Environmental and Social Provisions. 1. Without limitation to the provisions of Section 5.01 (b) of the General Conditions, the Borrower shall carry out and shall cause DER-SP to carry out the Project in accordance with the provisions and recommendations of the Updated Environmental Assessment (including provisions regarding chance finding and protection of cultural property) and the Involuntary Resettlement Framework, when applicable. 2. Prior to carrying out any civil works under the Project, the Borrower shall cause DER-SP to submit to the Bank evidence that environmental and social impacts have been identified and planned mitigation measures defined, in accordance with the provisions of the Updated Environmental Assessment and the Involuntary Resettlement Framework, as applicable. 3. The Borrower shall cause DER-SP to ensure that any contractors that will carry out civil works under the Project shall perform their work in accordance with the technical and environmental practices for the Project, as set forth in the Updated Environmental Assessment.

Environmental and Social Provisions. 1. Without limitation to the provisions of Section 5.01 (b) of the General Conditions and of Section I.B. of this Schedule, the Borrower, through MARENASS, shall carry out the Project in accordance with the provisions and recommendations of the EA (including provisions regarding pest management and social policies).
Environmental and Social Provisions. Without limitation to the provisions of Section 4.01 (b) of the General Conditions, the Recipient, through MAG-FOR, shall: 1. carry out or cause the Implementing Agencies and FUNICA to carry out the Project in accordance with the provisions of the EA; 2. carry out or cause the Implementing Agencies and FUNICA to carry out the Project in accordance with the provisions of the IPDP; and 3. carry out or cause the Implementing Agencies and FUNICA to carry out the Project in accordance with the provisions of the IPMP.
Environmental and Social Provisions. (a) The Recipient shall ensure that the terms of reference for any consultancies related to studies or technical assistance provided under the Project shall be satisfactory to the World Bank and, to that end, such terms of reference shall incorporate the requirements of the World Bank safeguards policies as applied to the advice conveyed through such studies and technical assistance. (b) The Recipient shall carry out the Project in accordance with the provisions and recommendations of the ESMF. (c) The Recipient shall, prior to the carrying out of any works under the Project: (a) carry out, or cause to be carried out, an environmental screening/assessment of each of the pertinent works, and if needed, as determined by the World Bank, approve or cause to be approved, an environmental management plan or similar environmental instrument, acceptable to the World Bank, for each of said works (which plan or similar environmental instrument shall be based on the results of the pertinent screening/assessment mentioned herein, and the World Bank’s comments on the results of said screening/assessment, if any); and (b) immediately after said approval, implement and/or cause to be implemented, the corresponding plan (or similar environmental instrument) in accordance with its terms. (d) The Recipient shall ensure that there will be no Resettlement under the Project.
Environmental and Social Provisions. Without limitation to the provisions of Section 5.01 (b) of the General Conditions and of Sections I.B. and I.C of this Schedule, the Borrower shall: 1. carry out the Project, and cause each and every Selected Irrigation Subproject to be carried out, in accordance with the provisions and recommendations of the EA and to carry out the environmental assessment according to the provisions of the EMP (including provisions regarding protection of natural habitats, forests and pest management); and

Environmental and Social Provisions. The European Parliament reserves the right to carry out itself any inspections and checks on the Contractor which are necessary to ensure compliance with the environmental and social and labour law requirements laid down in Article I.7. Such inspections and checks may be carried out in part or in full by an external body duly authorised by the European Parliament. Any failure on the Contractor’s part to comply with the obligations laid down or any refusal to allow inspection by the European Parliament or a duly authorised body shall entitle the European Parliament to terminate this contract.

Environmental and Social Provisions. Without limitation to the provisions of Section 5.01 (b) of the General Conditions, the Borrower shall cause the Project, and each and every Sub-project, to be carried out in accordance with the provisions and recommendations of the EA, the Indigenous Peoples Framework, the Resettlement Policy Framework and the procedures outlined in the Operational Manual (including provisions regarding protection of cultural property), when applicable.
Environmental and Social Provisions. Without limitation to the provisions of Section 5.01 (b) of the General Conditions and of Section I.B of this Schedule, the Borrower, through SE shall: 1. carry out and cause the Project to be carried out in accordance with the provisions and recommendations of the ESMF; and 2. prior to the approval of any proposed civil work(s) under the Project, the Borrower, through SE, shall, as per the ESMF: (a) carry out an environmental screening and assessment of such proposed civil work(s); (b) ensure that the design, construction and operation of said civil work(s) are consistent with appropriate environmental manuals; (c) provide necessary related training; and (d) prepare and implement the respective IPDP and/or RAP when necessary.

Without limitation to the provisions of Section 5.01 (b) of the General Conditions, the Borrower shall carry out the Project in accordance with the provisions and recommendations of the Regional Environmental Assessment and the respective Environmental Management Plan, the Resettlement Policy Framework, any applicable Resettlement Action Plan, the Bacanga Dam Safety Study and the procedures outlined in the Operational Manual, when applicable. 2. Prior to initiating any bidding procedure for works under Parts 2 and 3 of the Project in respect of which a Resettlement Plan is required in accordance with the provisions of the Resettlement Framework, the Borrower shall submit to the Bank, for its review and approval: (a) a Resettlement Action Plan for the population affected by the relevant works, to be prepared in accordance with the Resettlement Policy Framework; and (b) such other information as the Bank shall reasonably request, including the requisite national environmental licensing. 3. The Borrower shall ensure that any contractors that will carry out civil works financed under the Project shall perform their work in accordance with the technical, environmental and social practices for the Project, as set forth in the Resettlement Policy Framework, the Resettlement Action Plan, if applicable, the Bacanga Dam Safety Study, the Regional Environmental Assessment and the respective Environmental Management Plan. 4. For the purposes of Part 3. 2 of the Project the Borrower shall, not later than six months after the Effective Date establish, and thereafter maintain, until the completion of the Project, the Bacanga Dam Safety Panel with powers and composition satisfactory to the Bank as set forth in the Operational Manual, including the oversight of dam safety matters pursuant to the provisions of the Dam Safety Study.
