Dues Deduction. A. The Board of Education agrees, upon the voluntary written request from any certified employee submitted on a form approved by the Board, to deduct from that employee's salary dues for the Westport Education Association, Inc., the Connecticut Education Association and/or the National Education Association and to transmit such monies so deducted at a time to be agreed upon between the Board of Education and the Union to the Westport Education Association, Inc. Any certified employee submitting a written request for such dues deduction shall be subject to dues deductions during the remainder of his or her employment by the Board of Education, or until the Board receives a written request from the employee that dues no longer need be deducted. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year. Dues Deduction. A. The Board College shall deduct and transmit to the Association, commencing with the first pay check in September, all dues and uniform assessments upon receipt of Education agrees, upon the voluntary a written request from any certified employee submitted authorization form signed by a faculty member. G. deductions. Each deduction authorization shall remain in effect until revocation in writing by the faculty member, termination of employment, or loss of the right of dues deduction specified in this Agreement. Each authorizing faculty member shall have the right to revoke the authorization upon written notice to both the College and the Association. The singular reference Association has paid to the "Union" herein College the one-time fee of seven hundred dollars ($700) to cover the expense of establishing the system for dues deductions described above, and it is understood that as long as dues deductions are made under the above described system, there will be no operational charges. The College shall be interpreted as referring have no responsibility or any liability for any monies once sent to the Westport Education Association. H. The Union Association shall hold the Board College harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against for unintentional errors in the Board as a result administration of the enforcement or administration of dues deduction system, although the College shall exercise reasonable care in said transactions. 6.2 Every teacher who so desires to authorize such deduction shall file with the school district Financial Services Department, through the office of the Association, a signed and dated "District Twelve Educators' Association Salary Deduction Authorization Form" authorizing the school district Financial Services Department to deduct from his/her monthly earnings and to remit to the Treasurer of the Association an amount equal to 1/12th of the Union dues required for membership in an organization or organizations specified. Teachers joining after the September payroll cut-off date shall have their dues pro-rated over the remaining months through August. Such forms shall include a waiver of all right and claim against the Board and the school district and the officers and agents thereof, for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the Office of the Association in writing. The Association will notify the school district Financial Services Department forthwith, on an appropriate form, that such teacher desires to discontinue or to change such authorization, said notice to be received by the first day of November.
6.3 The District Twelve Educators' Association agrees to save the Board harmless from any action growing out of these deductions and commenced by any teacher against the Board or the school district and assumes full responsibility for the disposition of the funds so deducted once they have been turned over to the Treasurer of the Association.
6.4 The District Twelve Educators' Association will notify the Board, in writing, of the current rate of membership dues. The Board will be notified of any change in the rate of membership dues or service fee by means thirty (30) days prior to the effective date of payroll deductionsuch change.

