ELIGIBILITY TO EXHIBIT. NCS reserves the right to determine the eligibility of any exhibitor for inclusion in the Event and to prohibit an exhibitor from conducting and maintaining an exhibit if, in the sole judgment of NCS, the exhibitor or exhibit or proposed exhibit shall in any respect be deemed unsuitable. Exhibitor’s eligibility to exhibit in the Event must remain in effect from the time of submission of the Contract to the time of the Event and should NCS determine that Exhibitors no longer eligible to exhibit at the Event (though previously deemed eligible), NCS may notify the Exhibitor and may terminate this Contract without liability upon written notice to Exhibitor.

ELIGIBILITY TO EXHIBIT. Exhibitor shall comply with all applicable laws, rules and regulations in the performance of its obligations under this Contract. Exhibitors should be a producer or supplier of equipment, products, or services whose proposed exhibit is directly related to the pharmaceutical, biotechnology, medical device, or related health care industries, and whose exhibit will contribute to the education of those registrants within the industry and/or their academic counterparts may apply for booth space. DIA reserves the right to determine the eligibility of any exhibitor for inclusion in the Event and to prohibit an exhibitor from conducting and maintaining an exhibit if, in the sole judgment of DIA, the exhibitor or exhibit or proposed exhibit shall in any respect be deemed unsuitable. An Exhibitor’s eligibility to exhibit in the Event must remain in effect from the time of submission of the Application & Contract to the time of the Event and should DIA determine that an Exhibitor which it had previously determined was eligible to exhibit at the Event is no longer eligible to do so, DIA may notify the Exhibitor and may terminate the Application & Contract without liability upon written notice to Exhibitor. Subject to all applicable laws, all Exhibitors (to include all accompanying staff) will be required to be fully vaccinated to enter the exhibit hall and to participate as a live Exhibitor at the Event. Each Exhibitor must provide proof of vaccination to gain access to the Event. Exhibitor agrees to follow all right of entry protocols established by DIA for the event including, but limited to, the process for providing proof of vaccination. No personal medical information will be retained by XXX. DIA reserves the right to refuse entry to any Exhibitor who is unable to comply with these entry protocols. No refunds will be made due to Exhibitor’s failure to be fully vaccinated on the first day of the Event or its failure to comply with DIA’s entry protocols. DIA reserves the right to waive this vaccination requirement, should it determine, in its sole discretion, that it is no longer merited by current public health concerns.
ELIGIBILITY TO EXHIBIT. Products and services must be related to the research or practice of pulmonary, critical care or sleep medicine and companies must be in good financial standing with the ATS. The ATS reserves the right to refuse space to any company who has failed to fulfill its financial obligations to the ATS, and/or whose products or services, in the judgment of the ATS do not meet the educational, scientific or practice needs of our members and attendees. Tobacco companies, and companies owned by tobacco companies, are prohibited from participating at Conference. EXHIBIT HALL DATES AND HOURS Sunday May 18, 2025: 10:30 a.m. – 3:30 p.m. Monday May 19, 2025: 10:30 a.m. – 3:30 p.m. Tuesday May 20, 2025: 10:30 a.m. – 3:30 p.m. *Please note these hours are subject to change and will be officially approved by October 1, 2024. Official hours will be posted on xxxxxxxxxx.xxxxxxxx.xxx. On the days the Exhibit Hall is open, exhibitors are allowed access into the hall 1.5 hours prior to hall opening. Exhibiting personnel may only remain in the Exhibit Hall up to 30 minutes after the hall closes unless prior authorization is received from the ATS. No exhibitors are allowed into the exhibit hall before 9:00am and after 4:00pm Sunday, May 18 through Tuesday, May 20 without ATS approval. INSTALLATION/MOVE-IN HOURS DISMANTLE/MOVE-OUT HOURS Friday May 16, 2025 8 a.m. – 5 p.m. Tuesday May 20, 2025 3:30 p.m. – 8 p.m. Saturday May 17, 2025 8 a.m. – 5 p.m. Wednesday May 21, 2025 8 a.m. – 5:30 p.m. All booths and material must be set-up by 5 p.m. on Saturday, May 17, 2025. Any booths unoccupied by 5pm on Saturday, May 17, 2025, are regarded as a no-show and the contract to exhibit is terminated unless the ATS has pre- authorized a late set-up. All freight is removed and returned to the loading dock at the exhibitor’s expense. For safety and security, no one under the age of 18 is allowed in the Exhibit Hall during move-in or move-out. Dismantling or tearing down exhibits prior to Tuesday, May 20, 2025 at 3:30 p.m. is prohibited. Bills of lading and return shipping labels are available at the Xxxxxxx Service Center.
