Eligible Checks and Items. You agree (i) to scan and transmit only checks as that term is defined in Federal Reserve Regulation CC ("Reg CC") and only those checks that are permissible under this section or such other items as we, in our sole discretion, elect to include under MDS; (ii) that the image of the check transmitted to us shall be deemed an "item" within the meaning of Article 4 of the applicable Uniform Commercial Code; and (iii) that you will not use MDS to scan and deposit any of the following checks or other items:

You agree that you will not use Mobile Deposit Capture to scan and deposit any checks or other items as shown below: • Checks or items payable to any person or entity other than you, or to you and another party. • Checks or items containing alteration to any of the fields on the front of the check or item (including the MICR line), or which you know or suspect, or should know or suspect, are fraudulent or otherwise not authorized by the owner of the account on which the check or item is drawn. • Checks or items previously converted to a substitute check, as defined in Reg CC. • Checks or items drawn on a financial institution located outside the United States. • Checks or items that are remotely created checks, as defined in Reg CC. • Checks or items not payable in United States currency. • Checks or items dated more than 6 months prior to the date of deposit. • Checks or items that are postdated, defined as having an issue date after the date of deposit. • Checks or items on which a stop payment order has been issued or for which there are insufficient funds. • Checks or items previously presented for payment to us or another financial institution. • Checks or items marked, in any manner, as “non-negotiable.” • Third party checks, defined as any item that is made payable to another party and subsequently endorsed to you by such party or any successor payee. • Checks or items prohibited by our current procedures relating to Mobile Deposit Capture or which are otherwise not acceptable under the terms of your Account. Nothing in this Agreement shall be construed as requiring us to accept any check or item for deposit, even if we have accepted that type of check or item previously. Nor shall we be required to identify or reject any checks or items that you may scan and deposit that fail to meet these requirements.
Eligible Checks and Items. In using Mobile Check Deposit, you agree to scan and remotely deposit into a deposit account only checks, as that term is defined in Federal Reserve Board Regulation CC (“Reg CC”). When the image of the check transmitted to CNB is converted to an Image Replacement Document for subsequent presentment and collection, it shall thereafter be deemed an "item" within the meaning of Article 4 of the Uniform Commercial Code as adopted in Oklahoma. You agree that you will NOT use Mobile Check Deposit to electronically present to CNB for deposit any of the following items:

Nor shall First Bank be required to identify or reject any checks or items that you may scan and deposit that fail to meet the requirements of this Agreement.

  • Investment of Account Assets a. All contributions to the custodial account shall be invested in the shares of the Provident Trust Mutual Funds, Inc. or, if available, any other series of Provident Trust Mutual Funds, Inc. or other regulated investment companies for which Provident Trust Company serves as Investment Advisor or designates as being eligible for investment. Shares of stock of an Investment Company shall be referred to as “Investment Company Shares”. To the extent that two or more funds are available for investment, contributions shall be invested in accordance with the depositor’s investment election.

  • Eligible Accounts The words “Eligible Accounts” mean at any time, all of Borrower’s Accounts which contain selling terms and conditions acceptable to Lender. The net amount of any Eligible Account against which Borrower may borrow shall exclude all returns, discounts, credits, and offsets of any nature. Unless otherwise agreed to by Lender in writing, Eligible Accounts do not include:

  • New Accounts Contractor may ask State Agencies and other Authorized Users to provide information in order to facilitate the opening of a customer account, including documentation of eligibility to use New York State Contracts, agency code, name, address, and contact person.   • Financial Institution with Only Low-Value Accounts An Estonian Financial Institution satisfying the following requirements:

  • Ineligible Items You agree that you will not use this Service to deposit any ineligible items, including, but not limited to, the following:

  • Accounts Excluded from Financial Accounts The following accounts are excluded from the definition of Financial Accounts and therefore shall not be treated as U.S. Reportable Accounts.
