for Union membership dues shall be equal to that which would have applied for each of the total dues divided by regular pay periods as described in the number of paychecks from which the teacher wishes dues to be deductedparagraph above. The amount Association shall inform the College in writing not later than August 1 of any change in the deduction dues or uniform assessments from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school previous year. The Board shall notify the Union monthly writing of any changes in the formula for dues and uniform assessments, the College shall use the previous year’s formula for said list. G. deductions. Each deduction authorization shall remain in effect until revocation in writing by the faculty member, termination of employment, or loss of the right of dues deduction specified in this Agreement. Each authorizing faculty member shall have the right to revoke the authorization upon written notice to both the College and the Association. The singular reference Association has paid to the "Union" herein College the one-time fee of seven hundred dollars ($700) to cover the expense of establishing the system for dues deductions described above, and it is understood that as long as dues deductions are made under the above described system, there will be no operational charges. The College shall be interpreted as referring have no responsibility or any liability for any monies once sent to the Westport Education Association. Further, the Connecticut Education Association, and the National Education Association. H. The Union Association shall hold the Board College harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against for unintentional errors in the Board as a result administration of the enforcement or administration of dues deduction system, although the College shall exercise reasonable care in said transactions. Dues deduction authorizations and revocations received by the Payroll Office seven (7) business days prior to the next pay date will take effect with that pay date. Those received after this article. The Board reserves deadline may still be implemented by the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraphnext pay date if processing time permits, and further agree that it is valid and enforceable by if not, will be processed the Boardfollowing pay date.

Dues Deduction. A. The Board shall deduct from the pay of Education agrees, upon each teacher current membership dues of the voluntary Union provided that at the time of such deduction there is in the possession of the Board a current written request from any certified employee submitted on a form approved authorization for dues deduction executed by the Board, teacher. Such authorization shall specify the dues to deduct be deducted from that employee's each teacher’s salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to current school year. Such authorization forms shall be agreed upon between the Board of Education and furnished by the Union to the Westport Education Association, Inc. The amount of the deduction from each paycheck for the service fee specified shall be equal to prorated and deducted from the total service fee divided by teacher’s paychecks commencing with the total number of paychecks between the first last paycheck in January September and terminating with the last paycheck in June, provided the amount to be deducted from each paycheck may remain uniform with respect to each individual teacher. The amount of Union membership Any teacher who files an authorization for dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year. D. Those teachers whose employment commences deduction after the start of the school year term shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with have such check a list of teachers for whom such deductions were made. F. No deduction implemented no later than the first paycheck issued in the period following thirty (30) calendar days after such authorization is received, provided the amount to be deducted from each remaining paycheck in October the school year is uniform. Any change in dues deduction for the school year shall be filed in writing with the Business Office within twenty (20) school days following ratification of each school the Agreement or any subsequent Successor Agreement. Should no Successor Agreement be sought or deemed necessary in any given year, such filing shall take place prior to September 1. Such authorization shall be revocable upon the giving of a notice in writing to the Superintendent or designee pursuant to the terms of the dues authorization, such revocation to be effective no later than thirty (30) calendar days following its receipt. A termination of employment for any reason shall constitute revocation of authorization for dues deduction (if not otherwise provided on the last day of employment). All dues deducted by the Board shall be transmitted to the Treasurer of Education shall provide the Union with a list or designee within thirty (30) calendar days of all teacher employees of their receipt. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teachers' salaries an amount to cover dues for the United Teaching Profession as the teachers individually and voluntarily authorize the Board to deduct, and to transmit the amount so authorized to the Treasurer of the Association. 6.2 Every teacher who so desires to authorize such deduction shall file with the school district Financial Services Department, through the office of the Association, a signed and dated "District Twelve Educators' Association Salary Deduction Authorization Form" authorizing the school district Financial Services Department to deduct from his/her monthly earnings and to remit to the Treasurer of the Association an amount equal to 1/12th of the Union dues required for membership in an organization or organizations specified. Teachers joining after the September payroll cut-off date shall have their dues pro-rated over the remaining months through August. Such forms shall include a waiver of all right and claim against the Board and the school district and the officers and agents thereof, for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the Office of the Association in writing. The Association will notify the school district Financial Services Department forthwith, on an appropriate form, that such teacher desires to discontinue or to change such authorization, said notice to be received by the first day of November. 6.3 The District Twelve Educators' Association agrees to save the Board harmless from any action growing out of these deductions and commenced by any teacher against the Board or the school district and assumes full responsibility for the disposition of the funds so deducted once they have been turned over to the Treasurer of the Association. 6.4 The District Twelve Educators' Association will notify the Board, in writing, of the current rate of membership dues. The Board will be notified of any change in the rate of membership dues or service fee by means thirty (30) days prior to the effective date of payroll deductionsuch change. C. Notification of this provision will be contained on any future authorization form signed by the teacher. 6.7 The Association shall pay not make any direct or indirect contribution out of membership dues to any political party or political organization. Teachers may voluntarily agree to an additional deduction as a prorated amount equal contribution to the percentage of the remaining school yearAssociation's political action committees. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. Dues Deduction. A. 14:1 The Board agrees to provide payroll deductions of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary membership dues for the Westport Colonial Transportation Association, the Delaware State Education Association, Inc., the Connecticut Education Association and/or and the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union promptly these moneys to the Westport Delaware State Education Association according to established procedures of the Delaware State Education Association, Inc. Any certified employee submitting a written request the Delaware State Treasurer, and the Laws of the State of Delaware. 14:2 All employees in the collective bargaining unit for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Educationmore than thirty (30) days who are not, who do not become, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 do not remain members of the same yearAssociation shall, during any such period of non-member ship, pay to the Association a fair share service fee as a condition of employment. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education 14:3 The District agrees to deduct from each teacher an amount equal to the Union membership dues or service fee from the earned wages of each employee covered by means this Agreement. Such deduction shall be made after the employee executes the appropriate written form. On or before the first of payroll deduction. C. The amount of each month, the deduction from each paycheck for Union Association shall deliver to the District additional executed authorization forms under which membership dues or service fee deductions shall be equal made from the payroll. Such deductions for dues or service fees are to the total dues divided be transmitted each month by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. No later than the first paycheck in October of each school yearDistrict, the Board of Education shall provide the Union with a list of all teacher employees those from whom such deductions have been made, to the Delaware State Education Association not later than the tenth (10th) of the Board of Education and the positions held by said teacher employeesfollowing month. The Board Association shall notify the Union monthly District thirty (30) days prior to any change in dues or fees. The District agrees to expedite the processing of any changes in said listdues or agency fees within a reasonable period of time. G. The singular reference to the "Union" herein 14:4 Service fees for this article shall be interpreted as referring to determined by the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. 14:5 The Board also agrees to provide payroll deduction for, but not limited to: State Life Insurance U.S. Savings Bonds Credit Union Individual Retirement Accounts 14:6 The Association shall indemnify and hold the Board District harmless against any and all claims, demands, liabilitiessuits, lawsuits, attorney's fees or and other costs which may forms of liability that shall arise out of or by reason of actions any action taken against or not taken by the Board as a result District for the purpose of the enforcement or administration complying with any of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Boardarticle.

H. 2. Regular dues for any or all of the above-stated organizations shall be deducted together, as one deduction, in ten (10) equal monthly installments from the second paycheck of each month of the school year, except in June when it will be the first pay. 3. Dues authorizations filed with the Superintendent on or before the Monday preceding the second payday of each year shall become effective with the first scheduled dues deduction of the coming school year. Dues authorizations filed after the Monday preceding the second payday shall be deducted from the second paycheck of the succeeding months in equal installments. 4. Dues authorizations, once filed with the Superintendent, shall continue in effect until a revocation form in writing and signed by the teacher is filed with the Superintendent and the Treasurer of the Association. 5. The Union Association shall, on or before the first day of each school year, give written notification to the Superintendent of the amount of its dues and those of the MEA and NEA which dues are to be deducted in the coming school year under such dues authorizations. The amounts of deductions for these dues, as per said written notification, shall not be subject to change during the entire school year. 6. For the purpose of this Article, the term "school year" shall include the period beginning with the first teacher working day of school in the fall through the last teacher working day of school in the spring. 7. Dues deduction shall be transmitted by the Superintendent to the Pine River Education Association, MEA/NEA, Treasurer within ten (10) days after such deductions are made. 8. All refunds claimed for dues of the Pine River Education Association, MEA/NEA, MEA or NEA under such dues authorizations shall lie solely with the Association. The Association agrees to reimburse any teacher for the amount of any dues deducted by the Board and paid to the Association, which deduction is by error in excess of the proper deduction and agrees to hold the Board harmless against from all claims of excessive dues deductions. 9. Any dispute between the Pine River Education Association, MEA/NEA and the Board which may arise as to whether or not an employee properly executed or revoked an authorization card pursuant to this Article shall be reviewed with the employee by a representative of the Board. Until the matter is disposed of, no further deductions for that employee shall be made. The Board assumes no liability for the authenticity, execution or revocation of the authorization form. 10. The Association shall protect and save harmless the Board from any and or all claims, demands, liabilities, lawsuits, attorney's fees or suits and other costs which may arise out forms of or liability by reason of actions action taken against or not taken by the Board as a result or its designated agent for the purpose of the enforcement or administration of complying with this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the BoardArticle.