3. Dues authorizations filed with the Superintendent on or before the Monday preceding the second payday of each year shall become effective with the first scheduled dues deduction of the coming school year. Dues authorizations filed after the Monday preceding the second payday shall be deducted from the second paycheck of the succeeding months in equal installments.
4. Dues authorizations, once filed with the Superintendent, shall continue in effect until a revocation form in writing and signed by the teacher is filed with the Superintendent and the Treasurer of the Association.
5. The Union Association shall, on or before the first day of each school year, give written notification to the Superintendent of the amount of its dues and those of the MEA and NEA which dues are to be deducted in the coming school year under such dues authorizations. The amounts of deductions for these dues, as per said written notification, shall not be subject to change during the entire school year.
6. For the purpose of this Article, the term "school year" shall include the period beginning with the first teacher working day of school in the fall through the last teacher working day of school in the spring.
7. Dues deduction shall be transmitted by the Superintendent to the Pine River Education Association, MEA/NEA, Treasurer within ten (10) days after such deductions are made.
8. All refunds claimed for dues of the Pine River Education Association, MEA/NEA, MEA or NEA under such dues authorizations shall lie solely with the Association. The Association agrees to reimburse any teacher for the amount of any dues deducted by the Board and paid to the Association, which deduction is by error in excess of the proper deduction and agrees to hold the Board harmless against from all claims of excessive dues deductions.
9. Any dispute between the Pine River Education Association, MEA/NEA and the Board which may arise as to whether or not an employee properly executed or revoked an authorization card pursuant to this Article shall be reviewed with the employee by a representative of the Board. Until the matter is disposed of, no further deductions for that employee shall be made. The Board assumes no liability for the authenticity, execution or revocation of the authorization form.
10. The Association shall protect and save harmless the Board from any and or all claims, demands, liabilities, lawsuits, attorney's fees or suits and other costs which may arise out forms of or liability by reason of actions action taken against or not taken by the Board as a result or its designated agent for the purpose of the enforcement or administration of complying with this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. B. Each teacher who desires to authorize such deduction, shall file with the school district secretary through the treasurer of the Federation a signed and dated "Salary Deduction Authorization Form," authorizing the school district treasurer to deduct from monthly earnings and to remit to the treasurer of the Federation an amount equal to one twelfth (1/12) of the Union dues required for membership dues in the organization or service fee by means organizations so specified. Such forms shall include a waiver of payroll deductionall rights and claims against the Board and school district and the officers and agents thereof for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the school district secretary in writing, on an appropriate form, that the teacher desires to discontinue or to change such authorization.
C. Deductions shall be made uniformly on each monthly period. The amount school district secretary shall not be required to honor for any month's deduction, any authorizations that are delivered to the secretary later than the tenth (10TH) day of the deduction from each paycheck for Union membership dues shall be equal month prior to the total dues divided by distribution of the number of paychecks payroll from which the teacher wishes dues deductions are to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school yearmade.
D. Those teachers whose employment commences after If a teacher who is absent on account of sickness, leave of absence, or for any other reason has no earnings due for the start month, no deductions will be made for that teacher for that month. The Federation will arrange collection of dues for that month directly with the school year shall pay a prorated amount equal to the percentage of the remaining school yearteacher.

Dues Deduction. If the amount due the Association is greater than the amount the teacher has earned, the Superintendent and the President of the Association will determine the amount to be paid on a meet and confer basis.
9-7 The School District will honor the continuing membership concept as authorized by the dues authorization cards which state: "I hereby authorize continued deduction of my United Teaching Profession dues from my payroll check as established by local, state, and the National Education Association.
H. The Union shall hold the Board harmless against any national education associations and all claimsaccording to policy, demandsrule, liabilities, lawsuits, attorney's fees regulation or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this articlenegotiated contract within my school district. Should there be a dispute between an employee and the Association and/or the Board, relating to such grievances or costs, the Association agrees to defend, indemnify and hold the Board harmless in any such dispute.
F. X. C. The amount of the deduction from each paycheck for Union membership dues shall be equal to the total dues divided by the number of paychecks from which the teacher wishes dues to be deducted. The amount of the deduction from each paycheck for the service fee shall be equal to the total service fee divided by the total number of paychecks between the first paycheck in January and the last paycheck in June. The amount of Union membership dues shall be certified by the Union to the Board of Education prior to September 15th of each school year. The amount of the service fee shall be certified by the Union to the Board of Education prior to December 15th of each school year.
D. Those teachers whose employment commences after the start of the school year shall pay a prorated amount equal to the percentage of the remaining school year.
E. The Board of Education agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made.
F. No later than the first paycheck in October before August 25 of each school year, the Association shall give written notice to the Board of the dollar amount of dues and assessments of the Association, which dues and assessments are to be deducted in the coming school year under all payroll deductions. The total for these deductions shall not be subject to change during the school year.
B. The deductions authorized above shall be made in twelve (12) equal amounts from each paycheck beginning the pay period in September through the pay period in August of each year. Employees who commence employment after September or terminate employment before June shall have their deductions prorated for each month the employee is employed. The Board agrees to remit promptly and directly to the Washington Education shall provide the Union with Association all moneys so deducted, accompanied by a list of all teacher employees from whom the deductions have been made. A duplicate list shall be promptly provided to the Association as receipt of said transaction. On or before the Board of Education and monthly pay period, the positions held by said teacher employees. The Board shall notify the Union monthly Association of any changes in said listlist due to employees entering or leaving the employ of the District via approved meeting agenda and minutes which are sent via e-mail in accordance with Article II Section 2 I.
C. The Association agrees to reimburse any employee for dues and/or assessments that were deducted in excess of the total amount due to the Association at that time, provided the Association or its affiliate actually received the excessive amount.

