Entitlement Submittal. (a) Within the time set forth in the Schedule of Performance, the Developer will submit to the City a pre-application Project entitlement submittal for all Planning Approvals. The pre-application Project entitlement submittal ("Pre-Submittal") will include a preliminary analysis of land use entitlements required for the entire Project, for the City's review and approval. The Project described in the Pre-Submittal will be consistent with the Proposal and will include: . The Pre-Submittal will also include, in a form acceptable to the City, (i) an overview of sustainability measures that will be incorporated into the design and operation of the Project and (ii) a detailed description of the proposed use of the Site, including the square footage for each type of use; (b) a proposed development phasing schedule; (c) proposed housing 163\38\2715870.2 5 affordability and the nature of affordability controls, consistent with this Agreement, the Proposal and applicable City and State laws; (d) an updated Financing Proposal; and (e) a draft conceptual site plan. The draft site plan shall show the general location of the proposed buildings, landscaping and site improvements; the massing of any proposed buildings; roadways, parking and points of ingress and egress; and any other proposed improvements to be constructed as part of the Project.

  • Entitlement The allowances prescribed in this clause shall not be taken into account when calculating overtime penalty rates, annual leave, sick leave, long service leave or public holiday payments.