For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each the teachers' salaries an amount to cover dues for the Federation, the Colorado Federation of Teachers, and the American Federation of Teachers, as the teachers individually and voluntarily authorize the Board to deduct, and to transmit the amount so authorized to the treasurer of the Federation. Automatic deduction of increase or decrease in dues voted on by the Vocational Teachers' Federation, Local 203, shall he made when the treasurer of the Federation advises the change in dues in writing to the secretary-treasurer of the school district by September 1, or the first of any month. B. Each teacher who desires to authorize such deduction, shall file with the school district secretary through the treasurer of the Federation a signed and dated "Salary Deduction Authorization Form," authorizing the school district treasurer to deduct from monthly earnings and to remit to the treasurer of the Federation an amount equal to one twelfth (1/12) of the Union dues required for membership dues in the organization or service fee by means organizations so specified. Such forms shall include a waiver of payroll deductionall rights and claims against the Board and school district and the officers and agents thereof for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the school district secretary in writing, on an appropriate form, that the teacher desires to discontinue or to change such authorization. C. Deductions shall be made uniformly on each monthly period. The amount school district secretary shall not be required to honor for any month's deduction, any authorizations that are delivered to the secretary later than the tenth (10TH) day of the deduction from each paycheck for Union membership dues shall be equal month prior to the total dues divided by distribution of the number of paychecks payroll from which the teacher wishes dues deductions are to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. Those teachers whose employment commences after If a teacher who is absent on account of sickness, leave of absence, or for any other reason has no earnings due for the start month, no deductions will be made for that teacher for that month. The Federation will arrange collection of dues for that month directly with the school year shall pay a prorated amount equal to the percentage of the remaining school yearteacher. E. The Board of Education Federation agrees to forward save the Board and school district harmless from any action growing out of these deductions and commenced by any teacher against the Board or the school district, and assumes full responsibility for the disposition of the funds so deducted once they have been turned over to the Union biweekly a check for treasurer of the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were madeFederation. F. No later than A service charge of ten cents ($.10) per individual teacher authorization per month shall be retained by the first paycheck in October school district to help defray costs of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said listmaking such deduction. G. The singular reference Upon tile issuance of any employment contract to any member of the "Union" herein shall be interpreted as referring to the Westport Education AssociationFederation bargaining unit, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as district will provide tl1e employee with a result copy of the enforcement or administration of Agreement and information concerning responsibilities identified under this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

Dues Deduction. A. 12.1 The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, agrees to deduct from that employee's salary the salaries of its employees dues for the Westport Xxx-Xxxx Education Association/NEA-NH, the New Hampshire Education Association, Inc., the Connecticut Education Association and/or the National Education Association Association, or any one of such Associations, as said teacher individually and voluntarily authorizes the School Board to deduct and to transmit the monies promptly to such monies so deducted at a time to Association or Associations. Teacher authorizations will be agreed upon between in writing in the form set forth below: "Dues Authorization Card" NAME: ADDRESS: I hereby request and authorize the Lincoln-Woodstock Cooperative School Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher my earnings and transmit to the Treasurer of the Xxx-Xxxx Education Association/NEA-NH for transmittal to the Association checked below an amount equal sufficient to provide for regular payment of the Union membership dues or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be as certified by the Union to such Associations. I understand the Board of Education prior will continue such deductions for any school year only if I notify the Board in writing to September 15th of do so not later than October 1st each school year. The amount I hereby waive all rights and claim for said monies so deducted and transmitted in accordance with this authorization and relieve the Board, all of its officers, and employees from any liability therefore. Teacher Organizations: Xxx-Xxxx Education Association/NEA-NH New Hampshire Education Association National Education Association Dated: Teacher’s Signature: 12.2 Each of the service fee shall be certified by the Union Associations named in Section A above will certify to the Board, in writing, the current rate of its membership dues. 12.3 Any Association which changes the rate of its membership dues will give the Board written notice by October 1st of Education prior the year of such change. 12.4 Any teacher desiring to December 15th have the Board continue deductions she/he has previously authorized must notify the Board and the Association concerned, in writing, not later than October 1st of each school year. D. Those teachers whose employment commences after 12.5 For employees who have chosen the start option of receiving their paychecks in the form of 26 equal checks, dues deduction shall be calculated so that the full amount of dues to be deducted shall be completed by the end of the school year shall pay a prorated amount equal to the percentage of the remaining school yearin June. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education School District agrees to deduct from each teacher an amount equal the salaries of its teachers political contributions and dues for CCEA, NSEA, and NEA, by monthly deductions in one sum as the teachers individually authorize the School District to deduct, and to transmit the monies promptly to the Union Xxxxxxxxx County Education Association. Teacher authorizations will be in writing on forms provided by the Association. 9-2 The Association will certify to the School District in writing the current rate of membership dues. The School District will be notified of any changes in the rate of membership dues or service fee by means thirty (30) days prior to the effective date of payroll deductionsuch change. C. The amount of 9-3 Deductions referred to in Section 9-1 above will be made in equal installments once each month during the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount School District will not be required to honor for any month's deduction any authorizations that are delivered to it later than the fifteenth (15th) of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school yearmonth. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. 9-4 No later than the first paycheck in October fifteenth (15th) of each school year, year the Board of Education shall Association will provide the Union School District with a current list of all teacher employees of the Board of Education and the positions held by said teacher employeesmembership. The Board shall Association will notify the Union School District monthly of any changes in said list. G. The singular reference 9-5 Any teacher desiring to have the "Union" herein shall be interpreted as referring to School District discontinue the Westport Education Associationdues deductions he or she has previously authorized must notify the School District and the Association in writing between July 1 and July 15 for the school year's dues. If notification is received after July 15th, the Connecticut Education Associationdues will be deducted for that year in accordance with the dues authorization card which states, "I understand that if I terminate my membership in the United Teaching Profession after July 15 of any year, the balance of my dues for that year will be deducted from my payroll check(s)." 9-6 Upon termination of any teacher, the remaining amounts of dues for the Association in Section 9-1 above will be deducted from the final check in accordance with the dues authorization card. If the amount due the Association is greater than the amount the teacher has earned, the Superintendent and the President of the Association will determine the amount to be paid on a meet and confer basis. 9-7 The School District will honor the continuing membership concept as authorized by the dues authorization cards which state: "I hereby authorize continued deduction of my United Teaching Profession dues from my payroll check as established by local, state, and the National Education Association. H. The Union shall hold the Board harmless against any national education associations and all claimsaccording to policy, demandsrule, liabilities, lawsuits, attorney's fees regulation or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this articlenegotiated contract within my school district. The Board reserves I reserve the right to revoke this authorization by written notice to my school district and local association before July 15th of any school year." The Association shall provide the School District with an updated listing of memberships on July 15 so that proper deductions might be represented by counsel of its choice and made. 9-8 The Association agrees to hold the Board shall be reimbursed District harmless for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable any actions taken by the BoardDistrict in reliance upon information furnished by the Association with respect to dues check off authorizations.