Within ten (10) days of their commencement of employment, employees may sign and deliver to the "Union" herein Board a Dues - Automatic Payroll Deduction form (see Appendix D), which shall be interpreted as referring to authorize deduction for membership dues and assessments of the Westport Education Association, the Connecticut Education Association, and Association (including the National Education Association and the Washington Education Association). Such authorization shall continue in effect from year to year unless a request of revocation is submitted to the Board and the Association, signed by the employee and received between August 1 and August 31, preceding the designated school year for which revocation is to take effect. Each month during the school year the Association agrees to provide the Board with names of those employees who have joined the Association and paid its dues and assessments by means other than through payroll deduction.
H. The Union shall hold the Board harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result E. No member of the enforcement or administration of this articlebargaining unit will be required to join the Association; however, those employees who are not Association members will be required to pay a representation fee to the Association. The Board reserves the right to be represented by counsel of its choice and the Board representation fee shall be reimbursed an amount equal to dues for the Association membership less any political action contribution. The Association affirms that it has adopted such procedures for refund of agency fee deduction as required in Section 3, Chapter 677 of the Laws of 1977 of the State of New York and any amendments thereto. This provision for agency fee deductions shall be interpreted continue in effect so long as referring the Association maintains such procedure. The Association assumes full responsibility for the disposition of such funds so deducted once they have been forwarded to it by the Westport Education Association, District.

5. Any teacher whose dues deduction card is not received by the Business Office fifteen (15) days prior to the first paycheck in October will be accorded the same deductions as the other teachers. This teacher will, however, be responsible for any dues required after the last installment in June and the first one in October.
6. The Board shall, following each pay period from which dues deductions are made, transmit the amount so deducted at to the Association. The first transmittal shall be accompanied by a time to be agreed upon between listing of the Board of Education members' names and school ID Numbers for whom deductions have been made, and the Union amount deducted for each. 21:02 Each of the Union Associations listed in paragraph 21:01 above, will certify to the Westport Education AssociationBoard, Inc. in writing, the current rate of its membership dues. 3-4 The singular reference District agrees not to honor any check-off authorization or dues deduction authorization executed by any employee in the "Union" herein bargaining unit in favor of any other labor organization representing employees for negotiations.
3-5 In the case of an employee who is in non-pay status during part of the pay period, and/or whose wages are not sufficient to cover the full withholding, no Association dues deductions shall be interpreted as referring made. In this connection, all other required deductions have priority over Association dues.

The Union shall hold the Board District harmless against any and all claims, demands, liabilities, lawsuits, attorney's fees claims or other costs which suits that may arise out of or by reason of actions action taken against by the Board as a result District in reliance upon any authorization cards submitted by the Association to the District.

9-7 The School District will honor the continuing membership concept as authorized by the dues authorization cards which state: "I hereby authorize continued deduction of my United Teaching Profession dues from my payroll check as established by local, state, and the National Education Association.
H. The Union shall hold the Board harmless against any national education associations and all claimsaccording to policy, demandsrule, liabilities, lawsuits, attorney's fees regulation or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this articlenegotiated contract within my school district. Dues Deduction. A. X. Any employee in the unit desiring to revoke his/her dues deduction authorization must submit a request for such revocation to DCSAA and the School Board at least 30 days prior to the "Union" herein effect ive date of such action.

Dues Deduction. A. Dues Deduction. A. Each teacher who desires to authorize such deduction, shall file with the school district secretary through the treasurer of the Federation a signed and dated "Salary Deduction Authorization Form," authorizing the school district treasurer to deduct from monthly earnings and to remit to the treasurer of the Federation an amount equal to one twelfth (1/12) of the Union dues required for membership in the organization or organizations so specified. Such forms shall include a waiver of all rights and claims against the Board and school district and the officers and agents thereof for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the school district secretary in writing, on an appropriate form, that the teacher desires to discontinue or to change such authorization.
C. Deductions shall be made uniformly on each monthly period. The school district secretary shall not be required to honor for any month's deduction, any authorizations that are delivered to the secretary later than the tenth (10TH) day of the month prior to the distribution of the payroll from which the deductions are to be made.
D. If a teacher who is absent on account of sickness, leave of absence, or for any other reason has no earnings due for the month, no deductions will be made for that teacher for that month. The Federation will arrange collection of dues for that month directly with the teacher.
X. The Federation agrees to save the Board and school district harmless from any action growing out of these deductions and commenced by any teacher against the Board or the school district, and assumes full responsibility for the disposition of the funds so deducted once they have been turned over to the treasurer of the Federation.
F. A service fee charge of ten cents ($.10) per individual teacher authorization per month shall be retained by means the school district to help defray costs of payroll making such deduction.

