It is agreed that enrollment preferences and selection methods are left to the discretion of the school so long as the School complies with the District’s enrollment policies (specifically, JCA-JFB and JCA-JFB-R, except to the extent those may be inconsistent with this Contract, including Appendices 9 or 10) and the requirements of state and federal law, including allowance for equal educational opportunities.

It is agreed that enrollment preferences and selection methods are left to the discretion of the School so long as School complies with requirements of applicable State and federal law, including allowance for equal educational opportunities. In this regard, the District authorizes the School to submit a weighted Lottery and Enrollment Policy to CDE for approval in connection with its Colorado Charter Schools Program (“CCSP”) grant application and, if approved by CDE, implement such policy. In cases where the School’s student demographics continue to meaningfully deviate from average student demographic of the other District high schools, the School will further enhance its weighted lottery the following year, subject to approval of CDE, to seek to xxxxxx a diverse student population. The intended use or non-use of an enhanced weighted lottery should be communicated via writing from the School to the District no later than December 1 of the preceding academic year. In cases of disagreement, the School’s Principal and the District’s Superintendent or designee shall meet and resolve no later than December 10 of that same year. Any unresolved dispute with respect to such matter may be immediately appealed to the State Board. The School reserves the right to determine logistics of conducting the enhanced weighted lottery.