Dues Deduction. A. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher the salaries of its employees dues for the Manchester Education Association/NEA-NH, as said teachers individually and voluntarily authorize the Board to deduct and to transmit the monies promptly to the Association. Teacher authorizations will be in writing in the form set below. "DUES AUTHORIZATION CARD" MANCHESTER EDUCATION ASSOCIATION/NEA-NH NAME: ADDRESS: I hereby request and authorize the Manchester Board of School Committee to deduct from my earnings in accordance with the procedure set forth in Article XVIII of the Master Agreement between the Board and the Association and transmit to the Treasurer of the Manchester Education Association/NEA-NH an amount equal sufficient to provide for regular payment of the membership dues, as certified by the Association for the present school year and for succeeding school years. I understand that if I wish to discontinue such deductions for any school year, I must notify the Board and the Association in writing to do so no later than sixty (60) days prior to the Union commencement of the school year. I hereby waive all right and claim for said monies so deducted and transmitted in accordance with this authorization, and relieve the Board and all its officers from any liability therefore. Teacher's Signature DATED: _ B. The Association will certify to the Board, in writing, the current rate of its membership dues and will give the Board thirty (30) days written notice prior to September 1 of the year of any such change. C. Dues deduction procedure will be as follows: C. 1. Dues will be deducted every pay period for fifteen (15) periods from the 5th payday of the year to the 19th payday of the year, inclusive. C. 2. The Board will not be required to honor any authorizations that are delivered to it later than October 15. C. 3. Excepted from the October 15 cut-off date will be new teachers hired after September 30. If such new teachers submit a Dues Authorization Card within thirty (30) days of their appointment, they shall have all such dues deducted in equal amounts for the remainder of fifteen (15) pay period deduction schedule. D. No later than October 15 of each year, the Association will provide the Board with copies of dues authorization cards and a list of those teachers who have voluntarily authorized the Board to deduct dues for the Association. Any teacher desiring to have the Board discontinue deductions that the teacher has previously authorized must notify the Board and the Association in writing no later than sixty (60) days prior to the commencement of the school year. E. If paragraphs F-H below are deemed illegal, any employee who is in the bargaining unit and is not a member of the Association but wishes to be represented by the Association in grievances shall assume full financial responsibilities as to the actual costs of processing the grievances. Collection of such fees shall be the sole responsibility of the Association. Should there be a dispute between an employee and the Association and/or the Board, relating to such grievances or costs, the Association agrees to defend, indemnify and hold the Board harmless in any such dispute. F. Although it is agreed that union membership is not a mandatory condition of employment, employees covered by this Agreement shall be required, for as long as it is permitted by law, to pay an agency service fee in an amount not to exceed the union dues for the purpose of administering the provisions of this Agreement. Employees have the right to object to payment of an agency fee and the union shall justify what portion of the agency fee may constitutionally be collected from an objecting employee. The Association shall notify the District in writing the amount of the fee annually. The unit member paying the fee shall be able to use the payroll deduction to pay the fee in the same manner that Association members have dues deducted. G. The Association will certify to the District, in writing, the current rate of the service fee. Any changes to the rate of its union membership dues or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall must be equal provided to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck District in January and the last paycheck writing thirty (30) days in June. The amount of Union membership dues shall be certified by the Union to the Board of Education advance, prior to September 15th of each school year1. The amount of Association is permitted to use District interoffice mail to notify the service employee that the fee shall must be certified by the Union to the Board of Education prior to December 15th of each school year. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school yearpaid within 30 days, however, the Board District is not responsible for ensuring the payment of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Associationsuch fee. H. The Union union shall indemnify, defend, and hold harmless the Board harmless District against any and all claims, demands, liabilitiessuits, lawsuits, attorney's fees legal costs or other costs which may arise forms of liability (monetary or otherwise) arising out of or by reason of actions any action taken against or not taken by the Board as a result District for the purpose of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest complying with the provisions of this paragraph, and further agree that it is valid and enforceable by the BoardArticle.

Dues Deduction. A. The Board shall deduct from the pay of Education agreeseach teacher current membership dues of the Association and its affiliates, upon provided that at the voluntary time of such deduction there is in the possession of the Board a current written request from any certified employee submitted on a form approved authorization for dues deduction, voluntarily executed by the Board, teacher. Such authorization shall specify the amount of dues to deduct be deducted from that employeeeach teacher's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction current school year. Such authorization forms shall be subject to dues deductions during the remainder of his or her employment furnished by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same yearAssociation. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues employed on or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year. D. Those teachers whose employment commences after before the start of the school year shall pay a prorated term may authorize dues deduction by presenting an authorization form (card) with the annual amount equal of deduction specified to the percentage employer on or before the first Friday of October. The amount specified will be prorated and deducted from the monthly paychecks, starting in October and ending in May. A termination of employment for any reason shall constitute revocation of authorization for dues deduction (if not otherwise provided) the last day of employment. Teachers employed after the school term shall have ten (10) teacher employment days in which to submit their dues reduction authorization form. Dues deduction shall commence with the second paycheck, after submission of authorization and shall be prorated through May. X. Xxxx authorization shall be revocable between September 15 and October 20, of the remaining school yearterm in which dues are to be deducted; otherwise, the authorization shall not be revocable for the remainder of the school term. On receipt of dues revocation, the Board will notify the Association in writing of such dues revocation. The revocation shall be implemented in the payroll period following the payroll period in which the notice is received, subject to the provisions of this section. The authorization form described in paragraph A shall fully set forth the obligations of this paragraph. D. All dues deducted by the Board shall be remitted to the treasurer of the Association within ten (10) days after such deductions are made. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board Association shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, indemnify and hold harmless the Board and all of Education shall provide the Union with a list of all teacher its agents and employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against from any and all claims, demands, liabilitiessuits, lawsuitsand costs incurred in connection with any such claim, attorney's fees demand, or other costs which may arise out of suit resulting from any reasonable action taken or omitted by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and agents or employees for the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest purpose of complying with the provisions of this paragraph, and further agree that it is valid and enforceable by the Boardarticle.

Dues Deduction. A. 1. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, agrees to deduct from that employee's salary the salaries of the teachers, dues for the Westport Education AssociationXxxxxx Teachers' Alliance, Inc., as said teachers individually and voluntarily authorize the Connecticut Education Association and/or the National Education Association Board to deduct and to transmit such monies to the Alliance. Teacher authorization shall be in writing in the form set forth below: Social Security Number District Name Union To The Board of Education: I hereby authorize you, according to arrangements agreed upon with the above association, to deduct from my salary and transmit to said association, dues as certified by said association. I hereby waive all right and claim to said monies so deducted at a time to be agreed upon between and transmitted in accordance with this authorization and relieve the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request all its officers from any liability therefor. I revoke any and all instruments heretofore made by me for such dues deduction purposes. This authorization shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, remain in full force and effect for all purposes while I am employed in this school system or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored revoked by the Board me in writing between June September 1 and June 30 September 15 of any year of this Agreement to be effective on June 30 of the same given year.. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union Alliance will certify to the Board in writing the current rate of Education membership dues named in Section A above. The Alliance will give the Board thirty (30) days’ written notice prior to September 15th the effective date of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school yearany such change. D. Those teachers whose employment commences 3. Deductions shall commence with the first pay period after the start of the school year as agreed to by the parties and shall continue for twenty pay a prorated amount periods. Dues shall be deducted in twenty equal to the percentage payments. For those teachers who submit deduction authorization forms after dues deductions have commenced, dues shall be taken out of each of the remaining school yeartwenty checks in the same amount as is deducted from teachers who have dues deducted over the full twenty periods. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period4. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October September 30th of each school year, year the Board of Education shall will provide the Union Alliance with a list of all teacher those employees of who have voluntarily authorized the Board of Education and the positions held by said teacher employeesto deduct dues pursuant to subsection P-1 above. 5. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree agrees that they it will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Boardaccord dues deduction or similar check- off rights to any other teacher organization.

Dues Deduction. A. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his On or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October before August 25 of each school year, the Association shall give written notice to the Board of the dollar amount of dues and assessments of the Association, which dues and assessments are to be deducted in the coming school year under all payroll deductions. The total for these deductions shall not be subject to change during the school year. B. The deductions authorized above shall be made in twelve (12) equal amounts from each paycheck beginning the pay period in September through the pay period in August of each year. Employees who commence employment after September or terminate employment before June shall have their deductions prorated for each month the employee is employed. The Board agrees to remit promptly and directly to the Washington Education shall provide the Union with Association all moneys so deducted, accompanied by a list of all teacher employees from whom the deductions have been made. A duplicate list shall be promptly provided to the Association as receipt of said transaction. On or before the Board of Education and monthly pay period, the positions held by said teacher employees. The Board shall notify the Union monthly Association of any changes in said listlist due to employees entering or leaving the employ of the District via approved meeting agenda and minutes which are sent via e-mail in accordance with Article II Section 2 I. C. The Association agrees to reimburse any employee for dues and/or assessments that were deducted in excess of the total amount due to the Association at that time, provided the Association or its affiliate actually received the excessive amount. G. The singular reference D. Within ten (10) days of their commencement of employment, employees may sign and deliver to the "Union" herein Board a Dues - Automatic Payroll Deduction form (see Appendix D), which shall be interpreted as referring to authorize deduction for membership dues and assessments of the Westport Education Association, the Connecticut Education Association, and Association (including the National Education Association and the Washington Education Association). Such authorization shall continue in effect from year to year unless a request of revocation is submitted to the Board and the Association, signed by the employee and received between August 1 and August 31, preceding the designated school year for which revocation is to take effect. Each month during the school year the Association agrees to provide the Board with names of those employees who have joined the Association and paid its dues and assessments by means other than through payroll deduction. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result E. No member of the enforcement or administration of this articlebargaining unit will be required to join the Association; however, those employees who are not Association members will be required to pay a representation fee to the Association. The Board reserves the right to be represented by counsel of its choice and the Board representation fee shall be reimbursed an amount equal to dues for the Association membership less any political action contribution. This fee shall be regarded as fair compensation and reimbursement to the Association for fulfilling its reasonable legal fees. The Union and obligation to represent each member of the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Boardbargaining unit.