Dues authorizations filed with the Superintendent on or before the Monday preceding the second payday of each year shall become effective with the first scheduled dues deduction of the coming school year. Dues authorizations filed after the Monday preceding the sec- ond payday shall be deducted from the second paycheck of the succeeding months in equal installments.
4. Dues authorizations, once filed with the Superintendent, shall continue in effect until a revocation form in writing and signed by the teacher is filed with the Superintendent and the Treasurer of the Association.
5. The Union Association shall, on or before the first day of each school year, give written notifica- tion to the Superintendent of the amount of its dues and those of the MEA and NEA, which dues are to be deducted in the coming school year under such dues authorizations. The amounts of deductions for these dues, as per said written notification, shall not be subject to change during the entire school year.
6. For the purpose of this Article, the term “school year” shall include the period beginning with the first teacher working day of school in the fall through the last teacher working day of school in the spring.
7. Dues deduction shall be transmitted by the Superintendent to the Association Treasurer within ten (10) days after such deductions are made.
8. All refunds claimed for dues of the Association, MEA, or NEA under such dues authoriza- tions shall lie solely with the Association. The Association agrees to reimburse any teacher for the amount of any dues deducted by the Board and paid to the Association, which de- duction is by error in excess of the proper deduction and agrees to hold the Board harm- less from all claims of excessive dues deductions.
9. Any dispute between the Association and the Board that may arise as to whether or not an employee properly executed or revoked an authorization card pursuant to this Article shall be reviewed with the employee by a representative of the Board. Until the matter is dis- posed of, no further deductions for that employee shall be made. The Board assumes no liability for the authenticity, execution or revocation of the authorization form.
10. The Association shall protect and save harmless against the Board from any and or all claims, demandsde- mands, liabilities, lawsuits, attorney's fees or suits and other costs which may arise out forms of or liability by reason of actions action taken against or not taken by the Board as a result or its designated agent for the purpose of the enforcement or administration of complying with this article. Such written request for withdrawal from dues deductions shall only be accepted and honored by the Board between June 1 and June 30 of any year of this Agreement to be effective on June 30 of the same year.
B. For teachers not subject to dues deduction in accordance with paragraph A above, the Westport Board of Education agrees to deduct from each teacher the salaries of its employees dues for the Manchester Education Association/NEA-NH, as said teachers individually and voluntarily authorize the Board to deduct and to transmit the monies promptly to the Association. Teacher authorizations will be in writing in the form set below. "DUES AUTHORIZATION CARD" MANCHESTER EDUCATION ASSOCIATION/NEA-NH NAME: ADDRESS: I hereby request and authorize the Manchester Board of School Committee to deduct from my earnings in accordance with the procedure set forth in Article XVIII of the Master Agreement between the Board and the Association and transmit to the Treasurer of the Manchester Education Association/NEA-NH an amount equal sufficient to provide for regular payment of the membership dues, as certified by the Association for the present school year and for succeeding school years. I understand that if I wish to discontinue such deductions for any school year, I must notify the Board and the Association in writing to do so no later than sixty (60) days prior to the Union commencement of the school year. I hereby waive all right and claim for said monies so deducted and transmitted in accordance with this authorization, and relieve the Board and all its officers from any liability therefore. B. The Association will certify to the Board, in writing, the current rate of its membership dues or service fee by means and will give the Board thirty (30) days written notice prior to September 1 of payroll deductionthe year of any such change.
C. The amount Dues deduction procedure will be as follows:

Dues will be deducted every pay period for fifteen (15) periods from the 5th payday of the deduction from each paycheck for Union membership dues shall be equal year to the total dues divided by 19th payday of the number of paychecks from which the teacher wishes dues to be deductedyear, inclusive.

