Extension of Completion Date. The University may apply to CIMA for CIMA to give its consent to an extension of the Completion Date specified in Schedule 2. This application must be made to CIMA in writing at least 3 months prior to the expiration of the Completion Date specified in Schedule 2. At CIMA‟s sole discretion a maximum of two extensions may be granted of periods no longer than 6 months each. Save in the case of delays caused by Force Majeure Events as set out in clause 11(5), the University is required to apply to CIMA in writing for delays of more than 4 calendar weeks to any aspect of the Project or the delivery of any Output, and where such delays are likely to impact on the University‟s ability to meet the Completion Date, the University is required to request CIMA to consent to a new Completion Date. This provision is without prejudice to CIMA's other rights and remedies under this Agreement including its right to terminate this Agreement or to withhold funds. Any new Completion Date agreed between CIMA and the University shall be deemed to amend Schedule 2 as necessary and be binding on the University.

Extension of Completion Date. Borrower may extend the Completion Date for up to two (3) additional periods of one (1) month each (each such period being an “Extension Term”), provided that on or before the then-current Completion Date (prior to the extension of same then being requested), Borrower submits to Lender a written notice (an “Extension Notice”) of its election to so extend the Completion Date together with a payment to Lender of a fee in an amount equal to one-third of one percent (0.33%) of the original principal amount of the Loan; and (2) no Default or Event of Default shall exist under the Note, this Mortgage or any of the other Loan Documents, as of either the date on which the Extension Notice is submitted to Lender or the date on which the extension is to become effective. Notwithstanding anything herein to the contrary, in no event shall the Completion Date be extended pursuant to this Section 1.33 and no Extension Notice shall be effective unless as of the date on which the Extension Notice is submitted to Lender and the date on which the extension is to become effective, Lender determines (in its reasonable discretion) that the parties responsible under the Primary Lease for the construction of the Initial Improvements are diligently pursuing the completion of same and Borrower is diligently pursuing the satisfaction of all of the Completion Conditions.
Extension of Completion Date. In agreeing to complete the work within the contract time, Contractor has taken into consideration and made allowance for ordinary delays and hindrances incident to such work, whether growing out of delays of common carriers, delays in securing materials or workers, changes, omissions, alterations, or otherwise. The time for completion of the contract may be extended due to delays caused through no fault of the Contractor, which are commonly referred to in the construction industry as Acts of God. These excusable delays shall consist of fire, national emergency, extraordinary weather conditions that are beyond the reasonable control of Contractor. If any changes requested by the Owner increase the time needed for completion of the project, the Contractor shall request in writing a extension of the time for completion which must be agreed to and signed by the Owner at the same time that a change order for the changed work is signed. If a written extension of the time for completion is not signed by the Owner before the changed work is performed, then the completion date will not be extended.