Dues Deduction. A. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June August 1 and June 30 August 31 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year. D. C. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. D. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. E. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. F. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. G. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's ’s fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

Dues Deduction. A. 1. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, agrees to deduct from that employee's salary the salaries of its employees dues for the Westport Education AssociationArlington Teachers’ Association and affiliates, Inc.as said teachers individually and voluntarily authorize the Board to deduct, the Connecticut Education Association and/or the National Education Association and to transmit the monies monthly beginning in October to such Association or associations. As of July 1, 2008 monies so deducted at a time collected under this provision shall be electronically transmitted by the District to the Association’s account. Teacher authorizations for all school years will be agreed upon between in writing in the form set forth below: LAST NAME FIRST NAME INITIAL BUILDING ADDRESS PAYROLL DEDUCTION AUTHORITY: I hereby authorize the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees Arlington School District to deduct from each teacher an amount equal to the Union my salary membership dues or service fee by means pursuant to Chapter 392, Laws of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal 1967, and to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck make any adjustment necessary for the service fee shall be equal to purpose of payment of dues in the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to Arlington Teachers’ Association and any other affiliated organizations for this school year and for succeeding school years. I understand that the Board of Education prior will discontinue such deductions for any school year only if I notify the Board in writing to do so not later than September 15th 15 of each that school year. The amount I hereby waive all rights and claims for said monies so deducted and transmitted in accordance with this authorization, and relieve the Board and all of its officers from any liability therefore. I revoke all instruments, if any, heretofore made by me for any of the service fee purposes herein set forth. This instrument shall be certified remain in full force and continuous force and effect while I am employed in the Arlington School District or until revoked by written notice by me. The membership dues deductions options are: a. Six (6) bi-weekly payments beginning with the Union first check in October. b. Ten (10) bi-weekly payments beginning with the first check in October. c. Fifteen (15) bi-weekly payments beginning with the first check in October. Option selected: Date: Signature: 2. The Arlington Teachers’ Association and those of all affiliates shall certify to the Board in writing the current rate of Education its membership dues. The Association shall give the Board thirty (30) days written notice prior to December 15th the effective date of each school yearany change. D. Those teachers whose employment commences 3. Deductions referred to in Section 1 above shall be made in (a) six (6) bi-weekly consecutive installments or (b) ten (10) bi-weekly consecutive installments or (c) fifteen (15) bi-weekly consecutive installments commencing with the first check in October. All dues shall have been deducted by the end of the fifteenth pay period thereafter. The Board shall not be required to honor for any month’s deduction any authorizations that are delivered to it later than one (1) week prior to the distribution of the payroll from which the deductions are to be made. Teachers joining the District after the start of the school year shall pay have their dues deducted on a prorated amount equal to the percentage of the remaining school yearpro rated basis. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period4. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October September 30 of each school year, the Board of Education shall provide the Union Association with a list of all teacher those employees who have voluntarily authorized the Board to deduct dues for any of the Board of Education and the positions held by said teacher employeesassociations named in Section 1 above. The Board shall notify the Union Association monthly of any changes in said list. Any teacher desiring to have the Board discontinue deductions he/she has previously authorized must notify the Board, in writing, by September 15 of each year for that school year’s dues. G. 5. The singular reference District shall deduct from the salary of any unit member who is not a member of the Association an agency fee of corresponding amount to dues deductions as set forth in paragraph “B” above. These deductions shall be paid to the "Union" herein ATA in the same manner and at the same time as dues deductions are paid pursuant to paragraph “B” above. The Association affirms that it has adopted such procedures for refund of agency fee deduction as required in Section 3, Chapter 677 of the Laws of 1977 of the State of New York and any amendments thereto. This provision for agency fee deductions shall be interpreted continue in effect so long as referring the Association maintains such procedure. The Association assumes full responsibility for the disposition of such funds so deducted once they have been forwarded to it by the Westport Education Association, District. 6. The Board agrees that it shall not accord dues deduction or similar check-off right to any other organizations representing or purporting to represent employees in the Connecticut Education Association, and negotiating unit represented by the National Education Association. H. The Union 7. All payroll deductions for tax sheltered annuities and credit unions shall hold be remitted forthwith by the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which District to the designated party. 8. Those teachers who wish to avail themselves of NYSUT benefits through payroll deduction may arise out of or by reason of actions taken against notify the Board as a result of the enforcement or administration of this articleDistrict in writing. The Board reserves shall not be required to honor, for any month’s deduction, any authorizations that are delivered to it later than one (1) week prior to the right distribution of the payroll from which the deductions are to be represented by counsel of its choice and made. Any teacher desiring to have the Board discontinue deductions that previously have been authorized, must notify the Board in writing. 9. The District shall deduct from the salary of any unit member an authorized amount for Vote Cope. 10. Upon a unit member’s request, his/her payroll check shall be reimbursed mailed directly to the bank of the unit member’s choice for its reasonable legal feesdeposit. The Union and District’s sole responsibility shall be the Connecticut Education Association agree that they will not contest mailing of the provisions check to the unit member’s designated bank. 11. Effective January 1, 2004, upon a unit member’s request, his/her payroll check shall be electronically transferred to a bank(s) of this paragraph, and further agree that it is valid and enforceable by the Boardunit member’s choice for deposit.

Dues Deduction. A. 1. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to shall deduct from that employee's salary the salaries of its employees, dues for the Westport Education Association, Inc., OTA and such groups as shall be designated by the Connecticut Education Association and/or OTA and said teachers individually and voluntarily authorize the National Education Association Board to deduct; and to transmit the monies to these designated groups. Teacher authorization shall be in writing in the form set by the OTA. 2. The OTA shall certify to the Board or designee, in writing, the current rate of its membership dues. If the OTA shall change the rate of its membership dues, it shall give the Board thirty (30) days written notice prior to the effective date of such monies change. 3. The OTA shall provide the Board with a list of those employees who have to deduct dues for the OTA along with annual dues amount to be deducted. 4. Deduction referred to in Section I above shall be made in the following manner: the total annual membership dues for those designated professional Associations, certificated as mentioned above shall be deducted in eighteen (18) equal installments beginning with the first paycheck in October and continuing for 17 consecutive paychecks thereafter. 5. Any teacher whose dues deduction card is not received by the Business Office fifteen (15) days prior to the first paycheck in October will be accorded the same deductions as the other teachers. This teacher will, however, be responsible for any dues required after the last installment in June and the first one in October. 6. The Board shall, following each pay period from which dues deductions are made, transmit the amount so deducted at to the Association. The first transmittal shall be accompanied by a time to be agreed upon between listing of the Board of Education members' names and school ID Numbers for whom deductions have been made, and the Union amount deducted for each. Additions or deletions to the Westport Education Associationpayroll deduction list occurring between deducting periods should be noted with the remittance; including the person's name, Inc. Any certified employee submitting school ID Number and effective date of the change. 7. Once a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment card is received by the Board of EducationBusiness Office, or it remains in effect until the Board receives a (a) withdrawn by written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored notice received by the Board between June 1 July 1st and June 30 September 15th of any year of this Agreement to be effective on June 30 of given year; or (b) by the same yearemployee's leaving the district. In such situations, the employee must assume responsibility for any required unpaid dues. B. For teachers 8. Each professional employee who chooses not subject to join the Association and its state and national affiliates will make a contribution to the Association equal to the dues described in Section 2 above. The annual contribution can be made by the employee directly to the Association prior to October 1st each year. If the employee chooses to elect payroll deduction as an alternative method of payment, the Board shall deduct from the employee's salary in eighteen (18) equal installments commencing with the first pay period in October and in accordance with paragraph A aboveSection 8 of this Article. Where a new professional employee is hired after October 1st, deductions shall be appropriately prorated so as to complete deductions of the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues or service annual agency fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th end of each school year. The amount of On the service fee first school day in October, the Association shall be certified by the Union to provide the Board of Education prior with a list of those employees who have chosen not to December 15th of each school yearjoin the Association or make a contribution to the Association. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. 9. The Board of Education agrees not to forward accord dues deduction or similar check off to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were madeany other teacher's organization. F. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

