Extension of Time/ Period. The Affected Party shall be granted by the other Party, extension of time specified in this Agreement for the performance of any obligation by such period not exceeding the period during which the relative performance was affected by the Force Majeure Event. Such extension may include extension of the Concession Period by the Authority in appropriate cases.
Extension of Time/ Period. The time periods for the restrictions set forth in this Agreement shall be extended by the number of days in which Stockholder is in breach of such restrictions.
Extension of Time/ Period. (a) Upon the occurrence of any Force Majeure Event prior to the Date of Award of Concession, the period set forth in Clause 3.2 for fulfilment of Conditions Precedent shall be extended by a period equal in length to the duration of the Force Majeure Event.
(b) At any time after the Date of Award of Concession, if any Force Majeure Event occurs:
i. before COD, the Concession Period and the dates set forth in the Project Completion Scheduleshall be extended by a period equal in length to the duration for which such Force Majeure Event subsists; or
ii. after COD, whereupon the Concessionaire is unable to collect Tariff despite making best effortsor it is directed by the Concessioning Authority to suspend the collection thereof during the subsistence ofsuch Force Majeure Event, the Concession Period shall be extended by a period,equal in length to the period during which the Concessionaire was prevented from collection ofTariff on account thereof; provided that in the event of reduction in collection of Tariff on accountof partial inability or suspension, as the case may be, which causes the daily collection to decline below 90% of the Average Daily Tariff, the Concessioning Authority shall extend the ConcessionPeriod in proportion to the loss of Tariff on a daily basis. For the avoidance of doubt, loss of 25% in collection of Tariff as compared to the Average Daily Tariff for 4 (four) days shall entitlethe Concessionaire to extension of 1 (one) day in the Concession Period
Extension of Time/ Period. The Option Agreement (as amended by the Amending Agreement) be and it is hereby amended as follows:
Extension of Time/ Period. The time period during which you are to refrain from any of the activities listed in this Agreement will be automatically extended by any length of time during which you or any of your affiliates, successors or assigns are in breach of any provision of this Agreement. This Agreement will continue through the duration of the extended time periods.
Extension of Time/ Period. The 30-day periods for exercise of certain rights under Sections 2, 7, 8, and 12 shall be extended so that each such period expires 30 days after all regulatory approvals required for the exercise of such rights have been obtained and all statutory waiting periods have expired; and shall be further extended to the extent necessary to avoid liability under Section 16(b) of the 1934 Act by reason of such exercise. No such extensions shall extend the period for the Holder to exercise the Option to a date more than 2 years after the date of this Agreement.
Extension of Time/ Period. Recipient may at any time not less than thirty (30) days prior to the scheduled termination date of a Transition Service, as set forth in the applicable Transition Service Schedule, request in writing to Provider to extend the Time Period for such Transition Service. To the extent requested by Recipient and consented to by Provider, which consent shall not be unreasonably withheld, conditioned or delayed, Provider shall provide such Transition Services during the extended Time Period (the “Extended Transition Services”) on the terms and conditions set forth in this Agreement (after taking into account any amendments or modifications to the terms and conditions of this Agreement that are implemented in connection with such extension), and for a such time period and at such cost as shall be mutually agreed to in good faith by Provider and Recipient; provided, however, that any Extended Transition Services shall not be provided after unless Provider has consented thereto, which consent may be given or withheld in Provider’s sole and absolute discretion. To the extent that the termination date for any Transition Service has been extended pursuant to this Section 7(b), the Time Period for such Service shall be deemed to be extended accordingly. If CloudCo and MC are unable to agree within ten (10) days of a request on the terms and conditions of an extension of a Time Period, such Dispute shall be resolved in accordance with Section 3.
Extension of Time/ Period. If it shall be determined that Executive has violated any of his obligations under the Agreement, then the period applicable to the obligation which Executive shall have been determined to have violated shall automatically be extended by a period of time equal in length to the period during which said violation(s) occurred.
Extension of Time/ Period. In the event that the Employee violates any legally enforceable provision of this Agreement as to which there is a specific time period during which the Employee is prohibited from taking certain actions or from engaging in certain activities, then the time period shall be extended for the same amount of time that any such violation continued.
Extension of Time/ Period. Such extension may include extension of the Concession period by the Authority in appropriate cases if permissible under Applicable Law. If the period of Force Majeure continues or is in the reasonable judgment of the Parties likely to continue beyond a period of 120 (one hundred and twenty) Days, the Parties may mutually decide to terminate this Agreement or continue this Agreement on mutually agreed revised terms. If the Parties are unable to reach an agreement in this regard, the Affected Party shall after the expiry of the said period of 120 (one hundred and twenty ) Days be entitled to terminate the Agreement in which event, the provisions of Articles 16 and 17 shall, to the extent expressly made applicable, apply.