Collection of such fees shall be the sole responsibility of the Association. Should there be a dispute between an employee and the Association and/or the Board, relating to such grievances or costs, the Association agrees to forward to the Union biweekly a check for the amount of money deducted during that pay period. The Board shall include with such check a list of teachers for whom such deductions were made.
F. No later than the first paycheck in October of each school yeardefend, the Board of Education shall provide the Union with a list of all teacher employees of the Board of Education indemnify and the positions held by said teacher employees. The Board shall notify the Union monthly of any changes in said list.
G. The singular reference to the "Union" herein shall be interpreted as referring to the Westport Education Association, the Connecticut Education Association, and the National Education Association.
H. The Union shall hold the Board harmless against in any and all claims, demands, liabilities, lawsuits, attorney's fees or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this article. The Board reserves the right to be represented by counsel of its choice and the Board shall be reimbursed for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable by the Boardsuch dispute.

Automatic deduction of increase or decrease in dues voted on by the Vocational Teachers' Federation, Local 203, shall he made when the treasurer of the Union advises the change in dues in writing to the secretary-treasurer of the school district by September 1, or the first of any month.
B. Each teacher who desires to authorize such deduction, shall file with the school district secretary through the treasurer of the Federation a signed and dated "Salary Deduction Authorization Form," authorizing the school district treasurer to deduct from monthly earnings and to remit to the treasurer of the Federation an amount equal to one twelfth (1/12) of the Union dues required for membership dues in the organization or service fee by means organizations so specified. Such forms shall include a waiver of payroll deductionall rights and claims against the Board and school district and the officers and agents thereof for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the school district secretary in writing, on an appropriate form, that the teacher desires to discontinue or to change such authorization.
C. Deductions shall be made uniformly on each monthly period. The amount school district secretary shall not be required to honor for any month's deduction, any authorizations that are delivered to the secretary later than the tenth (10TH) day of the deduction from each paycheck for Union membership dues shall be equal month prior to the total dues divided by distribution of the number of paychecks payroll from which the teacher wishes dues deductions are to be deducted. Teachers joining after the August payroll cut-off date shall have their dues pro-rated over the remaining months through July. Such forms shall include a waiver of all right and claim against the Board and the school district and the officers and agents thereof, for monies deducted and remitted in accordance with said authorization, and an agreement that such deductions and remittances shall continue from year to year as so authorized, unless such teacher notifies the Office of the Association in writing. If notification is received after July 15th, the Connecticut Education Associationdues will be deducted for that year in accordance with the dues authorization card which states, "I understand that if I terminate my membership in the United Teaching Profession after July 15 of any year, the balance of my dues for that year will be deducted from my payroll check(s)."
10-6 Upon termination of any teacher, the remaining amounts of dues for the Association in Section 10-1 above will be deducted from the final check in accordance with the dues authorization card. If the amount due the Association is greater than the amount the teacher has earned, the Superintendent and the President of the Association will determine the amount to be paid on a meet and confer basis.
10-7 The School District will honor the continuing membership concept as authorized by the dues authorization cards which state: "I hereby authorize continued deduction of my United Teaching Profession dues from my payroll check as established by local, state, and the National Education Association.
H. The Union shall hold the Board harmless against any national education associations and all claimsaccording to policy, demandsrule, liabilities, lawsuits, attorney's fees regulation or other costs which may arise out of or by reason of actions taken against the Board as a result of the enforcement or administration of this articlenegotiated contract within my school district. The Board reserves I reserve the right to revoke this authorization by written notice to my school district and local association before July 15th of any school year." The Association shall provide the School District with an updated listing of memberships on July 15 so that proper deductions might be represented by counsel of its choice and made.
10-8 The Association agrees to hold the Board shall be reimbursed District harmless for its reasonable legal fees. The Union and the Connecticut Education Association agree that they will not contest the provisions of this paragraph, and further agree that it is valid and enforceable any actions taken by the BoardDistrict in reliance upon information furnished by the Association with respect to dues check off authorizations.