Dues Deduction. A. 21:01 The Board agrees to deduct from the salaries of Education agreesthe members of the professional teaching staff dues for the Utica Teachers Association, the New York State United Teachers, the American Federation of Teachers or anyone of or any combination of those associations as said teachers individually and voluntarily authorize the Board to deduct and to transmit the monies promptly to such association or associations. Membership in the Utica Teachers Association is prerequisite to dues deduction for any of the three (3) associations. Teacher’s authorization will be written in the form set below: Social Security Number Last Name: F. M District Name: Organization: To the Board of Education: I hereby authorize you, according to arrangements agreed-upon with the voluntary written request from any certified employee submitted on a form approved by the Boardabove organization, to deduct from that employee's my salary and transmit to said organization, dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association as certified by said organization. I hereby waive all rights and claims to transmit such monies said moneys so deducted at a time to be agreed upon between and transmitted in accordance with this authorization and relieve the Board of Education and all its officers from any liability therefore. I revoke any and all instruments hereto for made by me for such purposes. This authority shall remain in full force and effect for all purposes while I am employed in this school system, or until revoked by me in writing between September 1st and September 15th of any given year. Member signature: Date: 21:02 Each of the Union Associations listed in paragraph 21:01 above, will certify to the Westport Education AssociationBoard, Inc. in writing, the current rate of its membership dues. Any Association which changes the rate of its membership dues will give the Utica Teachers Association notice prior to the effective date of such change, and the Utica Teachers Association will give to the Board thirty (30) calendar days prior notice to the effective date of such change. 21:03 Deductions referred to above will be made in the following manner: The total annual membership dues for those designated professional associations, certified employee submitting as mentioned above, will be deducted in twenty (20) equal installments beginning with the second pay period in September. No later than two (2) weeks prior to the second scheduled paycheck in September the Association will provide the Board with a written request list and the original signed dues authorization cards, if such cards are not already in the possession of the Board, of those employees who have voluntarily authorized the Board to deduct dues for the Associations named in Paragraph 21:01 above, and forward at the same time to the respective Associations a list of the members and their addresses who have elected payroll deduction for such dues Association. 21:04 Authorizations which are submitted subsequent to the second payroll deduction shall in September will be subject to dues deductions during honored on the remainder next regularly scheduled payday, provided the date of his or her employment receipt by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement is two (2) weeks prior to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deductedsuch date. The amount of the deduction authorized will be deducted in twenty (20) equal installments. Teachers initially employed on a full-time basis during the Spring Term will have their dues deducted in a similar twenty (20) pay period. 21:05 The Board will, following each pay period from which a dues deduction is made, transmit the amount so deducted to each paycheck organization for which deductions have been made. The first and final transmittal will be accompanied by a listing of the service fee shall be equal members from whom deductions have been made and the amount deducted for each. If deductions have been made for only a portion of the deduction period, the listing should show the date of commencement of such deductions and the anticipated date of termination of dues deduction. 21:06 A teacher may withdraw authorization for dues deduction by written notice submitted to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school any given year. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The Board of Education agrees, upon 3-1 Upon appropriate written authorization from the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education District shall make monthly Association and/or dues deductions from the National Education Association salary of the employee and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union make appropriate remittance to the Westport Education Association. In the event the District fails to withhold dues owed by employee, Inc. Any certified employee submitting a written request for such dues deduction except as stated in 0-0-0, Xxxxxxxx shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request responsible for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same yearsaid dues. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 3-2 No later than October 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, the Board of Education shall Association will provide the Union District with a list of all teacher those employees of who have voluntarily authorized the Board of Education District to deduct Association dues and the positions held by said teacher employeesamount to be withheld for each employee. The Board shall District will provide the Association with a list within the month of March and no later than October 15 each year, of all classified employees whose positions are included on the MCCSEA Salary Schedule. This list will include job classification (and) or title, number of hours worked per day and work site. The March report will include a seniority list by district. The Association will notify the Union District monthly in writing of any changes in said list, changes in the amount to be withheld must be submitted by the Association to the District in writing at least 30 calendar days prior to the date the change is to be effective. Any employee desiring to have the District discontinue deductions he/she has previously authorized, must notify the Local Association in writing by certified mail during July for that school year's dues and the Association must submit the changes to the district office at least 30 days prior to the date the change is to be effective. G. 3-3 Upon termination of an employee the current month's dues will be deducted from the final check. 3-4 The singular reference District agrees not to honor any check-off authorization or dues deduction authorization executed by any employee in the "Union" herein bargaining unit in favor of any other labor organization representing employees for negotiations. 3-5 In the case of an employee who is in non-pay status during part of the pay period, and/or whose wages are not sufficient to cover the full withholding, no Association dues deductions shall be interpreted as referring made. In this connection, all other required deductions have priority over Association dues. 3-6 The Association agrees to the Westport Education Associationindemnify, the Connecticut Education Associationdefend, and the National Education Association. H. The Union shall hold the Board District harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees claims or other costs which suits that may arise out of or by reason of actions action taken against by the Board as a result District in reliance upon any authorization cards submitted by the Association to the District. 3-7 The Association agrees to refund the District any excess amounts paid to it in error on account of the enforcement or administration payroll deduction provision upon presentation of this article. The Board reserves the right to be represented by counsel proper evidence of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Boarderror mistake.

Dues Deduction. A. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher the salaries of its employees dues for the Manchester Education Association/NEA-NH, as said teachers individually and voluntarily authorize the Board to deduct and to transmit the monies promptly to the Association. Teacher authorizations will be in writing in the form set below. C. 1. Dues deduction procedure will be as follows: C. 2. Dues will be deducted every pay period for fifteen (15) periods from the 5th payday of the year to the 19th payday of the year, inclusive. C. 3. The Board will not be required to honor any authorizations that are delivered to it later than October 15. C. 4. Excepted from the October 15 cut-off date will be new teachers hired after September 30. If such new teachers submit a Dues Authorization Card within thirty (30) days of their appointment, they shall have all such dues deducted in equal amounts for the remainder of fifteen (15) pay period deduction schedule. D. If paragraphs F-H below are deemed illegal, any employee who is in the bargaining unit and is not a member of the Association but wishes to be represented by the Association in grievances shall assume full financial responsibilities as to the actual costs of processing the grievances. Collection of such fees shall be the sole responsibility of the Association. Should there be a dispute between an employee and the Association and/or the Board, relating to such grievances or costs, the Association agrees to defend, indemnify and hold the Board harmless in any such dispute. E. Although it is agreed that union membership is not a mandatory condition of employment, employees covered by this Agreement shall be required, for as long as it is permitted by law, to pay an agency service fee in an amount not to exceed the union dues for the purpose of administering the provisions of this Agreement. Employees have the right to object to payment of an agency fee and the union shall justify what portion of the agency fee may constitutionally be collected from an objecting employee. The Association shall notify the District in writing the amount of the fee annually. The unit member paying the fee shall be able to use the payroll deduction to pay the fee in the same manner that Association members have dues deducted. F. The Association will certify to the District, in writing, the current rate of the service fee. Any changes to the rate of its union membership dues or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall must be equal provided to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck District in January and the last paycheck writing thirty (30) days in June. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school yearpaid within 30 days, however, the Board District is not responsible for ensuring the payment of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said listsuch fee. G. The singular reference to the "Union" herein union shall be interpreted as referring to the Westport Education Associationindemnify, the Connecticut Education Associationdefend, and hold harmless the National Education Association. H. The Union shall hold the Board harmless District against any and all claims, demands, liabilitiessuits, lawsuits, attorney's fees legal costs or other costs which may arise forms of liability (monetary or otherwise) arising out of or by reason of actions any action taken against or not taken by the Board as a result District for the purpose of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest complying with the provisions of this paragraph, and further agree that it is valid and enforceable by the BoardArticle.

