Expansion of Program. At such time as the Authority desires to expand the Curbside Recycling Service into other areas within the Service Area as defined herein, the Authority will provide to TFC Recycling a written notice for such expansion. The notice shall include a description of the expansion area, the number of Households to be added to the program, and the required date for initiation of services. The Authority will provide such notice at least 60 days prior to the required initiation date. TFC Recycling will deliver Carts to all Households in the expansion area one week before the initiation of services in the expansion area, on the collection day for the expansion area. In the event that an expansion results in unbalanced routes, TFC Recycling shall notify the Authority and changes may be made to the routes, as necessary for TFC Recycling to most efficiently use its collection equipment, with written approval of the Authority, which will not be unreasonably withheld.

Expansion of Program. SPV acknowledges that TFC may invite other timeshare developers ("Other Developers") to participate in the Program. TFC agrees that it will not allow an Other Developer to participate in the Program unless, immediately prior to such Other Developer's inclusion in the Program, TFC shall have made a good faith determination that at such time (x) such Other Developer satisfies eligibility criteria comparable in all material respects to the definition of Eligible Developer, and (y) any resorts of such Other Developer to be included in the Program satisfy eligibility criteria comparable in all material respects to the definition of Eligible Resort. SPV agrees that (i) an error by TFC in such good faith determination, whether or not based on misrepresentation or breach of contract by such Other Developer or otherwise, shall not be a breach of this Section, (ii) a change in circumstances following such determination that causes such Other Developer or resorts to cease to satisfy such eligibility requirements shall not be a breach of this Section, (iii) SPV's sole remedy for breach of this Section shall be a breach of contract claim against TFC, and no other Secured Party shall have any liability with respect to such breach, (iv) any amount owed in connection with such breach shall not be offset against the Obligations or the Parallel Claims, and (v) no such breach shall in any way change or delay the allocations or other determinations provided for in Section 2.4.
Expansion of Program. MSS further commits to expand its Food Waste collection program by encouraging other Marin County solid waste haulers to collect commercial food waste from their service areas, sharing education materials, and offering to Pre‐process their collected Food Waste at the Transfer Station for MSS’ Pre‐processing and Delivery to the Facility.
Expansion of Program. The Parties currently intend to extend their participation in the drilling of exploratory wxxxx to additional wxxxx and agree to enter into good faith discussions with respect to the possibility of expanding such participation to wxxxx in addition to the Program Wxxxx.

The Company will complete the Project at the Project Location. B. The Company represents that the number of permanent, Full-Time Employees (as defined in Indiana Code § 6–3.1–13–4) from whom Indiana state income tax withholdings are retained by the State of Indiana, employed as of the Commencement Date at the Project Location, is the Base Employment Number. C. The Project will result in the creation of New Employees (as defined in Indiana Code § 6- 3.1-13-6) at the Project Location of at least the Additional Jobs Commitment. D. The average of the hourly wages, before benefits, paid to New Employees at the Project Location, will at least equal the Average Wage Commitment. E. At the discretion of the IEDC, New Employees that are paid an average wage of less than the Minimum Wage Commitment may be excluded for the purpose of calculating the credit amount. F. The Project is anticipated to involve at least the Capital Investment Amount.

  • Payment of Project Activities County will reimburse Subrecipient for eligible project-related costs only. Subrecipient shall submit requests for reimbursement to County on a monthly basis beginning on August 1, 2021, and must provide adequate documentation as required by County in accordance with the OC Community Resources Contract Reimbursement Policy, as set forth in Exhibit 1, attached hereto and incorporated herein by reference. In addition, Subrecipient will provide a progress Grantee Performance Report (“GPR Information Form”) for the time period covered, as prescribed by County. Failure to provide any of the required documentation and reporting will cause County to withhold all or a portion of a request for reimbursement, or return the entire reimbursement package to Subrecipient, until such documentation and reporting has been received and approved by County.

  • Description of Projects Services a. Project/Services to be performed by A-E shall consist of the work as specified herein and as required in Attachment A. If in the event Attachment A shall be in conflict with any provision of this Contract, the wording as set forth in Attachment A shall prevail. b.