Dues Deduction. A. The Board State and National Association dues of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved administrators shall be paid by the Board, District. Membership is limited to deduct from that employee's salary dues two (2) approved organizations; one state and one national for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deductedeach administrator. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education The District agrees to deduct from each teacher the salaries of its administrators dues for the Concord Administrators' Association and any one of such Associations, as said administrators individually and voluntarily authorize the District to deduct and to transmit the monies promptly to such Association(s). For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education School District agrees to deduct from each teacher an amount equal the salaries of its teachers political contributions and dues for CCEA, NSEA, and NEA, by monthly deductions in one sum as the teachers individually authorize the School District to deduct, and to transmit the monies promptly to the Union Churchill County Education Association. Teacher authorizations will be in writing on forms provided by the Association. 9-2 The Association will certify to the School District in writing the current rate of membership dues. The School District will be notified of any changes in the rate of membership dues or service fee by means thirty (30) days prior to the effective date of payroll deductionsuch change. C. The amount of 9-3 Deductions referred to in Section 9-1 above will be made in equal installments once each month during the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount School District will not be required to honor for any month's deduction any authorizations that are delivered to it later than the fifteenth (15th) of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school yearmonth. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. 9-4 No later than the first paycheck in October fifteenth (15th) of each school year, year the Board of Education shall Association will provide the Union School District with a current list of all teacher employees of the Board of Education and the positions held by said teacher employeesmembership. The Board shall Association will notify the Union School District monthly of any changes in said list. G. The singular reference 9-5 Any teacher desiring to have the "Union" herein shall be interpreted as referring to School District discontinue the Westport Education Associationdues deductions he or she has previously authorized must notify the School District and the Association in writing between July 1 and July 15 for the school year's dues. If notification is received after July 15th, the Connecticut Education Associationdues will be deducted for that year in accordance with the dues authorization card which states, "I understand that if I terminate my membership in the United Teaching Profession after July 15 of any year, the balance of my dues for that year will be deducted from my payroll check(s)." 9-6 Upon termination of any teacher, the remaining amounts of dues for the Association in Section 9-1 above will be deducted from the final check in accordance with the dues authorization card. If the amount due the Association is greater than the amount the teacher has earned, the Superintendent and the President of the Association will determine the amount to be paid on a meet and confer basis. 9-7 The School District will honor the continuing membership concept as authorized by the dues authorization cards which state: "I hereby authorize continued deduction of my United Teaching Profession dues from my payroll check as established by local, state, and the National Education Association. H. The Union shall hold the Board harmless against any national education associations and all claimsaccording to policy, demandsrule, liabilities, lawsuits, attorney's fees regulation or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this articlenegotiated contract within my school district. The Board reserves I reserve the right to revoke this authorization by written notice to my school district and local association before July 15th of any school year." The Association shall provide the School District with an updated listing of memberships on July 15 so that proper deductions might be represented by counsel of its choice and made. 9-8 The Association agrees to hold the Board shall be reimbursed District harmless for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable any actions taken by the BoardDistrict in reliance upon information furnished by the Association with respect to dues check off authorizations.

B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from the salaries of its employees dues for the NEA-NH/STA. B. The Stratford School District shall not require a payroll deduction authorization other than the “Payroll Office Copy” that is supplied by the NEA-NH/STA as part of the membership application. The “Payroll Office Copy” will state the amount(s) to be withheld. Those who choose continuing deductions shall be required to submit the appropriate form, and the district shall place the form on file. The Payroll Office Copy supplied by the NEA-NH/STA for each teacher an amount equal member requesting dues deduction must be submitted to the Union membership dues or service fee by means of payroll deductionCentral Office no later than October 15th each year. No other form will be accepted. C. The amount of the deduction from each paycheck district shall discontinue such deductions for Union membership dues shall be equal to the total dues divided any school year only if notified by the number of paychecks from which the teacher wishes dues in writing to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of do so not later than October 1st each school year. The amount teachers waive all rights and claims for said monies so deducted and transmitted in accordance with this authorization and relieve the district and all its officials from any liability thereof. D. Any Association which changes the rate of its membership dues will give the district notice by October 1st of the service year of such change. E. Deductions will be made in ten (10) installments beginning with the first check in November, or if requested in writing by the member the total deduction may be made from the final payment in June. F. It is recognized that the negotiations for, and administration, of the Agreement entails expenses, which appropriately should be shared by all employees who are beneficiaries of this Agreement. To this end, if an employee in the bargaining unit does not join the Association, such employee will have the option of executing an authorization for the deduction of a “representation fee” which shall be the sum equivalent to the membership dues and assessments required to be paid by the members of the Association, which sum shall be retained for a scholarship fund. Employees who choose not to authorize the District to deduct the representation fee shall be certified responsible for full payment of the representation fee by the Union to the Board May 1st of Education prior to December 15th of each that school year. D. Those teachers whose employment commences after . The committee to award the start scholarship shall be made up of two administrators, two members of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and one member of the National Education “representation fee” group. The scholarship shall be given in the name of the Stratford Teachers’ Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

The School Board shall provide, at no cost to DCSAA, services of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, payroll deduction of dues and uniform assessment s. The School Board shall collect and t ransmit such monies as are suf f icient to deduct from that employee's salary dues provide for the Westport Education Associationfull payment of membership dues or assessment , Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union pursuant to the Westport Education Association, Inc. Any certified employee submitting a written request for such terms and conditions contained in the dues deduction shall be subject to dues deductions during the remainder authorization contract signed by members of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same yearDCSAA. B. For teachers not subject to Whenever there is a change in regular dues, DCSAA, Local 77 shall notify the Chief Financial Officer on or before July 1 of each year regarding: 1. The amount of each Union’s dues deduction to be made; and 2. The number of deductions required during that contract year. If there is no change in accordance with paragraph A abovethe dues amount s, the Westport School Board of Education agrees w ill continue to deduct from each teacher an amount equal to dues based upon the Union membership dues or service fee by means of payroll deductionprevious year’s deductions. C. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of authorized Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school yeardues. D. Those teachers whose employment commences after The Union shall provide M-DCPS a sample of its proposed Dues Deduction Card, w hich includes a st atement that the start School Board shall be absolved of any and all liability result ing f rom the collection of authorized dues. Any modification of the school year current form shall pay a prorated amount equal be provided to the percentage School Board in advance of the remaining school yearits use. E. The Board of Education agrees to forward to the Union biweekly w ill be provided a check for the amount of money deducted during that deduction regist er follow ing each pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than DCSAA shall be required to submit completed and correct payroll deduction authorization cards, including the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees manual signat ure of the Board of Education and employee, to t he Payroll Department at least seven days before the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said listinitial deduction is to be made. G. The singular reference authorization cards shall be retained on f ile in the Payroll Department as long as DCSAA is the certified bargaining agent of the unit. Payroll deduction authorization, for employees w ho are on School Board approved leave, w ill be rest ored upon their return to an active employment st atus. X. Any employee in the unit desiring to revoke his/her dues deduction authorization must submit a request for such revocation to DCSAA and the School Board at least 30 days prior to the "Union" herein effect ive date of such action. I. DCSAA shall be interpreted as referring to responsible for the Westport Education Association, the Connecticut Education Association, and the National Education Associationcollection of any dues in arrears. H. J. The Union shall hold School Board w ill process dues deduction authorization forms submit xxx after the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against date necessary for the Board as a result full deduction for the amount that can be deducted for the remainder of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Boardf iscal year.

Dues Deduction. A. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, agrees to deduct from that employee's salary dues for the Westport Education salaries of its employees any obligation due the Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Association within thirty (30) days of collection. By signing and dating the SEA/IEA membership form, teachers agree to the following: I hereby request and authorize the Board of Education of School District #54 to deduct from my earnings and the Union transmit to the Westport Education Association an amount sufficient to provide for regular payment of my obligation in conformance with Article IV. Such amount will be annually certified by the Association. I understand that the deductions will be in eighteen (18) equal installments, Inc. Any certified employee submitting a written request starting with the fifth (5th) payroll period and continuing for such dues deduction shall be subject to dues deductions the next seventeen (17) payroll periods. I also understand that if I should leave the District for any reason during the school term, the Board will deduct the remainder of his or her employment by my unpaid prorated obligation from my final paycheck. I hereby waive all right and claim for monies so deducted and transmitted in accordance with this authorization and relieve the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request and all its officers for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same yearliability therefore. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal The Association will certify annually to the Union membership dues or service fee by means of payroll deductionBoard in writing the current obligation for each affected teacher. C. Deductions referred to in Paragraph A above will be made in eighteen (18) equal installments beginning with the fifth (5th) payroll period and continuing for the next seventeen (17) payroll periods. The amount Board will not be required to honor any authorizations that are presented later than two (2) weeks prior to the distribution of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks payroll from which the teacher wishes dues deduction is to be deducted. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

Dues Deduction. A. The (a) Teachers employed by the Region 15 Board of Education agreeswho are hired on or after July 1, upon 1995, as well as those hired before that date who at any time during their employment with the voluntary written request from any certified employee submitted on Board have voluntarily become members of the Association, shall as a form approved condition of employment either join the Association or pay a service fee to the Association. Said service fee shall be equal to the proportion of Association dues uniformly required by members to underwrite the Boardcosts of collective bargaining, contract administration, and grievance adjustment. (b) The singular reference to deduct from that employee's salary dues for the Westport “Association” herein shall be interpreted as referring to the Pomperaug Education Association, Inc., the Connecticut Education Association and/or and the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport (c) The Region 15 Board of Education agrees to deduct from the salary of each teacher an amount equal to the Union Association membership dues or service fee by means of payroll deduction. C. The deductions. Deductions for part- time teachers shall be prorated equal to the percentage of FTE worked. For members, the amount of the deduction from each paycheck for Union membership dues shall be in equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between amounts beginning with the first paycheck in January November through and including the last paycheck in June. The amount of Union Association membership dues shall be certified by the Union Association to the Board of Education prior to September 15th the opening of school each school year, but in no case less than two weeks prior to the distribution of payroll from which the deductions are to be made. For fee service payers, the deduction shall begin with the first paycheck in January and shall be made in equal amounts through the last paycheck in June. The amount of the Association service fee shall be certified by the Union forwarded to the Board of Education prior to December 15th the first deduction in January, but in no case less than two weeks prior to the distribution of each school yearpayroll from which these deductions are to be made. D. (d) Those teachers whose employment commences after the start of the school year shall pay a prorated amount of membership dues or service fees equal to the percentage of the remaining school year. E. (e) The Board of Education agrees to forward to the Union biweekly Association each pay period a single check for the total amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, (f) The Association shall hold harmless and indemnify the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees attorney fees, or other costs which that may arise out of of, or by reason of of, actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Boardsection.

Dues Deduction. A. The Board agrees to continue the practice of Education agrees, upon deducting from the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary of its employees’ dues for the Westport Education AssociationFederation. Such employees must voluntarily authorize the Board to make such deductions on the form provided in subparagraph B, Inc.this section, and such monies shall be transmitted to the Federation. In the event dues deductions are not made due to clerical errors, the Connecticut Education Association and/or Board will be notified by the National Education Association Federation and to transmit such monies so deducted at a time to proper action will be agreed upon between taken the following month. In accordance with Chapter 233, Laws of 1969, the following law shall be used for dues check or for the Federation. To: Secretary, Board of Education, School district of Perth Amboy I hereby request and authorize the above-named secretary of the Board of Education and to deduct from my earnings an amount sufficient to provide one tenth (1/10) of the Union yearly membership dues, as certified by Local 857 AFT, to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder secretary of his or her employment by the Board of Education, to the treasurer of Local 857, AFT, in equal monthly payments for all or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 part of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues or service fee by means of payroll deduction. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year. D. Those teachers whose employment commences after the start of the current school year shall pay a prorated amount equal to and for succeeding school years. I understand that the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. Employee shall provide personal information requested on the card along with a signature. B. The Board shall notify agrees to authorize the Union monthly of any changes in said list. G. The singular reference payroll department to deduct one dollar ($1.00) per pay period as a voluntary contribution to the "Union" herein Federation’s Political Education Fund. Employees wishing to voluntarily contribute must authorize the Board to make such deductions on the form provided and such monies shall be interpreted as referring transmitted to the Westport Education Association, Federation in conjunction with the Connecticut Education Association, and the National Education Associationdeducted dues. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each the teachers' salaries an amount to cover dues for the Federation, the Colorado Federation of Teachers, and the American Federation of Teachers, as the teachers individually and voluntarily authorize the Board to deduct, and to transmit the amount so authorized to the treasurer of the Federation. Automatic deduction of increase or decrease in dues voted on by the Vocational Teachers' Federation, Local 203, shall he made when the treasurer of the Federation advises the change in dues in writing to the secretary-treasurer of the school district by September 1, or the first of any month. B. Each teacher who desires to authorize such deduction, shall file with the school district secretary through the treasurer of the Federation a signed and dated "Salary Deduction Authorization Form," authorizing the school district treasurer to deduct from monthly earnings and to remit to the treasurer of the Federation an amount equal to one twelfth (1/12) of the Union dues required for membership in the organization or organizations so specified. Such forms shall include a waiver of all rights and claims against the Board and school district and the officers and agents thereof for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the school district secretary in writing, on an appropriate form, that the teacher desires to discontinue or to change such authorization. C. Deductions shall be made uniformly on each monthly period. The school district secretary shall not be required to honor for any month's deduction, any authorizations that are delivered to the secretary later than the tenth (10TH) day of the month prior to the distribution of the payroll from which the deductions are to be made. D. If a teacher who is absent on account of sickness, leave of absence, or for any other reason has no earnings due for the month, no deductions will be made for that teacher for that month. The Federation will arrange collection of dues for that month directly with the teacher. X. The Federation agrees to save the Board and school district harmless from any action growing out of these deductions and commenced by any teacher against the Board or the school district, and assumes full responsibility for the disposition of the funds so deducted once they have been turned over to the treasurer of the Federation. F. A service fee charge of ten cents ($.10) per individual teacher authorization per month shall be retained by means the school district to help defray costs of payroll making such deduction. C. The amount G. Upon tile issuance of any employment contract to any member of the deduction from each paycheck for Union membership dues shall be equal to Federation bargaining unit, the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount district will provide tl1e employee with a copy of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January Agreement and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of information concerning responsibilities identified under this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

Dues Deduction. A. 1. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher an amount equal to the Union membership dues or service fee by means of payroll deduction. C. The amount salaries of the deduction from each paycheck for Union membership teachers dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Michigan Education Association, and the National Education Association, when voluntar- ily authorized in writing by each teacher desirous of having such dues deducted. H. 2. Regular dues for any or all of the above-stated organizations shall be deducted together, as one (1) deduction, in ten (10) equal monthly installments from the second paycheck of each month of the school year, except in June when it will be the first pay. 3. Dues authorizations filed with the Superintendent on or before the Monday preceding the second payday of each year shall become effective with the first scheduled dues deduction of the coming school year. Dues authorizations filed after the Monday preceding the sec- ond payday shall be deducted from the second paycheck of the succeeding months in equal installments. 4. Dues authorizations, once filed with the Superintendent, shall continue in effect until a revocation form in writing and signed by the teacher is filed with the Superintendent and the Treasurer of the Association. 5. The Union Association shall, on or before the first day of each school year, give written notifica- tion to the Superintendent of the amount of its dues and those of the MEA and NEA, which dues are to be deducted in the coming school year under such dues authorizations. The amounts of deductions for these dues, as per said written notification, shall not be subject to change during the entire school year. 6. For the purpose of this Article, the term “school year” shall include the period beginning with the first teacher working day of school in the fall through the last teacher working day of school in the spring. 7. Dues deduction shall be transmitted by the Superintendent to the Association Treasurer within ten (10) days after such deductions are made. 8. All refunds claimed for dues of the Association, MEA, or NEA under such dues authoriza- tions shall lie solely with the Association. The Association agrees to reimburse any teacher for the amount of any dues deducted by the Board and paid to the Association, which de- duction is by error in excess of the proper deduction and agrees to hold the Board harm- less from all claims of excessive dues deductions. 9. Any dispute between the Association and the Board that may arise as to whether or not an employee properly executed or revoked an authorization card pursuant to this Article shall be reviewed with the employee by a representative of the Board. Until the matter is dis- posed of, no further deductions for that employee shall be made. The Board assumes no liability for the authenticity, execution or revocation of the authorization form. 10. The Association shall protect and save harmless against the Board from any and or all claims, demandsde- mands, liabilities, lawsuits, attorney's fees or suits and other costs which may arise out forms of or liability by reason of actions action taken against or not taken by the Board as a result or its designated agent for the purpose of the enforcement or administration of complying with this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the BoardArticle.

Dues Deduction. A. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher the salaries of its employees dues for the Manchester Education Association/NEA-NH, as said teachers individually and voluntarily authorize the Board to deduct and to transmit the monies promptly to the Association. Teacher authorizations will be in writing in the form set below. "DUES AUTHORIZATION CARD" MANCHESTER EDUCATION ASSOCIATION/NEA-NH NAME: ADDRESS: I hereby request and authorize the Manchester Board of School Committee to deduct from my earnings in accordance with the procedure set forth in Article XVIII of the Master Agreement between the Board and the Association and transmit to the Treasurer of the Manchester Education Association/NEA-NH an amount equal sufficient to provide for regular payment of the membership dues, as certified by the Association for the present school year and for succeeding school years. I understand that if I wish to discontinue such deductions for any school year, I must notify the Board and the Association in writing to do so no later than sixty (60) days prior to the Union commencement of the school year. I hereby waive all right and claim for said monies so deducted and transmitted in accordance with this authorization, and relieve the Board and all its officers from any liability therefore. The Association will certify to the Board, in writing, the current rate of its membership dues or service fee by means and will give the Board thirty (30) days written notice prior to September 1 of payroll deductionthe year of any such change. C. The amount Dues deduction procedure will be as follows: C. 1. Dues will be deducted every pay period for fifteen (15) periods from the 5th payday of the deduction from each paycheck for Union membership dues shall be equal year to the total dues divided by 19th payday of the number of paychecks from which the teacher wishes dues to be deductedyear, inclusive. Any teacher desiring to have the Board discontinue deductions that the teacher has previously authorized must notify the Board and the Association in writing no later than sixty (60) days prior to the commencement of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board Any employee who is in the bargaining unit and is not a member of Education the Association but wishes to be represented by the Association in grievances shall assume full financial responsibilities as to the actual costs of processing the grievances. Collection of such fees shall be the sole responsibility of the Association. Should there be a dispute between an employee and the Association and/or the Board, relating to such grievances or costs, the Association agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school yeardefend, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education indemnify and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against in any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Boardsuch dispute.

Dues Deduction. A. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each the teachers' salaries an amount to cover dues for the Federation, the Colorado Federation of Teachers, and the American Federation of Teachers, as the teachers individually and voluntarily authorize the Board to deduct, and to transmit the amount so authorized to the treasurer of the Federation. Automatic deduction of increase or decrease in dues voted on by the Vocational Teachers' Federation, Local 203, shall he made when the treasurer of the Union advises the change in dues in writing to the secretary-treasurer of the school district by September 1, or the first of any month. B. Each teacher who desires to authorize such deduction, shall file with the school district secretary through the treasurer of the Federation a signed and dated "Salary Deduction Authorization Form," authorizing the school district treasurer to deduct from monthly earnings and to remit to the treasurer of the Federation an amount equal to one twelfth (1/12) of the Union dues required for membership dues in the organization or service fee by means organizations so specified. Such forms shall include a waiver of payroll deductionall rights and claims against the Board and school district and the officers and agents thereof for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the school district secretary in writing, on an appropriate form, that the teacher desires to discontinue or to change such authorization. C. Deductions shall be made uniformly on each monthly period. The amount school district secretary shall not be required to honor for any month's deduction, any authorizations that are delivered to the secretary later than the tenth (10TH) day of the deduction from each paycheck for Union membership dues shall be equal month prior to the total dues divided by distribution of the number of paychecks payroll from which the teacher wishes dues deductions are to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school yearmade. D. Those teachers whose employment commences after If a teacher who is absent on account of sickness, leave of absence, or for any other reason has no earnings due for the start month, no deductions will be made for that teacher for that month. The Federation will arrange collection of dues for that month directly with the school year shall pay a prorated amount equal to the percentage of the remaining school yearteacher. E. The Board of Education Federation agrees to forward save the Board and school district harmless from any action growing out of these deductions and commenced by any teacher against the Board or the school district, and assumes full responsibility for the disposition of the funds so deducted once they have been turned over to the Union biweekly a check for treasurer of the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were madeFederation. F. No later than A service charge of five cents ($.05) per individual teacher authorization per month shall be retained by the first paycheck in October school district to help defray costs of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said listmaking such deduction. G. The singular reference Upon tile issuance of any employment contract to any member of the "Union" herein shall be interpreted as referring to the Westport Education AssociationFederation bargaining unit, the Connecticut Education Association, and the National Education Association. H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as district will provide tl1e employee with a result copy of the enforcement or administration of Agreement and information concerning responsibilities identified under this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Board.

Dues Deduction. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teachers' salaries an amount to cover dues for the United Teaching Profession as the teachers individually and voluntarily authorize the Board to deduct, and to transmit the amount so authorized to the Treasurer of the Association. 6.2 Every teacher who so desires to authorize such deduction shall file with the school district Financial Services Department, through the office of the Association, a signed and dated "District Twelve Educators' Association Salary Deduction Authorization Form" authorizing the school district Financial Services Department to deduct from their monthly earnings and to remit to the Treasurer of the Association an amount equal to 1/12th of the Union dues required for membership in an organization or organizations specified. Teachers joining after the August payroll cut-off date shall have their dues pro-rated over the remaining months through July. Such forms shall include a waiver of all right and claim against the Board and the school district and the officers and agents thereof, for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the Office of the Association in writing. The Association will notify the school district Financial Services Department forthwith, on an appropriate form, that such teacher desires to discontinue or to change such authorization, said notice to be received by the first day of November. 6.3 The District Twelve Educators' Association agrees to save the Board harmless from any action growing out of these deductions and commenced by any teacher against the Board or the school district and assumes full responsibility for the disposition of the funds so deducted once they have been turned over to the Treasurer of the Association. 6.4 The District Twelve Educators' Association will notify the Board, in writing, of the current rate of membership dues. The Board will be notified of any change in the rate of membership dues or service fee by means thirty (30) days prior to the effective date of payroll deductionsuch change. C. Those teachers whose employment commences after the start of district during the school year will have the remaining balance of their annual dues deducted from their last paycheck. Notification of this provision will be contained on any future authorization form signed by the teacher. 6.7 The Association shall pay not make any direct or indirect contribution out of membership dues to any political party or political organization. Teachers may voluntarily agree to an additional deduction as a prorated amount equal contribution to the percentage of the remaining school yearAssociation's political action committees. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. No later than the first paycheck in October of each school year, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list. G. A. ‌ 10-1 The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education School District agrees to deduct from each teacher an amount equal the salaries of its teachers political contributions and dues for CCEA, NSEA, and NEA, by monthly deductions in one sum as the teachers individually authorize the School District to deduct, and to transmit the monies promptly to the Union Xxxxxxxxx County Education Association. Teacher authorizations will be in writing on forms provided by the Association. 10-2 The Association will certify to the School District in writing the current rate of membership dues. The School District will be notified of any changes in the rate of membership dues or service fee by means thirty (30) days prior to the effective date of payroll deductionsuch change. C. The amount of 10-3 Deductions referred to in Section 10-1 above will be made in equal installments once each month during the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount School District will not be required to honor for any month's deduction any authorizations that are delivered to it later than the fifteenth (15th) of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school yearmonth. D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year. E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made. F. 10-4 No later than the first paycheck in October fifteenth (15th) of each school year, year the Board of Education shall Association will provide the Union School District with a current list of all teacher employees of the Board of Education and the positions held by said teacher employeesmembership. The Board shall Association will notify the Union School District monthly of any changes in said list. G. The singular reference 10-5 Any teacher desiring to have the "Union" herein shall be interpreted as referring to School District discontinue the Westport Education Associationdues deductions he or she has previously authorized must notify the School District and the Association in writing between July 1 and July 15 for the school year's dues. If notification is received after July 15th, the Connecticut Education Associationdues will be deducted for that year in accordance with the dues authorization card which states, "I understand that if I terminate my membership in the United Teaching Profession after July 15 of any year, the balance of my dues for that year will be deducted from my payroll check(s)." 10-6 Upon termination of any teacher, the remaining amounts of dues for the Association in Section 10-1 above will be deducted from the final check in accordance with the dues authorization card. If the amount due the Association is greater than the amount the teacher has earned, the Superintendent and the President of the Association will determine the amount to be paid on a meet and confer basis. 10-7 The School District will honor the continuing membership concept as authorized by the dues authorization cards which state: "I hereby authorize continued deduction of my United Teaching Profession dues from my payroll check as established by local, state, and the National Education Association. H. The Union shall hold the Board harmless against any national education associations and all claimsaccording to policy, demandsrule, liabilities, lawsuits, attorney's fees regulation or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this articlenegotiated contract within my school district. The Board reserves I reserve the right to revoke this authorization by written notice to my school district and local association before July 15th of any school year." The Association shall provide the School District with an updated listing of memberships on July 15 so that proper deductions might be represented by counsel of its choice and made. 10-8 The Association agrees to hold the Board shall be reimbursed District harmless for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable any actions taken by the BoardDistrict in reliance upon information furnished by the Association with respect to dues check off authorizations.
